In this case, the Complainant had, in his application dated 28<br \/>\nNovember 2008, requested the CPIO for a number of information in respect<br \/>\nof the OD account of M\/s Sree Srinivasa Construction Co. In his reply dated<br \/>\n16 January 2009, the CPIO declined to disclose the information on the<br \/>\nground that the matter was pending before the DRT. Not satisfied with this<br \/>\nreply, the Complainant preferred an appeal on 4 February 2009. It is not<br \/>\nclear if the Appellate Authority passed any order. The Complainant is now<br \/>\nbefore the CIC alleging that he was wrongly denied the information.\n<\/p>\n<p>3.      We heard this case through videoconferencing. The Appellant was not<br \/>\npresent in spite of notice. The Respondent was present in the Mangalore<br \/>\nstudio of the NIC. We heard his submissions. He submitted that the<br \/>\ninformation had not been disclosed at the time of the application since the<br \/>\nmatter was pending before the DRT and the disclosure of the information<br \/>\ncould have adversely affected the commercial interests of the Bank. He also<br \/>\nadmitted that the CPIO had not mentioned the exact provision of the Right<\/p>\n<p>CIC\/SM\/A\/2009\/000674<br \/>\n to Information (RTI) Act under which he had decided to withhold the<br \/>\ninformation. He, however, agreed to provide the information now that the<br \/>\ncase had been decided.\n<\/p>\n<p>4.      We, therefore, direct the CPIO to provide to the Appellant within 10<br \/>\nworking days from the receipt of this order all the information sought by<br \/>\nhim.\n<\/p>\n<p>5.      The case is, thus, disposed off.\n<\/p>\n<p>6.
