Corrie  this Writ Petition impugning the judgment and<\/p>\n
K  award v\ufb02hdated 20.10.2009 wherein its application under<\/p>\n
Section 152 read with Section 151 of CPC for amendment of<\/p>\n
the judgment and award is dismissed.\n<\/p>\n<\/p>\n

The petitioner — insurance c0.IIii3any=_,’v”is; the second’<\/p>\n
respondent in the ciairn  filed’ the ‘respondent
\nnos.l and 2 herein  for the death of
\ntheir son T. Harshadee\ufb01in \u00a2b1,r1oi’:or.’  which took
\nplace on 28.21     at”Manasa Gangotri Road,
\nMysore,  a motor cycle bearing<\/p>\n
Regis:tratior1rVi\u00a7o.K}; 1074?\n<\/p>\n
3;  vfact_t’hlat= deceased T. Harshadeep met with an<\/p>\n
accident while travelling as pillion rider on the motor cycle<\/p>\n
   respondent, in the said accident he suffered<\/p>\n
 .ir1j’uries ttuviiead, succumbed to it later is not in dispute.<\/p>\n
It  also  in dispute that respondent nos.l and 2 \ufb01led<\/p>\n
 claim petition against the owner and insurer of the said<\/p>\n

vehicle in MVC 160.359\/2000 seeking compensationhlfor the<\/p>\n
death of their son.\n<\/p>\n
4. During the pendency the said’<\/p>\n
second petitioner died, in that hehaif. a3 :\ufb01leii1,n_on<\/p>\n
10.08.2006. Thereafter. the’ -clairnt<\/p>\n
from time to time for taking\ufb02lsteps 0′  the legal
\nrepresentatives of ‘.ge\u00a2.9;id’\u00abp\u00a2t:uoae} on record.
\nHowever, subsequently.V:’pd\u00a71eV__\ufb01tfo  recording the
\nproceeding,  the Tribunal
\nrecorded   dead instead of recording
\nthe  the said mistake
\nperpetuated  claim petition being dismissed<\/p>\n
as against””secora.d.’.respondent in first place, which resulted<\/p>\n
   second “respondent not participating in the<\/p>\n
 L’  15.11.2007. Thereafter, the claim petition<\/p>\n
is disposed,  on merits awarding compensation to the<\/p>\n
 petitioner nos.1 and 2 who are respondent r1os.1 and 2 in<\/p>\n
hm?\n<\/p>\n
this proceedings by fixing the liability to pay the-“~.entire<\/p>\n
compensation by respondent No.2.\n<\/p>\n<\/p>\n

with 151 to bring the said mistake  noti;ce..Ajof,the_\u00a7court,i ”<\/p>\n
It is seen that the Tribunai xiifithotit  its} mind and
\nwithout Iooking into;..4′.tiie  in the file has
\ndismissed the same, whichorderiis  by the second<\/p>\n
respondent e”in\u00e9;u.i’a.nce coriipany’it’1’ti1is”Writ Petition.<\/p>\n
;;notioe  served on first respondent and
\nthird :’r__espondei1t”vthey’haike. remained exparte. Insofar as the
\nnotice issued to se’cond””.petitioner in the court beiow, the<\/p>\n
sanjzehas co’n:=e”baci\u00a7: with an endorsement that second<\/p>\n

A 7.’  court heard the counsel for the petitioner<\/p>\n
 regarding the order passed by the Tribunai dismissing its<\/p>\n
 \u00bb application \ufb01led under Section 152 read with Section 151 of<\/p>\n

CPC. On perusal of the order dated 20.10.2009 andslalso on<\/p>\n
going through the entire records maintained <\/p>\n
in MVC No.359\/2000, it is seen that  <\/p>\n
conducted the claim petition in :a”*\u00a2a1~e1\u00a2ss man”ne_r_Withoi\u00ab1t 5<\/p>\n
even ascertaining the facts properly-_Vheforev’~v_disposVing–~.theL<\/p>\n
claim petition.\n<\/p>\n
8. The order   ot the Tribunal

\ncourt   after several dates

\ninsurance   and consequently dismissed the<\/p>\n
