PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.DK Parihar, for the petitioners.<br \/>\nMr.OP Mehta     ) for the respondents.\n<\/p>\n<pre>Mr.GR Calla     )\n                         - - - - -\n\n<\/pre>\n<p>    Heard learned counsel for the parties.\n<\/p>\n<p>    The present writ petition has been filed by<br \/>\nthe petitioner no.1 &#8211; Shri Umed Kanya Pathsala, a<br \/>\nregistered    society,     through    its   Secretary     and<br \/>\nPetitioner No.2 &#8211; Shri Umed Kanya Secondary School<br \/>\nthrough   its     Manager\/Secretary.        In   the     writ<br \/>\npetition, following reliefs have been prayed :-\n<\/p>\n<blockquote><p>    &#8220;(a) The order dated 17.8.2002 i.e. Ex.17 be<br \/>\n    quashed.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                              2<\/span><\/p>\n<blockquote><p>                        S.B. Civil Writ Petition No.3302\/2002<\/p>\n<p>                             Shri Umed Kanya Pathsala &amp; Anr.\n<\/p><\/blockquote>\n<blockquote><p>                                                 vs.\n<\/p><\/blockquote>\n<blockquote><p>                                    State of Rajasthan &amp; Ors.\n<\/p><\/blockquote>\n<blockquote><p>    (b)           The       certification\/verification\/<br \/>\n    recognition done by the Respondent no.3 on<br \/>\n    1.3.2002     or   any   document    prepared     by   the<br \/>\n    Respondent No.3 for the matter in dispute be<br \/>\n    quashed.\n<\/p><\/blockquote>\n<blockquote><p>    (c)    The Respondents no.1 to 3 be directed<br \/>\n    not to exercise the jurisdiction which is not<br \/>\n    vested in them in this matter under the Act<br \/>\n    1989 and Act 1958.\n<\/p><\/blockquote>\n<blockquote><p>    (d)    Any     other     relief     for      which    the<br \/>\n    petitioners are entitle, be granted.&#8221;<\/p><\/blockquote>\n<p>    Detail facts may not be necessary in view of<br \/>\nthe fact that the order dated 17.8.2002 (Annex.17)<br \/>\nwhich is under challenge was issued by the Special<br \/>\nSecretary, Education because of the reason that a<br \/>\nwrit petition no.3919\/2001 was filed by one Hemraj<br \/>\nwherein the following directions were issued on<br \/>\n7.2.2002 :-\n<\/p>\n<blockquote><p>    &#8220;The      petitioner    will      approach    Education<br \/>\n    Department with the grievances which he claims<br \/>\n    to be existing. The Department will hear the<br \/>\n    petitioner and pass orders in accordance with<br \/>\n<span class=\"hidden_text\">                                           3<\/span><\/p>\n<p>                               S.B. Civil Writ Petition No.3302\/2002<\/p>\n<p>                                      Shri Umed Kanya Pathsala &amp; Anr.\n<\/p><\/blockquote>\n<blockquote><p>                                                          vs.\n<\/p><\/blockquote>\n<blockquote><p>                                             State of Rajasthan &amp; Ors.\n<\/p><\/blockquote>\n<blockquote><p>      law. With these observations the writ petition<br \/>\n      is disposed of.&#8221;<\/p><\/blockquote>\n<p>      In    pursuance         of    the       said    directions,         after<br \/>\nhearing the parties, it has been held that the<br \/>\nelection      of        the        managing          committee       of     the<br \/>\npetitioner no.2 was held on 30.12.2001. 15 members<br \/>\nwere elected for the managing committee, 6 members<br \/>\nwere co-opted and thereby total 21 members are in<br \/>\nthe executive committee and the constitution of<br \/>\nthe   executive         committee             is   proper.       Both     these<br \/>\nissues were considered and it was observed that<br \/>\none of the member Amar Singh was suspended from<br \/>\nmembership of the society on 10.7.2001. Said order<br \/>\nwas   set    aside      on     17.7.2001           but     in    order    dated<br \/>\n2.8.2002,      it       was        held       that    the       order     dated<br \/>\n17.7.2001 was not in accordance with law and the<br \/>\nsuspension         of     Amar        Singh          was        upheld.     The<br \/>\npetitioners&#8217; grievance is against the order dated<br \/>\n17.8.2002 (Annex.17) and the contention of learned<br \/>\ncounsel      for        the         petitioners            is     that      the<br \/>\nrespondents         had       no     authority           to     declare     the<br \/>\nelection dated 16.2.2001 to be valid nor had right<br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>                             S.B. Civil Writ Petition No.3302\/2002<\/p>\n<p>                                 Shri Umed Kanya Pathsala &amp; Anr.\n<\/p>\n<p>                                                     vs.\n<\/p>\n<p>                                        State of Rajasthan &amp; Ors.\n<\/p>\n<p>to pass any order in the affairs of the society.\n<\/p>\n<p>    From the tenor of Annex.17, it appears that<br \/>\nsome person informed the Government that in the<br \/>\naffairs        of     the     managing        committee,          some<br \/>\ndisturbance is         created    upon   and      this    order    was<br \/>\nissued    on    17.8.2002      that    the     Deputy     Director,<br \/>\nEducation should take care that there should be no<br \/>\nhindrance       in     the     working       of    the     managing<br \/>\ncommittee.\n<\/p>\n<p>    Undisputedly, the term of managing committee<br \/>\nof the year 2002 had come to an end in the year<br \/>\n2005 and now in this writ petition, no relief has<br \/>\nbeen claimed for setting aside the election of the<br \/>\nsaid managing committee and, therefore, no issue<br \/>\nwith respect to the validity in the constitution<br \/>\nof the managing committee is under consideration<br \/>\nbefore this Court in this writ petition and the<br \/>\norder     dated      17.8.2002    (Annex.17)        had    its     own<br \/>\ntenure which came to an end.\n<\/p>\n<p>    The        petitioners&#8217;      another       relief      is     with<br \/>\n<span class=\"hidden_text\">                                   5<\/span><\/p>\n<p>                             S.B. Civil Writ Petition No.3302\/2002<\/p>\n<p>                                  Shri Umed Kanya Pathsala &amp; Anr.\n<\/p>\n<p>                                                      vs.\n<\/p>\n<p>                                         State of Rajasthan &amp; Ors.\n<\/p>\n<p>respect      to   challenge           to    Annex.18       which   is<br \/>\npurported     decision       to      constitute     the     managing<br \/>\ncommittee on 16.2.2002.\n<\/p>\n<p>      Learned counsel for the respondent State as<br \/>\nwell as private respondents pointed out that the<br \/>\nState       has      already         send    its       departmental<br \/>\nrepresentative as required by Rule 23(1)(e) of the<br \/>\nRules   of    1993     which    is     apparent     from    Annex.18<br \/>\nitself. Be it as it may be, the fact is that the<br \/>\nterm of the said committee admittedly has come to<br \/>\nan end and nothing survives in this writ petition<br \/>\nso far as challenge to said constitution of the<br \/>\ncommittee.\n<\/p>\n<p>      Learned counsel for the petitioners submitted<br \/>\nthat the term of second managing committee also in<br \/>\nthe facts has already come to end in the year 2008<br \/>\nand   the    society    is     free    to   elect    its    managing<br \/>\ncommittee.\n<\/p>\n<p>      The above issue is not involved in this writ<br \/>\npetition     because    of     the    reason   that     nobody     can<br \/>\nprevent a lawfully constituted body to undertake<br \/>\nall the exercises which they are under obligation<br \/>\nby the virtue of Byelaws and Rules governing their<br \/>\n<span class=\"hidden_text\">                                  6<\/span><\/p>\n<p>                           S.B. Civil Writ Petition No.3302\/2002<\/p>\n<p>                                 Shri Umed Kanya Pathsala &amp; Anr.\n<\/p>\n<p>                                                     vs.\n<\/p>\n<p>                                        State of Rajasthan &amp; Ors.\n<\/p>\n<p>affairs. How the society should work and proceed,<br \/>\nthere is no need of any direction of any Court.<br \/>\nTheir     acts    and    actions      unless    challenged      and<br \/>\naggrieved    party      approaches     the     Court,    they   are<br \/>\nfree to proceed in accordance with law and rules.\n<\/p>\n<p>    In view of the above reasons, there is no need<br \/>\nto issue any direction and, therefore, this writ<br \/>\npetition has become infructuous and the same is<br \/>\nhereby dismissed.\n<\/p>\n<p>    Learned       counsel       for   the     respondent     State<br \/>\nsubmitted    that       there    is   a     litigation     pending<br \/>\nbetween     the    private      parties      with   respect      to<br \/>\nvarious issues.\n<\/p>\n<p>    Be it as it may be, no issue is decided in<br \/>\nthis writ petition by this Court and, therefore,<br \/>\nthe merits of the suit are not affected in any<br \/>\nmanner by any observation made in this order, is<br \/>\nmade clear expressly.\n<\/p>\n<p>                                            (PRAKASH TATIA), J.\n<\/p>\n<p>S.Phophaliya\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Shri Umed Kanya Pathsala &#8230; vs State &amp; Ors on 17 July, 2009 1 S.B.
