{"id":24389,"date":"2010-03-10T00:00:00","date_gmt":"2010-03-09T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/dula-ram-vs-state-on-10-march-2010"},"modified":"2018-02-04T07:44:18","modified_gmt":"2018-02-04T02:14:18","slug":"dula-ram-vs-state-on-10-march-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/dula-ram-vs-state-on-10-march-2010","title":{"rendered":"Dula Ram vs State on 10 March, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Rajasthan High Court &#8211; Jodhpur<\/div>\n<div class=\"doc_title\">Dula Ram vs State on 10 March, 2010<\/div>\n<pre>                                    1\n\n   IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT\n                       JODHPUR.\n\n\n                          J U D G M E N T\n\n\n\n\nDula Ram                      vs.            State of Rajasthan\n\n\n\n              D.B.Criminal Appeal No.796\/2003\n              against   the     judgment    dated\n              17.7.2003 passed by Additional\n              Sessions   Judge,    Deedwana,   in\n              Sessions Case No.36\/2002.\n\n\n\nDate of Judgment                    ::             10th March, 2010\n\n\n\n\n                          P R E S E N T\n\n              HON'BLE MR.JUSTICE GOVIND MATHUR\n                HON'BLE MR.JUSTICE C.M.TOTLA\n\n\nMr. Rajesh Panwar, for the appellant.\nMr. Anil Upadhyay, PP, for the State.\n                         ....\n\n\n\n\nBY THE COURT : (PER HON'BLE MATHUR,J.)<\/pre>\n<p>             For the offences punishable under Sections<\/p>\n<p>302,   324    and   323    IPC,   the    accused    appellant   was<\/p>\n<p>convicted under judgment dated 17.7.2003, passed by<\/p>\n<p>learned Additional Sessions Judge, Deedwana and was<\/p>\n<p>ordered to be sentenced as under:-\n<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>302 IPC : life term with a fine of Rs.500\/- and in<\/p>\n<p>default     to   which     further        to   undergo    five     months<\/p>\n<p>rigorous imprisonment;\n<\/p>\n<p>324 IPC : one year&#8217;s rigorous imprisonment with a fine<\/p>\n<p>of Rs.200\/- and in default to which further to undergo<\/p>\n<p>two months simple imprisonment; and<\/p>\n<p>323 IPC : three months rigorous imprisonment with a<\/p>\n<p>fine of Rs.100\/- and in default to which further to<\/p>\n<p>undergo one month&#8217;s simple imprisonment.<\/p>\n<p>            In brief, the facts of the case are that PW-<\/p>\n<p>4   Smt.   Bhanwari      Devi    on   2.9.2002    made    a    statement<\/p>\n<p>before the       Station    House     Officer    of     Police Station<\/p>\n<p>Maulasar that on the same day at about 09:00 AM her<\/p>\n<p>son Dula Ram gave an axe blow on the head of his wife<br \/>\nSmt. Shanti and also gave an axe blow to her when she<\/p>\n<p>went into the room on hearing cry of Smt. Shanti. As<\/p>\n<p>per statement, Dula Ram then ran away from the house<\/p>\n<p>and on way he also gave an axe blow to Smt. Soni who<\/p>\n<p>was passing through the path. Smt. Bhanwari Devi also<\/p>\n<p>stated that from last about 15 days Dula Ram was not<\/p>\n<p>feeling well and he was making a complaint about his<\/p>\n<p>mental condition. On basis of the statement aforesaid<\/p>\n<p>(Ex.P\/16)    a    case     was   registered       for    the     offences<\/p>\n<p>punishable under Sections 302 and 307 IPC and after<\/p>\n<p>regular investigation a charge sheet was filed. The<\/p>\n<p>matter then was committed for trial and charges were<br \/>\n<span class=\"hidden_text\">                                         3<\/span><\/p>\n<p>framed for the offences punishable under Sections 302,<\/p>\n<p>307, 323 and 324 IPC. The accused appellant denied the<\/p>\n<p>allegations and desired for trial.\n<\/p>\n<\/p>\n<p>               The prosecution supported its case with the<\/p>\n<p>aid of 22 witnesses, out of whom PW-4 Bhanwari Devi<\/p>\n<p>and     PW-5     Soni    Devi     are       the     eye      witnesses.       The<\/p>\n<p>prosecution also got 43 documents (Ex.P\/1 to Ex.P\/43)<\/p>\n<p>exhibited.       PW-21     Jitendra         Singh    being        investigating<\/p>\n<p>officer        stated      about        the         steps        taken       while<\/p>\n<p>investigating       the     matter          and     PW-16    Dr.      Moti    Raj<\/p>\n<p>conducted       autopsy     on    the       body,     thus        approved    his<\/p>\n<p>postmortem report. As per the postmortem report the<\/p>\n<p>body was having an antemortem incised wound 3\u00bd&#8221; x 2&#8243; x<\/p>\n<p>2&#8243; deep from left nuchel line to neck. And the cause<\/p>\n<p>of death in opinion of Dr. Moti Raj was shock because<\/p>\n<p>of head injury and loss of blood as a consequent to<br \/>\nthe     injury     aforesaid.      The        weapon        of     offence    was<\/p>\n<p>recovered on 2.9.2002 on basis of disclosure made by<\/p>\n<p>the     accused.    The     weapon          was     having        blood    stains<\/p>\n<p>matching with the blood group of deceased Smt. Shanti.<\/p>\n<p>The Forensic Science Laboratory&#8217;s report is available<\/p>\n<p>on record as Ex.P\/24.\n<\/p>\n<\/p>\n<p>               PW-4 Smt. Bhanwari Devi, who is mother of<\/p>\n<p>accused, was declared as hostile witness, however, the<\/p>\n<p>trial court while relying upon the statements of PW-5<\/p>\n<p>Smt. Soni Devi, PW-10 Hardeen Ram, PW-11 Nathi Devi,<\/p>\n<p>PW-12     Rampal     and    the    investigating                 officer     PW-21<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>Jitendra Singh, found the accused appellant guilty for<\/p>\n<p>the offences concerned and sentenced accordingly.<\/p>\n<p>              While    challenging        the       conviction       recorded<\/p>\n<p>and the sentence awarded, the contention of counsel<\/p>\n<p>for the appellant is that even by accepting the entire<\/p>\n<p>case of the prosecution no case of culpable homicide<\/p>\n<p>amounting to murder is made out as in the instant<\/p>\n<p>matter    motive      and    intention         of    causing     death    is<\/p>\n<p>conspicuously absent.\n<\/p>\n<\/p>\n<p>              While     opposing         the        argument       advanced,<\/p>\n<p>learned Public Prosecutor urged that the injury given<\/p>\n<p>by    accused    to    his    wife       on    a    vital   part     clearly<\/p>\n<p>establishes that he was intending to kill Smt. Shanti.<\/p>\n<p>He further pointed out that the accused after giving<\/p>\n<p>axe    blow     to    his    wife    also      assaulted       his    mother<br \/>\nBhanwari Devi and PW-5 Smt. Soni Devi with axe and<\/p>\n<p>that   clearly       establishes     that      he    wanted    to    abscond<\/p>\n<p>from the place after committing the offence.<\/p>\n<p>              Having considered the arguments advanced and<\/p>\n<p>on examination of record, we are of the view that<\/p>\n<p>ample evidence is available on record to establish the<\/p>\n<p>fact relating to death of Smt. Shanti as a consequent<\/p>\n<p>to axe blow given by the accused.\n<\/p>\n<\/p>\n<p>              True it is, PW-4 Smt. Bhanwari Devi did not<\/p>\n<p>support the prosecution case, however, the statements<br \/>\n<span class=\"hidden_text\">                                           5<\/span><\/p>\n<p>of PW-5 Smt. Soni Devi in detail narrates the entire<\/p>\n<p>incident. As per Smt. Soni, on the date of occurrence<\/p>\n<p>when she was on way to her parental field one other<\/p>\n<p>lady    Manbhari       wife        of   Balu       Ram    came     to     her    and<\/p>\n<p>informed that Dula Ram has given an axe blow to Smt.<\/p>\n<p>Bhanwari.       She    also       found       Smt.    Bhanwari      lying       down<\/p>\n<p>unconscious on path. She further stated that Dula Ram<\/p>\n<p>killed    his        wife.        In    cross        examination          too    she<\/p>\n<p>reiterated      with        all    confidence         whatever       she    stated<\/p>\n<p>during examination in chief. It is pertinent to note<\/p>\n<p>that Smt. Soni is real sister of accused and she also<\/p>\n<p>received an injury because of an axe blow given to her<\/p>\n<p>by accused Dula Ram.\n<\/p>\n<\/p>\n<p>            PW-10 Hardeen Ram, PW-11 Nathi Devi and PW-<\/p>\n<p>12     Rampal        also     deposed          before        the     court      and<\/p>\n<p>corroborated          whatever          stated       by   Smt.       Soni.       The<br \/>\nevidence relating to recovery of blood stained weapon<\/p>\n<p>and medical evidence also establishes killing of Smt.<\/p>\n<p>Shanti as per prosecution story.\n<\/p>\n<\/p>\n<p>            As already stated above, blood stained axe<\/p>\n<p>was recovered from the accused and the blood stains<\/p>\n<p>matched    with       blood       group       of   deceased        Smt.    Shanti.<\/p>\n<p>Learned counsel for the appellant too looking to all<\/p>\n<p>the facts and circumstances of the case confined his<\/p>\n<p>argument to          the    extent of          determination         of    offence<\/p>\n<p>committed       by     the        appellant.         Thus,     precisely         the<\/p>\n<p>question before us is whether the instant one is a<br \/>\n<span class=\"hidden_text\">                                          6<\/span><\/p>\n<p>case of murder or culpable homicide not amounting to<\/p>\n<p>murder?\n<\/p>\n<\/p>\n<p>             As per parcha bayan Ex.P\/16, Dula Ram gave a<\/p>\n<p>single blow to Smt. Shanti and then to Smt. Bhanwari<\/p>\n<p>and then while running he also gave certain injuries<\/p>\n<p>to    Smt.   Soni      who     is     his      real     sister.       PW-4      Smt.<\/p>\n<p>Bhanwari Devi was declared hostile, however, PW-5 Smt.<\/p>\n<p>Soni stated that when he was going to the place of<\/p>\n<p>occurrence she found her mother lying unconscious on<\/p>\n<p>the way and she was having an injury. No evidence is<\/p>\n<p>available      on     record     to      establish       intention         of   the<\/p>\n<p>accused to give a bodily injury to Smt. Shanti with an<\/p>\n<p>intention      to     kill     her.       It     is   also      the     position<\/p>\n<p>admitted that deceased was having a single antemortem<\/p>\n<p>injury. If the accused was having any intention to<\/p>\n<p>kill her then he had opportunity or to say that no one<br \/>\nwas    there     to     stop     him      from    doing       so.     In      these<\/p>\n<p>circumstances         we   are      of   the     view    that     the      offence<\/p>\n<p>committed by the accused is of giving a bodily injury<\/p>\n<p>sufficient to cause death without having intention to<\/p>\n<p>kill   Smt.     Shanti,        therefore,         the    conviction           under<\/p>\n<p>Section 302 IPC is not proper. So far as conviction of<\/p>\n<p>the    accused        under    Sections         324     and     323     IPC     are<\/p>\n<p>concerned, those have not been even challenged in this<\/p>\n<p>appeal by counsel for the appellant.\n<\/p>\n<\/p>\n<p>             In view of whatever discussed above, we are<\/p>\n<p>inclined to accept this appeal in part. Accordingly,<br \/>\n<span class=\"hidden_text\">                                     7<\/span><\/p>\n<p>the   same   is   partly      allowed.      The    judgment     impugned<\/p>\n<p>dated    17.7.2003       is   set       aside    to     the   extent    of<\/p>\n<p>conviction of appellant Dula Ram son of Keshra Ram for<\/p>\n<p>an offence under Section 302 IPC and he is convicted<\/p>\n<p>for     an   offence     under      Section       304     part-II      IPC.<\/p>\n<p>Accordingly, the sentence of life term with fine of<\/p>\n<p>Rs.500\/-     is   also    modified        and     is    substituted     by<\/p>\n<p>sentence of rigorous imprisonment for a term of eight<\/p>\n<p>years with fine of Rs.500\/- and in default to which<\/p>\n<p>further to undergo five months rigorous imprisonment.<\/p>\n<p>The conviction and sentence awarded by the trial court<\/p>\n<p>for commission of offences under Sections 324 and 323<\/p>\n<p>IPC are maintained.\n<\/p>\n<\/p>\n<pre>( C.M.TOTLA ),J.
