Anu Sivaraman, the learned Government<\/p>\n<p>Pleader appearing for the first respondent, Sri. K. Anand,<\/p>\n<p>the learned standing counsel appearing for the second<\/p>\n<p>respondent and Sri. Murali Purushothaman, the learned<\/p>\n<p>counsel appearing for the third respondent. When the writ<\/p>\n<p>petition was called upon for hearing today, there was no<\/p>\n<p>representation for the petitioner.\n<\/p>\n<p>      2. Sri K.Anand, the learned standing counsel<\/p>\n<p>appearing for the second respondent submits that         the<\/p>\n<p>petitioner had earlier filed a writ petition seeking<\/p>\n<p>appointment as Mazdoor, that the second respondent<\/p>\n<p>resisted the said writ petition contending, inter alia, that<\/p>\n<p>the petitioner was over aged as on 01.01.2004, that the said<\/p>\n<p>disability continues to exist and that the second respondent<\/p>\n<p>has not taken steps to appoint Mazdoors from the open<\/p>\n<p>W.P.(C) 10043\/09                       -2-\n<\/p>\n<p>market. The learned standing counsel also submits that<\/p>\n<p>earlier writ petition filed by the petitioner was disposed of<\/p>\n<p>by Ext. P8 judgment with the          direction that petition&#8217;s<\/p>\n<p>candidature would also be considered as and when<\/p>\n<p>vacancies arise, if he applies pursuant to the notification<\/p>\n<p>issued by the second respondent, if he is otherwise eligible.<\/p>\n<p>The learned standing counsel further submits that the<\/p>\n<p>second respondent has not so far taken steps to issue a<\/p>\n<p>notification    inviting applications     for appointment    of<\/p>\n<p>Mazdoors from the open market and that the petitioner has<\/p>\n<p>no cause of action.\n<\/p>\n<p>         On going through the pleadings and after hearing<\/p>\n<p>the submissions made at the Bar by the learned standing<\/p>\n<p>counsel for the second respondent, I am persuaded to agree<\/p>\n<p>with the learned standing counsel for the second<\/p>\n<p>respondent that the petitioner has no cause of action to<\/p>\n<p>maintain this writ petition.\n<\/p>\n<p>       This writ petition fails and is accordingly dismissed.<\/p>\n<p>                                     P.N.RAVINDRAN,<br \/>\n                                     JUDGE.\n<\/p>\n<p>mn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Babu Rajan.K. vs State Of Kerala Represented By &#8230; on 25 May, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 10043 of 2009(A) 1.
