4.  TheVeontention’~v–._.o’f’ the claimant before the<\/p>\n
Commissioner for Worknie\ufb02s Compensation is as under:<\/p>\n
Tfigie Ciairnaiatqvaps a bus conductor working under<\/p>\n
“r_espon.den_t’~NoV.’1v in a bus bearing registration No.TN-23-A-<\/p>\n
  95.55.’*~’That7[jon.1=.”t)9.03.2OO3 at about 1.50 p.m. the bus<\/p>\n
 stopped ..ata..D.o4mmasandra Village, which is on Mulbagal V-<\/p>\n
 .A__i{fota’CCRoad. The claimant was on duty as a conductor in<\/p>\n
6\/<\/p>\n
4<\/span><\/p>\n
the said bus. When he was boarding the bus from the front
\ndoor, at that time, the driver of the bus Without observing<\/p>\n
the passengers and also the claimant boarding<\/p>\n
moved the bus. Consequently, the cIaimant__fe1t  <\/p>\n
sustained injuries. The claimant ;\u00a7)vas”dra’wing–   of<\/p>\n
Rs.4,000\/– per month and bata at \/– pier. <\/p>\n
the accident, his services were terrninated*.arid’:he:’:yvas aged
\nabout 30 years.\n<\/p>\n

The Commissioner for Workmen’s Compensation
\ntaking the income of the claimant at Rs.4,000\/– andoage as<\/p>\n
42 years and adopting relevant factor 178.49 <\/p>\n
the loss of earning capacity at <\/p>\n
compensation of Rs. 1,99,623\/– (17:\u00e9i\u00e9d9″X’:v4’QO{0 ;:_diso\/_ iog\u00a7}:<\/p>\n
46.6\/100).\n<\/p>\n
Company has preferred’. this’  challenging the<\/p>\n
quantum. of compensation.  C<\/p>\n

was a disability to an extent of theleft lower limb
\nand 23.3% to the whole’  of earning<\/p>\n
capacity at 46;~5%g..g33y the Ciornnii-ssioner for Workmen’s
\nCompensationi  no’t\u00a7;prope’r-.\n<\/p>\n
10.   for the respondent supports<\/p>\n
 – the  }’ud”g”me_nt.v<\/p>\n
 Dr.K.N.Devaraj, has stated in his<\/p>\n
 evidence.’ that the examined the claimant on 09.03.2003 at<\/p>\n
 Jayar1a.gara General Hospital, Bangalore. On examination<\/p>\n
   that left hip movements were restricted, limb<\/p>\n

length right 88 cm and left 85 cm shortening of 3 cm. X-
\nray pelvis both hips A? view showing proximal migration<\/p>\n
and lessening of the A.M. prosthesis. He has got’<\/p>\n
in climbing the stairs, difficulty in standing   <\/p>\n
leg. The doctor has opined thavtmthe’ <\/p>\n
disability to left lower limb at 46.6′?\/clfand  <\/p>\n
whole body.  ‘ _  A\n<\/p>\n
12. The schecluie  the”-.. Workmen’s<\/p>\n
Compensation Act envhisagesg _injuries, commonly<\/p>\n
encountered’ “E-ndufs’trial ‘practi’ce*.'”4 Further even for these,
\nthe schedule._ nei.ther\u00ab.Vis.,_.’noii_. claims to be, complete and<\/p>\n
Comprehensive.  the schedule envisages total<\/p>\n
Variatomiicg\ufb02 loss olflorgans, limbs or part thereof. in the<\/p>\n
Wof};menf’s.\ufb01lompcnsation Act, the basic principle is not the<\/p>\n
  anatomical. .e:dst’ence of a part but persistence or<\/p>\n
“”T.-Ti;’V’adisappeaifance of part of its function. The function as<\/p>\n
 the Act is not function from the physiological<\/p>\n
   of View but from the utility point of View. This utility<\/p>\n

occupation and the nature of injuries sustained by the<\/p>\n
Claimant. ;\n<\/p>\n
15. In the instant Case, the wound e.e1ftif1eate<\/p>\n
discloses the fracture of neck of left femur <\/p>\n
inability to walk, traumatic cataractof eye _bali.=i:  * . <\/p>\n
who examined the claimant is of the opmionnn<\/p>\n
and 2 are grievous in natufref-…V The e’1ainiant._:”hVas'” also-V<\/p>\n
produced the conductor ;_1icence.–andit–~e1ea1;1y’di.se1oses that<\/p>\n
he was working as a conductorf\u00bb The has stated in<\/p>\n
his evide:1Ce’tha:t cf\u00e9i3iI’ntant”ca11n’ot”stand for a long time nor
\nhe can sit on’  he has got disability in
\nclimbing the  tavi1’s._ <\/p>\n
‘ ‘=._:Con:sidering the nature of occupation and the<\/p>\n
  evidence of doctor, in my view, the functional disability<\/p>\n
the ciiaiinant can be assessed at 30%. 30% functionai<\/p>\n
  is equal to 30% loss of earning capacity.<\/p>\n

Rs.1,28,512.80 ps. [2400 X 178.49 X 30\/100), which is
\nrounded off to Rs.1,28,513\/–. The compensation amount
\nshall bear interest at 12% per annum from one month from<\/p>\n
the date of adjudication till the date of payment.<\/p>\n
