Deceased Kanjibhai Punjabhai was doing masonry<br \/>\nwork. The appellant &#8211; original opponent  is the contractor.\n<\/p>\n<p>2.2.\t\tThe<br \/>\nproceedings before the learned Civil Judge (SD) and<br \/>\nCommissioner, Workmen&#8217;s Compensation, Amreli,<br \/>\narose because of the accident which occurred on 20.04.1983 around<br \/>\n10:30 a.m., wherein while doing construction work, Kanjibhai<br \/>\nPunjabhai received serious injuries and ultimately succumbed to it.<br \/>\nThe learned Judge after hearing the parties and considering the<br \/>\nevidence on record, allowed the compensation application with the<br \/>\naforesaid direction. Hence, this appeal.\n<\/p>\n<p>3.0.\t\tHeard<br \/>\nlearned counsel for the parties.  It is a matter of record that the<br \/>\ndeceased expired during the course of employment.  The said fact is<br \/>\nalso evident from the evidence of Dr. Savalia ?  respondent no. 5<br \/>\nherein at Exh. 34. Moreover, the documentary evidence at Exh. 30 and<br \/>\n32, also establish the said fact.\n<\/p>\n<p>4.0.\n<\/p>\n<p>In view of the above, in my opinion,<br \/>\nthe impugned award passed by the learned trial Judge is just and<br \/>\nproper and no interference is required by this Court. Hence, the<br \/>\nappeal is dismissed with no order as to costs.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[K.S.
