Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/02\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ------------------------------------------\n            CRL.M.C.NO.409 OF 2010\n           ------------------------------------------\n           Dated 17th February 2010\n\n\n                         O R D E R\n<\/pre>\n<p>           Petitioners are the accused in<\/p>\n<p>C.C.562\/2009 on the file of Judicial First<\/p>\n<p>Class Magistrate&#8217; court, Kunnamkulam, taken<\/p>\n<p>cognizance for the offences under Sections<\/p>\n<p>463, 464, 465, 468, 471 and 120B read with<\/p>\n<p>Section  34     of       Indian            Penal       Code   on<\/p>\n<p>Annexure-A6 final report. Petition is filed<\/p>\n<p>under  Section      482       of       Code         of  Criminal<\/p>\n<p>Procedure to quash Annexure-A6 final report<\/p>\n<p>and the cognizance taken and to stay the<\/p>\n<p>trial  till   a      decision              is       rendered in<\/p>\n<p>O.S.701\/2008 on the file of Sub court,<\/p>\n<p>Thrissur  and      also          to        grant       permanent<\/p>\n<p>exemption to petitioners 2 and 3, who are<\/p>\n<p>aged ladies. Case of the petitioners is<\/p>\n<p>Crmc 409\/10<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>that O.S.701\/2008 is pending before Sub<\/p>\n<p>court, Thrissur where the genuineness of<\/p>\n<p>the very same document is being tried and<\/p>\n<p>till a decision is taken in the suit,<\/p>\n<p>learned Magistrate shall not try the case.<\/p>\n<p>It is also contended that when the original<\/p>\n<p>document which is allegedly forged   is not<\/p>\n<p>produced      before  the   court,  learned<\/p>\n<p>Magistrate should not have taken cognizance<\/p>\n<p>of     the   offences  and  in   any  case,<\/p>\n<p>petitioners 2 and 3 are to be exempted from<\/p>\n<p>personal appearance.\n<\/p>\n<p>           2. Learned counsel appearing for<\/p>\n<p>the        petitioners and  learned  Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p>           3. Though    learned     counsel<\/p>\n<p>appearing for the petitioners argued that<\/p>\n<p>as the very same question is being agitated<\/p>\n<p>Crmc 409\/10<br \/>\n<span class=\"hidden_text\">                         3<\/span><\/p>\n<p>before the civil court between the parties<\/p>\n<p>and    the   question whether  the   disputed<\/p>\n<p>documents were forged or not is to be<\/p>\n<p>decided by the civil court, I cannot agree<\/p>\n<p>with the submission of the learned counsel<\/p>\n<p>that     the finding    to  be   rendered  in<\/p>\n<p>O.S.701\/2008     is  binding on the criminal<\/p>\n<p>court. Criminal court has to decide the<\/p>\n<p>question whether there was forgery based on<\/p>\n<p>the evidence to be let in before the said<\/p>\n<p>court.     Therefore,  there  cannot   be   a<\/p>\n<p>direction to keep the case in abeyance till<\/p>\n<p>a decision in O.S.701\/2008 is taken. Though<\/p>\n<p>learned counsel vehemently argued that    for<\/p>\n<p>the     failure to produce original documents<\/p>\n<p>which is allegedly forged, the case is to<\/p>\n<p>be quashed ,I cannot    agree with the   said<\/p>\n<p>submission also. Petitioners are entitled<\/p>\n<p>Crmc 409\/10<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>to raise all the contentions before the<\/p>\n<p>learned Magistrate and seek an order of<\/p>\n<p>discharge under Section 239 of Code of<\/p>\n<p>Criminal Procedure. Petitioners      2 and 3<\/p>\n<p>are    at    liberty  to file  an application<\/p>\n<p>under      Section  205 of  Code of  Criminal<\/p>\n<p>Procedure for permanent exemption.
