No. I-276 of 2008  filed before Gondal Taluka<br \/>\nPolice Station,  Dist. Rajkot for offence punishable under sections<br \/>\n407, 420, 467, 468, and 114  of the Indian Penal Code.\n<\/p>\n<p>\tA<br \/>\ncomplaint was given by Ratilalbhai s\/o Mohanbhai Pansuria Patel<br \/>\nalleging therein that he is doing business in the name and style of<br \/>\nVaibhav Cotton Industries and used to supply cotton bundles through<br \/>\nbrokers.  It is alleged in the complaint that goods were sent by him<br \/>\nthrough a truck of National Roadways. As per the complaint, on<br \/>\n26.07.2008, 200 bundles of cotton were sent on assurance that payment<br \/>\nwill be made on or before 03.09.2008. As per the complaint, the goods<br \/>\nwere never delivered to the parties for whom it was dispatched and<br \/>\nwere sold off to some other parties and the amount in question was<br \/>\nnot paid to the complainant. The complainant therefore lodged the<br \/>\npresent complaint.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Ashish Dagli, learned advocate for the applicant  submitted that the<br \/>\napplicant  has been falsely implicated in the commission of the<br \/>\nalleged offence and a false case is foisted on him. He further<br \/>\nsubmitted that charge sheet is already filed and the entire<br \/>\ninvestigation is over and since the present applicant is in jail<br \/>\nsince his arrest, he be released on bail.  Learned advocate submitted<br \/>\nthat the dispute which is involved between the parties is of a civil<br \/>\nnature but a criminal complaint is filed with a view to exert<br \/>\npressure on the applicant and other accused persons. Learned<br \/>\nadvocate, placing reliance on the complaint,  submitted that the<br \/>\npresent case is triable by JMFC Court and looking to the backlog of<br \/>\ncases pending before JMFC court, the trial will take a long time and<br \/>\nthe applicant would remain behind the bars for a long time from the<br \/>\ndate of his arrest. In view of the aforesaid facts and circumstances,<br \/>\nlearned advocate submitted that this is a fit case to enlarge the<br \/>\napplicant  on regular bail. Learned advocate also placed reliance on<br \/>\nthe documents which are produced along with the application in<br \/>\nsupport of the contention that it is a fit case to release the<br \/>\napplicant on regular bail. He further submitted that in the charge<br \/>\nsheet there is not an iota of evidence connecting the applicant with<br \/>\nthe commission of offence and even nothing is recovered from the<br \/>\napplicant, and, therefore, the prayer as set out in the application<br \/>\nto release him on regular bail be granted.  Learned advocate further<br \/>\nplaced reliance on the order dated 06.03.2009 passed by this Court<br \/>\n[Coram: Z.K. Saiyed, J.] in Criminal Misc. Application No. 1993 of<br \/>\n2009 and submitted that even on the ground of parity, the application<br \/>\ndeserves to be granted.\n<\/p>\n<p>\tOn<br \/>\nthe other hand, learned APP, Ms. M.L. Shah submitted that the<br \/>\napplicant is involved in serious offences punishable under sections<br \/>\n407, 420, 467, 468, and 114 of the Indian Penal Code.  Taking into<br \/>\naccount the role attributed to the applicant  and the huge amount<br \/>\nwhich is involved, the prayer for bail may not be granted to the<br \/>\napplicant.  She further submitted that the applicant sold away the<br \/>\ngoods and pocketed huge amount of money and has not paid the money to<br \/>\nthe complainant.  Learned APP has placed reliance on the various<br \/>\nstatement of witnesses and other documents and submitted that  the<br \/>\ninextricable involvement is prima facie established.  She further<br \/>\nsubmitted that the applicant is in the habit of committing such<br \/>\noffences and various complaints have been filed against him, and even<br \/>\nlooking to the antecedents of the applicant, he cannot be granted<br \/>\nregular bail. She,  therefore, submitted that the applicant may not<br \/>\nbe granted discretionary relief as prayed for in the application, and<br \/>\nthe application deserves to be dismissed.\n<\/p>\n<p>\tHeard<br \/>\nlearned advocate Mr. Dagli for the applicant  and Ms. M.L. Shah,<br \/>\nlearned APP at length and in great detail.  Learned APP placed before<br \/>\nme for my perusal the entire investigation papers and I have also<br \/>\nconsidered the same.\n<\/p>\n<p>\tThe<br \/>\ninvestigating papers primafacie reveal offence against the applicant<br \/>\nas alleged.  Letter heads and rubber stamps were forged to dupe the<br \/>\ncomplainant. Goods are sold off and the proceeds are misappropriated.<br \/>\nHence there is no merit in the contention that nothing is recovered<br \/>\nfrom the applicant.  It appears to me from the reading of the case<br \/>\npapers that the applicant is the mastermind behind the entire<br \/>\nconspiracy.  For this reason alone, he cannot claim parity with the<br \/>\nco-accused released on regular bail by a co-ordinate Bench of this<br \/>\nCourt.  Even otherwise, relief under section 439 is a discretionary<br \/>\nrelief, where the ground of parity carries less weight because the<br \/>\nrole attributed to each applicant differs. I have also considered the<br \/>\nantecedents of the applicant. Various complaints of similar nature<br \/>\nare filed against the applicant. Even before me today, apart from the<br \/>\npresent application, there are four more applications for regular<br \/>\nbail [Misc. Criminal Applications No. 9670\/09, 9667\/09. 9686\/09 and<br \/>\n9688\/09] filed by the present applicant which indicates the conduct<br \/>\nof the applicant. Looking to the mode and manner in which the offence<br \/>\nis committed and the quantum of money involved, this Court is also<br \/>\nnot convinced by the argument that in the present and similar<br \/>\ntransactions only disputes of civil nature is involved and for that<br \/>\nreason the applicant is required to be released on regular bail.  On<br \/>\nthe contrary, I am of the considered view that releasing such persons<br \/>\non regular bail will have deleterious effect on the Society as a<br \/>\nwhole since large amount is alleged to have been misappropriated by<br \/>\nthe applicant along with co-accused and the record indicates that the<br \/>\napplicant is the mastermind behind it.\n<\/p>\n<p>\tFor<br \/>\nthe reasons aforesaid, and having heard the learned advocates and<br \/>\nhaving considered the role attributed to the applicant and reflected<br \/>\nin the FIR at Annexure &#8216;A&#8217;, antecedents of the applicant and the<br \/>\npolice papers produced by learned APP, statement of witnesses and<br \/>\nother documents, I am of the view that this is not a fit case where<br \/>\nthis Court, by exercising its discretionary jurisdiction, is required<br \/>\nto enlarge the applicant on regular bail.
