On his death, he was<br \/>\nsucceeded by  six children;  four of  whom are\tsons and two<br \/>\ndaughters. The eldest son is Abubakar.\n<\/p>\n<p>     On the  death of Syed Abdulla, agricultural lands which<br \/>\nwere Inams  in his  hands, were\t assigned to  Abubakar,\t the<br \/>\neldest son,  by\t certain  orders  passed  by  the  Ruler  of<br \/>\nKolhapur as  Inams of  two kinds. It is the admitted case of<br \/>\nthe parties  that these\t Inams were  impartible and  had  to<br \/>\ndevolve upon  the eldest  son by  the rule of primogeniture.<br \/>\nThe other  property was\t a dwelling  unit which was owned by<br \/>\nSayed Abdulla and remained in possession of abubakar.\n<\/p>\n<p>     On the abolition of the `Inams&#8217; under the provisions of<br \/>\nthe  Bombay  Merged  Territories  Miscellaneous\t Alienations<br \/>\nAbolition Act,\t1955, Abubakar was regarded as a Watandar on<br \/>\nre-grant of the properties. His brothers and sisters, on the<br \/>\none  side  ,laid  claims  to  those  lands  as\tco-heirs  of<br \/>\nAbubakar, taking  the plea  that by  virtue of\tinheritance,<br \/>\nthey had a share in that property; the bar of impartiability<br \/>\nand the\t rule of  primogeniture having\tgone. Regarding\t the<br \/>\nhouse property,they  laid claims  to partition\tit as heirs.<br \/>\nAbubakar resisted  the suit  by laying claim that the landed<br \/>\nproperties which  were erstwhile  `Inams&#8217; became on re-grant<br \/>\n`personal&#8217;in his hands and therefore the other heirs of Syed<br \/>\nAbdulla had no share in those. Regarding the house he put up<br \/>\nthe plea  of adverse  possession, even\tthough, avowedly, he<br \/>\nhad a  will in\this favour  from his father. The trial court<br \/>\npartly decreed\tthe suit  against him  insofar as  the\tInam<br \/>\nlands were  concerned but  dismissed the suit insofar as the<br \/>\nhouse was  concerned; and the lower appellate court affirmed<br \/>\nthat decision.\tBefore the High court the appeal of Abubakar<br \/>\nas also\t the cross-objections  on the  contrary were allowed<br \/>\nwith  the   result  that  the  entire  suit  stood  decreed,<br \/>\nrejecting the  claim of\t Abubakar of  the Inam\tlands  being<br \/>\npersonal  to   him  and\t the  house  being  in\this  adverse<br \/>\npossession, maturing in his ownerships.\n<\/p>\n<p>     We have  heard Mr.\t Ganpule, learned senior counsel for<br \/>\nthe appellant-Abubakar,\t at great  length and pointedly with<br \/>\nregard to  the nature  of regrant after the abolition of the<br \/>\nInam. It  stands conceded by him that the terms of the grant<br \/>\nare not in any manner peculiar to the facts emerging in this<br \/>\ncase but  rather are  the usual\t ones which  find mention in<br \/>\nsuch grants.  He was  frank enough to concede before us that<br \/>\nhad the\t parties been  Hindus then the two decisions of this<br \/>\nCourt, namely,\t(i) Nagesh  Bisto Desai etc. etc. vs. Khando<br \/>\nTirmal Desai  etc. [1982  (3)SCP 341];\tand  (ii)  Annasaheb<br \/>\nBapusaheb Patil\t and others  vs. Balwant  (dead) by  lrs and<br \/>\nheirs and  others [1995\t (2) SCC  543] would have taken over<br \/>\nthe field  to hold  that the  properties in the hands of the<br \/>\nWatandar were joint family properties and partible after the<br \/>\nre-grant .  He tried in vain to convince us that principally<br \/>\nit would  make a difference if the parties were Mohammedans,<br \/>\nas presently they are. If we come to analyse the proposition<br \/>\ncanvassed,  Syed   Abdulla&#8217;s  estate  should  normally\thave<br \/>\ndevolved upon his six children in accordance with the shares<br \/>\nas defined  by the  Shariat Law.  But, since  the properties<br \/>\nwere Inams  and Impartible and the services to the Ruler due<br \/>\nfrom the  members of  the family  were expected\t to be taken<br \/>\nfrom the  eldest son  by the rule of primogeniture, then the<br \/>\nheirs of Syed Abdulla, even though not forming a joint Hindu<br \/>\nfamily as  is known  to Hindu Law, would still be a group of<br \/>\npeople, the representative of which was Abubakar in order to<br \/>\nhold the  Inam. Once  that Inam\t was abolished\tand re-grant<br \/>\ngiven to  Abubakar, impartibility of the estate vanished and<br \/>\nthus this  group of people were definitely entitled to claim<br \/>\ntheir respective  shares  in  accordance  with\tthe  law  of<br \/>\nSharfat. All  the three\t courts below have taken such a view<br \/>\nand we see no impelling reason to draw a line of distinction<br \/>\nqua the\t aforesaid two\tcases  in  Nagesh  Bisto  Desai\t and<br \/>\nAnnasaheb Bapusaheb  (supra) so as to carve out an exception<br \/>\nto the\tprinciple for Mohammedans. The prime reason for such<br \/>\ninterpretation is  that the  Ruler while drawing up the Inam<br \/>\ninitially and conferring it again on Abubakar did not intend<br \/>\nto create  any\tdistinction  between  his  subjects,  be  it<br \/>\nMuslims or  Hindus. Uniformity\tof tradition  in that regard<br \/>\nwould be  a good  rule of  reason so as to set the matter at<br \/>\nrest here.\n<\/p>\n<p>     With regard  to the  plea of  adverse  possession,\t the<br \/>\nappellant having been successful in the two courts below and<br \/>\nnot in\tthe High  Court, one has to turn to the pleadings of<br \/>\nthe appellant in his written statement. There he has pleaded<br \/>\na duration of his having remained in exclusive possession of<br \/>\nthe house,  but nowhere has he pleaded a single overt act on<br \/>\nthe basis  of which it could be inferred or ascertained that<br \/>\nfrom a\tparticular  point  of  time  his  possession  became<br \/>\nhostile and  notorious to  the complete\t exclusion of  other<br \/>\nheirs, and  his being  in possession openly and hostilely.It<br \/>\nis true\t that some evidence, basically of Municipal register<br \/>\nentries, were  inducted to  prove the point but no amount of<br \/>\nproof can  substitute pleadings\t which are the foundation of<br \/>\nthe claim  of a\t litigating party. The High Court caught the<br \/>\nappellant right at that point and drawing inference from the<br \/>\nevidence  produced   on\t record,   concluded  that   correct<br \/>\nprinciples relating  to the  plea of adverse possession were<br \/>\nnot applied  by the courts below. The finding, as it appears<br \/>\nto us,\twas rightly  reversed by the High Court requiring no<br \/>\ninterference at our end.\n<\/p>\n<p>     For the  foregoing reasons,  there is  no merit in this<br \/>\nappeal which is hereby dismissed.
