DENESAN, J.\n\n\n\n                   = = = = = = = = = = = = = = =\n\n                         W.P(C) No.30085 OF 2006\n\n                   = = = = = = = = = = = = = = =\n\n\n\n                 Dated this the 21st December, 2006\n\n\n\n                                J U D G M E N T\n<\/pre>\n<p>        The petitioner is a Sub Inspector of Police in the<\/p>\n<p>General   Executive   Wing   of   the   Police   Department.\n<\/p>\n<p>Respondent   No:3   passed   Ext.P1   order   dated   22.6.2001   to<\/p>\n<p>hold         non-oral         enquiry         into         certain         allegations<\/p>\n<p>constituting dereliction of duty and misconduct against<\/p>\n<p>the   petitioner.     The   Deputy   Superintendent   of   Police,<\/p>\n<p>Crime   Detachment,   Palakkad   issued   Ext.P2   memo   of<\/p>\n<p>charges   directing   the   petitioner   to   submit   his<\/p>\n<p>explanation.     The   gist   of   the   allegation   against   the<\/p>\n<p>petitioner   was   that   he   failed   to   conduct   investigation<\/p>\n<p>into   Crime   Nos:   168\/96,   180\/96   and   183\/96   of<\/p>\n<p>Kozhinjampara   Police   Station   and   that   he   had   falsely<\/p>\n<p>recorded   in   the   FIRs   index   that   the   above   cases   had<\/p>\n<p>been   charge   sheeted   and   that   the   above   conduct   of   the<\/p>\n<p>petitioner resulted in a miscarriage of justice.\n<\/p>\n<p>        2.   Since   no   explanation   was   received   from   the<\/p>\n<p>petitioner,     the   Deputy   Superintendent   of   Police   drew<\/p>\n<p>up   the   punishment   roll   minutes   on   31.10.2001   finding<\/p>\n<p>the   petitioner   guilty   of   the   charges.                              The   third<\/p>\n<p><span class=\"hidden_text\">WPC No. 30085 \/2006                2<\/span><\/p>\n<p>respondent accepted the findings of the Enquiry Officer<\/p>\n<p>and   awarded   the   penalty   of   postponement   of   his   next<\/p>\n<p>increment   for   six   months   without   cumulative   effect,<\/p>\n<p>vide   Ext.P3   order   dated   28.1.2002.     Ext.P3(a)   is   the<\/p>\n<p>copy of the punishment roll minutes.\n<\/p>\n<p>      3.   Against   Ext.P3   the   petitioner   preferred   appeal<\/p>\n<p>dated   10.4.2002   before   the   second   respondent.     As   per<\/p>\n<p>Ext.P5   the  appeal  was  dismissed.    The  petitioner  filed<\/p>\n<p>a review petition before the Government.  As per Ext.P6<\/p>\n<p>order   dated   22.10.2005   the   review   petition   has   been<\/p>\n<p>rejected.     Thereafter   the   petitioner   has   filed   Ext.P7<\/p>\n<p>petition   before   the   Government.     The   petitioner   says<\/p>\n<p>that no orders have been passed on Ext.P7.\n<\/p>\n<p>      4.     Heard   the   learned   counsel   for   the   petitioner.\n<\/p>\n<p>The fact that the petitioner did not submit his defence<\/p>\n<p>statement   within   the   time   permitted   is   a   pertinent<\/p>\n<p>point   that   would   weaken   the   contentions   of   the<\/p>\n<p>petitioner.     Though   it   is   stated   that   he   had   made   an<\/p>\n<p>application for the supply of certain documents for the<\/p>\n<p>purpose of submitting the written statement of defence,<\/p>\n<p>the   petitioner   has   not   produced   any   material   to<\/p>\n<p>substantiate   the   above   contention.             The   enquiring<\/p>\n<p><span class=\"hidden_text\">WPC No. 30085 \/2006                         3<\/span><\/p>\n<p>authority or for that matter the disciplinary authority<\/p>\n<p>cannot   be   found   fault   with   for   not   supplying   relevant<\/p>\n<p>documents   to   the   delinquent   employee   unless   he   lodges,<\/p>\n<p>promptly, a request in that behalf before the enquiring<\/p>\n<p>authority   or   the   disciplinary   authority.     There   is<\/p>\n<p>nothing to show that any of them had received any such<\/p>\n<p>request   from   the   petitioner.     It   appears   that   he   was<\/p>\n<p>not all diligent in alerting the officers to supply him<\/p>\n<p>the   documents   in   time.                  He   did   not   request   for<\/p>\n<p>extension   of   time   fixed   for   the   submission   of   his<\/p>\n<p>written statement of defence.\n<\/p>\n<p>      5.         The         proceedings         initiated         against         the<\/p>\n<p>petitioner   is   one   for   the   imposition   of   a   minor<\/p>\n<p>penalty.     Hence   no   question   of   examining   witnesses   or<\/p>\n<p>proving   documents   arises.     The   disciplinary   authority<\/p>\n<p>is   entitled   to   look   into   the   materials   on   record<\/p>\n<p>including   the   written   statement   of   defence   if   any,<\/p>\n<p>available   on   record   and   to   finalise   the   disciplinary<\/p>\n<p>proceedings   accordingly.     Since   the   petitioner   did   not<\/p>\n<p>take care to file the written statement within the time<\/p>\n<p>stipulated   or   make   any   request   to   grant   additional<\/p>\n<p>time   for  filing  the  written  statement,  the  only  course<\/p>\n<p><span class=\"hidden_text\">WPC No. 30085 \/2006                        4<\/span><\/p>\n<p>open   to   the   enquiry   officer   was   to   draw   the   report   of<\/p>\n<p>enquiry based on the materials available on record.\n<\/p>\n<p>      6.   The   contention   of   the   petitioner   that   the<\/p>\n<p>charge   was   framed   by   the   Deputy   Superintendent   of<\/p>\n<p>Police and not by the D.I.G and the same would vitiate<\/p>\n<p>the disciplinary proceedings is without any merit.  The<\/p>\n<p>enquiring authority is also empowered to frame charges.\n<\/p>\n<p>The   order   imposing   penalty   on   the   petitioner   has   been<\/p>\n<p>passed   by   the   D.I.G   who   is   the   disciplinary   authority<\/p>\n<p>competent to pass such orders.  The review petition has<\/p>\n<p>been   rightly   rejected   by   the   Government.     There   is   no<\/p>\n<p>provision   for   filing   one   more   review   petition   before<\/p>\n<p>the   Government.     Hence   the   petitioner   cannot   have   any<\/p>\n<p>legitimate         grievance         in         not         considering         Ext.P7<\/p>\n<p>representation.\n<\/p>\n<p>      7.   Ex.P3(a)   report   shows   that   the   petitioner   was<\/p>\n<p>found   guilty   based   on   cogent   and   reliable   materials.\n<\/p>\n<p>Hence,   no   interference   is   called   for.     The   penalty<\/p>\n<p>imposed is minor and not at all excessive.  There is no<\/p>\n<p>substance   in  the  contention  of  the  petitioner  that  the<\/p>\n<p>impugned   orders   would   result   in   a   miscarriage   of<\/p>\n<p>justice.  I am not able to appreciate such a contention<\/p>\n<p><span class=\"hidden_text\">WPC No. 30085 \/2006             5<\/span><\/p>\n<p>coming   from   the   side   of   an   officer   who   was   not<\/p>\n<p>diligent,   if   not   indifferent,   in   defending   his   case<\/p>\n<p>before   the   disciplinary   authority.   The   writ   petition<\/p>\n<p>fails and is dismissed.\n<\/p>\n<p>                                               K.K.
