No.28116 of 2011\n                      Manish Kumar son of Sri Shambhu Kumar Sah\n                                        Versus\n                                  The State Of Bihar\n                                       -----------\n<\/pre>\n<p>2\/   29.08.2011                   Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                  The petitioner seeks bail in a case instituted for the<\/p>\n<p>                      offence under sections 419, 420 and 468 of the Indian Penal Code.<\/p>\n<p>                                  Considering that the petitioner is in custody since<\/p>\n<p>                      01.07.2011 and there is no other case of similar nature pending<\/p>\n<p>                      against him, let the petitioner, above named, be released on bail on<\/p>\n<p>                      furnishing bail bond of Rs.5,000\/- (five thousand) with two sureties<\/p>\n<p>                      of the like amount each or any other surety to be fixed by the court<\/p>\n<p>                      below to the satisfaction of the Chief Judicial Magistrate, Patna, in<\/p>\n<p>                      connection with Hawai Adda (Patna) P.S. Case No.94 of 2011,<\/p>\n<p>                      subject to the conditions (i) That one of the bailors will be Raj<\/p>\n<p>                      Kumar, brother-in-law of the petitioner and another bailor shall be<\/p>\n<p>                      local since the petitioner is the resident of Bhagalpur district. (ii)<\/p>\n<p>                      That the affidavit shall clearly state that the petitioner is not an<\/p>\n<p>                      accused in any other case and, if he is, he shall not be released on<\/p>\n<p>                      bail, (iii) That the bailors shall also state on affidavit that they will<\/p>\n<p>                      inform the court concerned if the petitioner is implicated in any<\/p>\n<p>                      other case of similar nature after his release in the present case and<\/p>\n<p>                      thereafter the court below will be at liberty to initiate the proceeding<\/p>\n<p>                      for cancellation of bail on the ground of misuse, (iv) That the<\/p>\n<p>                      petitioner will give an undertaking that he will receive the police<\/p>\n<p>                      papers on the given date and be present on date fixed for charge and<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       if he fails to do so on two given dates and delays the trial in any<\/p>\n<p>       manner, his bail will be liable to be cancelled for reasons of misuse,<\/p>\n<p>       and (v) That the petitioner will be well represented on each date and<\/p>\n<p>       if he fails to do so on two consecutive dates, his bail will be liable to<\/p>\n<p>       be cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                            (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Manish Kumar vs The State Of Bihar on 29 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
