SHAH\n\t\t\n\t\n\n \n\nDate\n: 07\/04\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent Second Appeal under Section 100 of the Code of Civil<br \/>\nProcedure has been preferred by the appellant-original defendant<br \/>\nchallenging the judgement and decree dated 04\/08\/2007 passed by the<br \/>\nlearned Judge, Small Cause Court, Rajkot in Small Civil Suit No.<br \/>\n975\/2005 confirmed by the learned appellate Court by impugned<br \/>\njudgement and order dated 17\/08\/2008 passed by the  learned Presiding<br \/>\nOfficer, 2nd Fast Track Court, Rajkot in Regular Civil<br \/>\nAppeal No. 58\/2007.\n<\/p>\n<p>2.\tThe<br \/>\nrespondent-original plaintiff instituted suit for recovery of Rs.<br \/>\n15,950\/- towards supplementary bill issued against the<br \/>\nappellant-original defendant towards minimum charges for the period<br \/>\nbetween April, 2002 to July, 2003.  At the outset, it is required to<br \/>\nbe noted that the appellant-original defendant did not challenge the<br \/>\nbill in question issued by the respondent-original plaintiff for<br \/>\nconsumption of minimum charges for the aforesaid period and it is the<br \/>\nrespondent-original plaintiff, who instituted the suit for recovery<br \/>\nof the amount under the aforesaid bill and, therefore, the learned<br \/>\ntrial Court decreed the suit, which came to be confirmed by the<br \/>\nlearned appellate Court.\n<\/p>\n<p>3.\tThis<br \/>\nis a Second Appeal under Section 100 of the Code of Civil Procedure.<br \/>\nUnless there is any substantial question of law arising and\/or shown<br \/>\nfor determination of this Court, Second Appeal is not required to be<br \/>\nentertained.   The learned advocate appearing on behalf of the<br \/>\nappellant-original defendant has failed to show any substantial<br \/>\nquestion of law arising and\/or for determination by this Court in the<br \/>\npresent Second Appeal.  Even otherwise, considering the fact that<br \/>\nboth the Courts below have concurrently found against the<br \/>\nappellant-original defendant and passed the decree of Rs. 15,950\/-,<br \/>\nno case is made out to interfere with the judgement and order passed<br \/>\nby both the Courts below in exercise of powers under Section 100 of<br \/>\nthe Code of  Civil Procedure.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and for the reasons stated hereinabove, there is no<br \/>\nsubstance in the present Second Appeal, which deserves to be<br \/>\ndismissed and is accordingly dismissed.\n<\/p>\n<p> CIVIL<br \/>\nAPLICATION No. 3316\/2010<\/p>\n<p>\tIn<br \/>\nview of the order passed in Second Appeal, no order in the Civil<br \/>\nApplication.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Shri vs Paschim on 7 April, 2010 Author: M.R.
