Their services have not been regularised<br \/>\nfor want of vacancy. However, as they have completed ten years of<br \/>\ncontinuous service as Daily Wagers they are entitle to minimum of<br \/>\nthe pay scale of 6th pay commission which is admissible to class &#8211;<br \/>\nIV employees.\n<\/p>\n<p>It is submitted that in view of the decision of the Apex Court in<br \/>\nState of U.P. and others Vs. Putti Lal (2002)2 UPLBEC 1597 this<br \/>\nCourt has disposed of various petitions directing the Forest<br \/>\nDepartment to pay minimum of the pay scale admissible to Class &#8211;<br \/>\nIV employees. Reliance has been placed upon a judgment and<br \/>\norder dated 17.2.2009 passed in Civil Misc. Writ Petition<br \/>\nNo.63684 of 2005 (Sada Ali Vs. Division Forest Officer). It has<br \/>\nfurther been submitted that a similar order was passed on<br \/>\n23.10.2008 in Civil Misc. Writ Petition No.43443 of 2004<br \/>\n(Lakshmi Chandra Vs. State of U.P. and others). When the said<br \/>\norder was not complied with proceedings for contempt were<br \/>\ninitiated by means of Contempt Application (Civil) of 2009<br \/>\n(Lakshmi Chandra Vs. Sri N.K. Janu). In the said contempt<br \/>\npetition on behalf of Forest Department an undertaking was given<br \/>\nthat the minimum of the pay scale admissible to Class &#8211; IV<br \/>\nemployees i.e. Rs.2550\/- per month, which has now been increased<br \/>\nto Rs.6050\/- per month as per the report of the VI Pay Commission<br \/>\nshall be paid to Class &#8211; IV employees who have completed 10<br \/>\n years service.\n<\/p>\n<p>In view of above facts and circumstances, an interim mandamus is<br \/>\nissued to the respondents either to pay the petitioners monthly<br \/>\nsalary as per the minimum of the pay scale admissible to Class &#8211;<br \/>\nIV employees in the pay band of Rs. 6050\/- or show cause within a<br \/>\nperiod of one month from today.&#8221;\n<\/p>\n<p>In view of the aforesaid facts and circumstances, in my opinion, an<br \/>\ninterim mandamus be issued to the respondents to take into<br \/>\nconsideration the judgment of the apex court reported in Putti Lal&#8217;s<br \/>\ncase and accordingly pay the petitioner monthly salary as<br \/>\nminimum of the pay scale admissible to Class-IV employees in the<br \/>\npay band of Rs.6050\/-, in case the petitioner is working.
