SAHAI\n\t\t\n\t\n\n \n\nDate<\/a>\n: 10\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>\tHeard<br \/>\nlearned advocates for the parties.\n<\/p>\n<p>\tRULE.\n<\/p>\n<p>Learned advocate Mr.Parikh and learned AGP Mr.Pandya waive service of<br \/>\nnotice of rule on behalf of opponent nos.1 and 2 respectively.\n<\/p>\n<p>\tBy<br \/>\nthis Application, the applicant &#8211; original owner of the land<br \/>\nprays for permitting him to withdraw the amount deposited by the<br \/>\nopponent with the reference court.\n<\/p>\n<p>\tIn<br \/>\nfacts and circumstances of the case, the applicant is permitted to<br \/>\nwithdraw 50% of the amount, which shall be paid to him by the<br \/>\nreference court by Crossed Accounts Payee Cheque. The rest of the 50%<br \/>\namount deposited with the reference court shall be deposited in any<br \/>\nnationalized bank initially for a period of 3 years in a cumulative<br \/>\nterm deposit and shall be renewed thereafter from time to time for a<br \/>\nperiod of one year on each occasion till further orders that may be<br \/>\npassed by this Court.\n<\/p>\n<p>\tApplication<br \/>\nstands disposed of in the above terms. Rule made absolute.
