1.         This order will dispose of Civil Writ Petition<\/p>\n
Nos.9408, 9639 and 9640 of 1991 filed by the<\/p>\n
Improvement Trust and CWP Nos.13688, 13694, 13696 of<\/p>\n
1991 filed by the land owners, questioning the validity of<\/p>\n
the award of the Land Acquisition Tribunal. The
\n CWP No.9408 of 1991                                       2<\/span><\/p>\n
Improvement Trust seeks reduction of compensation<\/p>\n
awarded, apart from challenging the award of additional<\/p>\n
compensation          under section   23(1-A) of   the   Land<\/p>\n
Acquisition Act, 1894 (in short, ‘the 1894 Act’) on the<\/p>\n
ground that the award of the Collector was 3.2.1979 i.e.<\/p>\n
prior to 30.4.1982, while the land owners seek further<\/p>\n
enhancement.\n<\/p>\n
2.          Land in question was acquired in pursuance of<\/p>\n
notification under section 36 of the Punjab Town<\/p>\n
Improvement Act, 1922 (in short, ‘the 1922 Act’) dated<\/p>\n
27.12.1974. The said notification was          followed by<\/p>\n
notification dated 19.12.1975 under section 42 of the 1922<\/p>\n
Act. The Collector vide award dated 3.2.1979 determined<\/p>\n
compensation at the rate of Rs.2700\/- per marla. On<\/p>\n
reference to the Tribunal under the provisions of the 1922<\/p>\n
Act, the compensation was enhanced to Rs.15000\/- per<\/p>\n
marla. The Tribunal considered 18 instances of sale<\/p>\n
produced on behalf of the land owners and three instances<\/p>\n
of sale produced on behalf of the Improvement Trust. The<\/p>\n
said instances have been detailed in para 9 of the impugned
\n CWP No.9408 of 1991                                     3<\/span><\/p>\n
award. Referring to Ex.R.1, which was a sale deed relied<\/p>\n
upon on behalf of the Improvement Trust, it was noticed<\/p>\n
that the price fetched therein was Rs.10,000\/- per marla.<\/p>\n
The Tribunal observed that in the site plan, the location of<\/p>\n
the said land was inferior to the acquired land in as much<\/p>\n
as the acquired land was on the main road. Even the<\/p>\n
Collector had not acted upon Ex.R.1. The average of<\/p>\n
instances produced by the claimants worked out              to<\/p>\n
Rs.24000\/- per marla but the said instances were mostly<\/p>\n
after the acquisition. It was also observed that some<\/p>\n
allowance had to be made in favour of land owners as<\/p>\n
acquisition in question was six months after the sale<\/p>\n
instances Ex.R.1 and acquired land was better located.<\/p>\n
Taking an overall view of oral and documentary evidence<\/p>\n
on the record, compensation was determined at Rs.15000\/-<\/p>\n
per marla. Oral evidence, inter-alia, comprised AW4<\/p>\n
Harmesh Chander, property dealer who stated that value of<\/p>\n
one marla of land in the area was more than Rs.30,000\/-<\/p>\n
and gave certain instances in support of his statement. It<\/p>\n
was also noticed that the acquired land abutted the GT road
\n CWP No.9408 of 1991                                            4<\/span><\/p>\n
towards Ludhiana. There were petrol pumps, clinics,<\/p>\n
cinema houses, tractor agencies near the acquired land.<\/p>\n
Office of SDM was also near the acquired land apart from<\/p>\n
Bus Stand, Police Station and Courts. Land was within<\/p>\n
municipal limits.\n<\/p>\n
3.          We        have   heard   learned   counsel   for   the\n\nImprovement Trust.           None has appeared for the land\n\nowners.\n<\/pre>\n
4.          Learned counsel for the Improvement Trust<\/p>\n
submitted that the compensation awarded was excessive as<\/p>\n
average of sale instances produced by the land owners<\/p>\n
could not be taken into account being subsequent to<\/p>\n
acquisition except instances 2, 3 and 4, which related to<\/p>\n
very very small pieces of land\n<\/p>\n
5.          We are of the view that the Tribunal has reached<\/p>\n
its conclusion based on appreciation of evidence. Two<\/p>\n
instances relied upon by the land owners are prior to<\/p>\n
acquisition and support the value arrived at by the<\/p>\n
Tribunal. The location of land has not been disputed, which<\/p>\n
is within the municipal limits and in the heart of the town.<\/p>\n
Even if two views are possible, finding of the Tribunal is
\n CWP No.9408 of 1991                                      5<\/span><\/p>\n
not liable to be interfered with in exercise of writ<\/p>\n
jurisdiction unless the same is shown to be perverse or<\/p>\n
without any evidence.        We also find no scope for<\/p>\n
enhancement as claimed by land owners. In these<\/p>\n
circumstances, we do not find any ground to interfere with<\/p>\n
the determination of market value by the Tribunal. We,<\/p>\n
however, find merit in the contention that additional<\/p>\n
compensation under section 23(1-A) of the 1894 Act could<\/p>\n
not be awarded to the land owners, in view of judgment of<\/p>\n
the Hon’ble Supreme Court in K.S.Paripoornan v. State<\/p>\n
of Kerala, AIR<\/a> 1995 SC 1012, as the award of the<\/p>\n
Collector is prior to 30.4.1982.\n<\/p>\n
6.          Accordingly, these petitions are disposed of by<\/p>\n
not interfering with the determination of market value but<\/p>\n
with a direction that benefit under section 23(1-A) of the<\/p>\n
1894 Act will not be available to the land owners.<\/p>\n
