Mr. H.L. Jani, waives service of notice of Rule for<br \/>\nRespondent No.1-State of Gujarat.\n<\/p>\n<p>2.\t\tThe<br \/>\npresent petition has been filed by the applicants, who are the<br \/>\naccused in Sessions Case No. 16 of 2001 before the Sessions Court,<br \/>\nJunagadh, and they have prayed for cancellation of non-bailable<br \/>\nwarrant issued in the said matter.\n<\/p>\n<p>3.\t\tIt<br \/>\nis also stated that while passing the order in favour of Chandulal<br \/>\nMaganlal Shevak, who is the father of the applicant No.1, by<br \/>\ninadvertence the names of present applicants have not been mentioned<br \/>\nin the petition and therefore, the same or similar order may be<br \/>\npassed.\n<\/p>\n<p>4.\t\tHeard<br \/>\nParty-in-person Mr. Kiran Kumar @ Kritikumar Chandulal Sevak  and Ms.<br \/>\nPremilaben, who are present in the Court and learned APP Mr. Jani,<br \/>\nappearing for the State of Gujarat.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the detailed order passed earlier i.e. on 21.9.2011 in the<br \/>\ncase of Chandulal Maganlal Sevak(father), the present petition<br \/>\ndeserves to be allowed and non-bailable warrant which is issued is<br \/>\nordered to be cancelled subject to the same terms and conditions i.e.<br \/>\nfiling of the undertaking that they will co-operate and remain<br \/>\npresent for attending the trial of aforesaid Sessions Case No. 16 of<br \/>\n2001.\n<\/p>\n<p>6.\t\tAccordingly,<br \/>\nthe present petition stands allowed. Non-bailable warrant issued on<br \/>\n13.9.2011 by the 5th  (Ad-hoc) Additional Sessions Judge,<br \/>\nVeraval Camp Una is hereby cancelled and  the same is converted into<br \/>\nbailable warrant.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.\n<\/p>\n<p>(RAJESH<br \/>\nH.
