It<br \/>\nappears that the Mamlatdar, without assigning any reason or giving<br \/>\nsufficient opportunities to the parties to lead their respective<br \/>\nevidence, passed the order dated 2nd<br \/>\nDecember 2009 allowing the application of the respondent (original<br \/>\napplicant), restraining the present petitioner from causing any<br \/>\nobstruction to the respondent in his right of way through &#8216;Shedha&#8217; of<br \/>\nsurvey No.11 of the present petitioner. Being aggrieved by the said<br \/>\norder, the present petitioner preferred the revision before the<br \/>\nDeputy Collector under the provisions contained in the said Act. The<br \/>\nDeputy Collector while observing that the present respondent &#8211;<br \/>\noriginal applicant, had not submitted the application as per Section<br \/>\n7 of the said Act and the Mamlatdar had also not followed the<br \/>\nprocedure under Section 8 of the said Act, rejected the said revision<br \/>\napplication of the present petitioner vide order dated 13.12.2010.<br \/>\nBeing aggrieved by the said judgment and order passed by<br \/>\nthe Deputy Collector, the petitioner has preferred the present<br \/>\nrevision application under Section 115 of C.P.C.\n<\/p>\n<p>3.\tDuring the course of<br \/>\narguments it had transpired that the respondent &#8211; original<br \/>\napplicant had not filed his application as per Section 7 of the said<br \/>\nAct, nor the Mamlatdar had followed the procedure as required under<br \/>\nSection 8 of the said Act before entertaining the application of the<br \/>\nrespondent. Under the circumstances, Mr. Majmudar submitted that let<br \/>\nthe matter be remanded to the Mamlatdar&#8217;s Court for considering the<br \/>\nmatter afresh, after the respondent follows the procedure as<br \/>\nprescribed under Section 7 and the Mamlatdar follows the procedure if<br \/>\nrequired under Section 8 of the said Act. Mr. Umang Vyas for the<br \/>\nrespondent has no objection if the matter is remanded to the<br \/>\nMamlatdar Court for deciding afresh in accordance with law.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, with the consent of learned advocates for the<br \/>\nparties, the judgments and orders dated 13th<br \/>\nDecember 2010 and 2nd<br \/>\nNovember 2009 passed by the Deputy Collector and Mamlatdar<br \/>\nrespectively are required to be set aside and are hereby set aside.<br \/>\nThe matter is remanded to the Mamlatdar for deciding afresh, after<br \/>\nrespondent &#8211; original applicant complies with the requirement<br \/>\nunder Section 7 of the said Act and the Mamlatdar follows the<br \/>\nprocedure, if required, under Section 8 of the said Act. The<br \/>\nMamlatdar shall, thereafter, decide the matter afresh in accordance<br \/>\nwith law, after giving both the parties the opportunity of leading<br \/>\nthe evidence and of hearing.\n<\/p>\n<p>5.\tIt is clarified that<br \/>\ntill the Mamlatdar decides the matter afresh, both the parties shall<br \/>\nmaintain status quo as on today. The Mamlatdar is directed to decide<br \/>\nthe matter as expeditiously as possible, and both the parties are<br \/>\ndirected to co-operate the Mamlatdar in the proceedings.
