\n\tMs. Jirga Jhaveri for State Authority in SCA No.8437 of 2010 and SCA
\n\tNo. 8441 of 2010 as well as learned AGP Mr. Anand L. Sharma for
\n\tState Authority in SCA No. 8438 and 8440 of 2010.\n<\/p>\n
Petitioner
\n\tin this group of petitions has challenged action\/inaction on the
\n\tpart of respondents. Earlier, Special Civil Application NO. 654\/10,
\n\t655\/10, 656\/10 and 656\/10 were preferred by petitioner before this
\n\tcourt wherein orders have been passed by this Court on 28th
\n\tJanuary, 2010. Order passed by this Court in SCA No. 654 of 2010
\n\tdated 28.1.2010 is quoted as under:\n<\/p>\n
 1.\tThe
\n\tpetitioner herein has prayed to direct the respondents to decide the
\n\tapplication dated 05.10.2005 of the petitioner  for mining lease and
\n\tfurther to direct the respondents to give priority for deciding the
\n\tapplication without considering the notification dated 17.12.2009.\n<\/p>\n
2.\tThe
\n\tpetitioner on 05.10.2005 preferred an application under Form I of
\n\tthe Mineral Concession Rules, 1960 seeking mining lease of Mineral
\n\tQuartz admeasuring area of 4 hectares situated at Survey No. 326(3)
\n\tvillage sim of Naroda, Panchmahals before the Collector, Mining
\n\tDepartment.  It is the case of the petitioner that though the
\n\tpetitioner fulfills the requirement for  Mining lease to be
\n\tallotted, the respondent authorities have not paid any heed inspite
\n\tof opinions from experts in his favour.  Further the respondent has
\n\tbeen inviting new applications without deciding the petitioner’s
\n\tapplication which is pending since long.  Hence this petition is
\n\tpreferred.\n<\/p>\n
3.\tMr.\n<\/p>\n
\tMansuri, learned advocate appearing for the petitioner has submitted
\n\tthat the respondent no. 1 has passed notification on 17.12.2009
\n\tinviting applications for mining lease for survey no. 326\/3 of sim
\n\tof Naroda, Khanpur.  He has submitted that as per section 11(2) of
\n\tthe Act the applicant whose application is received earlier shall
\n\thave the preferential right to be considered for grant of mining
\n\tlease over the applicant whose application is received later.\n<\/p>\n
4.\tThis
\n\tcourt has heard learned advocates for the parties and perused the
\n\tpapers on record. As a result of the said exercise, this court is of
\n\tthe view that in the interest of justice, the following directions
\n\tare required to be issued:\n<\/p>\n
(I)\tThe
\n\tapplication of the petitioner pursuant to the notification dated
\n\t17.12.2009 shall be considered within a period of three months from
\n\tthe last date of receipt of applications.\n<\/p>\n
(II)\tIt
\n\tis made clear that this court has not entered into the merits of the
\n\tmatter.\n<\/p>\n
(III)\tThe
\n\trespondent authority shall decide the application of the petitioner
\n\tin accordance with law and relevant provisions of the Act.\n<\/p>\n
5.\tWith
\n\tthe above directions and observations, this petition is disposed of.
\n\tDirect service is permitted. No costs.\n<\/p>\n
Learned
\n\tAdvocate Mr. Chhaya for petitioner has submitted that in view of the
\n\torder of this court, on 8th February, 2010,
\n\trepresentation was made by petitioner which is at annexure D page 53
\n\taddressed to Joint Secretary, Industries and Mines Department, New
\n\tSachivalaya, Gandhinagar  which has been received by other side but
\n\ttill date, no decision has been taken by respondents and, therefore,
\n\tpetitioners have filed present petitions. Learned Advocate Mr.
\n\tChhaya also submitted that inspite of clear directions issued by
\n\tthis court in earlier group of petitions in respect of applications
\n\tof petitioner dated 5.10.2005 in special civil application no. 654
\n\tof 2010, 28.8.2008 in special civil application no. 656 of 2010,
\n\t17.1.2007 in special civil application no. 657 of 2010 and 29.9.2006
\n\tin special civil application no. 655 of 2010, respondent authority
\n\thas not decided representations and applications of petitioner
\n\twithin reasonable period and, therefore, present petitions have been
\n\tfiled by petitioners.\n<\/p>\n
In
\n\tview of this back ground, considering directions issued by this
\n\tcourt earlier in para 4 of order dated 28.1.2010, it is directed to
\n\trespondent NO.2 Commissioner, Department of Geology and Mines, Udyog
\n\tBhavan, Gandhinagar and respondent no .3 District Collector,
\n\tPanchmahals posted at Godhra, Geology and Mines Department to
\n\tconsider representation made by petitioner on 8th
\n\tFebruary, 2010 along with original application of petitioner and
\n\tdecide it and examine grievance of petitioner and thereafter to pass
\n\tappropriate reasoned order in accordance with law within the period
\n\tof one month from the date of receiving copy of present order and
\n\tcommunicate decision to petitioner immediately thereafter. This
\n\tCourt has considered fact that earlier, three months time was given
\n\tto respondent authority, however, yet, respondent authority has not
\n\tdecided representation and original applications of petitioner and,
\n\ttherefore, now, respondent no.2 and 3 both are directed to see that
\n\tthe representation made by petitioner on 8.2.2010 along with
\n\toriginal application is decided by them within time stipulated by
\n\tthis court by giving priority to this matter within one month from
\n\tdate of receiving copy of present order of this court and then to
\n\tcommunicate decision to petitioner.\n<\/p>\n
In
\n\tview of these observations and directions, these petitions are
\n\tdisposed of by this court without expressing any opinion on merits.
