S.J. MUKHOPADHAYA)<\/p>\n<p>\tIt<br \/>\nappears that 35 students of the petitioner   institution (CK Patel<br \/>\nCollege of Social Work) have been transferred to 9 other colleges<br \/>\nmainly on the following grounds :-\n<\/p>\n<p>(i)\tThe<br \/>\npetitioner   institution charged more fees from the students<br \/>\ntowards examination fees.  In place of Rs.910\/-, they have charged<br \/>\nRs.1,160\/- i.e. excess of Rs.250\/- charged per student and thereby<br \/>\nthe students have been mentally harassed.\n<\/p>\n<p>(ii)\tThe 2nd<br \/>\nSemester fee of Rs.15,000\/- had been taken in advance, and<\/p>\n<p>(iii)\tThe<br \/>\nservices of two teachers have been illegally terminated.\n<\/p>\n<p>2.\tPrima facie,<br \/>\nwe are of the view that the students of an institution cannot be<br \/>\ntransferred to other institution on the ground of termination of<br \/>\nservices of one or other teachers.  However, if the 2nd<br \/>\nsemester fee is charged in advance, i.e. prior to starting of the<br \/>\nclasses, there cannot be alleged to be some misconduct for<br \/>\ntransferring the students, but to de-affiliate the concerned<br \/>\ninstitution.\n<\/p>\n<p>3.\tThe<br \/>\ngrievance of the petitioner is that the Committee consists of a<br \/>\nperson, who is competitor of the petitioner   institution and<br \/>\nrunning  a parallel college in the same District.  At his instance, a<br \/>\nreport has been hurriedly prepared as at page 52A (Report of Inquiry<br \/>\nCommittee) on the basis of which the University hurriedly passed the<br \/>\nimpugned order.\n<\/p>\n<p>4.\tIt appears<br \/>\nthat the 9 institutions in which the students have been transferred<br \/>\nare situated within the Districts of Patan and Sabarkantha.\n<\/p>\n<p>5.\tTo find out<br \/>\nwhether the allegations were correct or not and due to bias of one or<br \/>\nother persons in the Inquiry Committee, the report was hurriedly<br \/>\nsubmitted, we are of the view that a Judicial Officer may make an<br \/>\ninquiry to consider the grievance.\n<\/p>\n<p>6.\tThe<br \/>\npetitioner   institution and the University are directed to give<br \/>\nthe names of the 35 students from whom the charging of excess<br \/>\nexamination fee is alleged.  They will also give the names of the<br \/>\ncolleges in which they have now been transferred.  The list of<br \/>\nrespective colleges of the districts concerned be provided to the<br \/>\nPrincipal District Judge, Patan and the Principal District Judge,<br \/>\nSabarkantha.  They in their turn will appoint one of the Judicial<br \/>\nOfficers not below the rank of the Additional District Judge, who<br \/>\nwill visit the respective colleges and inquire from the concerned<br \/>\nstudents preferably on a Court non-working Saturday.  The Principals<br \/>\nof the respective colleges situated in the Districts of Patan and<br \/>\nSabarkantha will co-operate with the Judicial Officer and will allow<br \/>\ninteraction with the students in camera.  The Officer will visit the<br \/>\npetitioner   institution and verify from the record including the<br \/>\nreceipts and the examination fees charged from the 35 students.\n<\/p>\n<p>\tThe process of<br \/>\ninspection be started immediately and the report be submitted before<br \/>\nthe next date.\n<\/p>\n<p>\tLet a copy of<br \/>\nthis order be handed over to the counsel for the parties.\n<\/p>\n<p>\tThe Registrar<br \/>\nGeneral of this Court will also forward a copy of this order to the<br \/>\nPrincipal District Judge, Patan and the Principal District Judge,<br \/>\nSabarkantha.\n<\/p>\n<p>\tPost the<br \/>\nmatter on 28th February, 2011.\n<\/p>\n<p>\tIn the<br \/>\nmeantime, the University will allow the students, those who are<br \/>\nattending the petitioner   institution as on today, to fill up the<br \/>\nexamination forms for the forthcoming examination.\n<\/p>\n<p>\t\t\t\t\t\t[S.
