No.28059 of 2011\n                              Brijesh Rao, son of Late Paras Rao\n                                              Versus\n                                      The State Of Bihar\n                                            -----------\n<\/pre>\n<p>2.   25.08.2011                  Heard learned counsel for the petitioners and the<\/p>\n<p>                  State.\n<\/p>\n<p>                                 The petitioners seek bail in a case instituted for<\/p>\n<p>                  the offence under Sections 302 and 201\/34 of the Indian Penal<\/p>\n<p>                  Code.\n<\/p>\n<p>                                 It has been submitted that the case is based on<\/p>\n<p>                  the theory of last seen and apart from a vague motive and<\/p>\n<p>                  suspicion having been expressed against the petitioners, there<\/p>\n<p>                  is no direct evidence against them.\n<\/p>\n<p>                               Considering the aforesaid as also that they have<\/p>\n<p>                  fair antecedents, let the petitioners above named, be released<\/p>\n<p>                  on bail on furnishing bail bond of Rs. 5,000\/- (Five thousand)<\/p>\n<p>                  each with two sureties of the like amount each or any other<\/p>\n<p>                  surety to be fixed by the court concerned to the satisfaction of<\/p>\n<p>                  Additional Chief Judicial Magistrate, Bagaha (West Champaran)<\/p>\n<p>                  in connection with Semera (Chiutaha) P.S. Case No. 16 of 2011<\/p>\n<p>                  subject to the following conditions: (i) That one of the bailors will<\/p>\n<p>                  be a close relative of the petitioners, who will give an affidavit<\/p>\n<p>                  giving genealogy as to how he is related with the petitioners.<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        The bailor will undertake to furnish information to the court<\/p>\n<p>        about any change in the address of the petitioners. (ii) That the<\/p>\n<p>        affidavit shall clearly state that the petitioners are not accused in<\/p>\n<p>        any other case and, if they are, they shall not be released on<\/p>\n<p>        bail. (iii) That the bailor shall also state on affidavit that he will<\/p>\n<p>        inform the court concerned if the petitioners are implicated in<\/p>\n<p>        any other case of similar nature after their release in the present<\/p>\n<p>        case and thereafter the court below will be at liberty to initiate<\/p>\n<p>        the proceeding for cancellation of bail on the ground of misuse.<\/p>\n<p>        (iv) That the petitioners will give an undertaking that they will<\/p>\n<p>        receive the police papers on the given date and be present on<\/p>\n<p>        date fixed for charge and if they fail to do so on two given dates<\/p>\n<p>        and delay the trial in any manner, their bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
