RAMACHANDRAN &amp; S.SIRI JAGAN, JJ.\n\n              ----------------------------------------------\n\n                 W.P(C).NO. 721  OF 2007 - S\n\n              ----------------------------------------------\n\n               Dated this the 5th day of February, 2007\n\n\n                          J U D G M E N T\n<\/pre>\n<p>Ramachandran, J.\n<\/p>\n<p>              By Ext.P2, the Supreme Court had directed that<\/p>\n<p>the dispute of the parents would be decided by the Family<\/p>\n<p>Court,   Thiruvananthapuram   untrammelled   by   any   earlier<\/p>\n<p>findings.   On   the   strength   of   the   order,   the   husband   had<\/p>\n<p>requested  the  Family  Court  that   custody   of  the  child   is  to<\/p>\n<p>be   handed   over   to   him   as   visitational   rights   alone   were<\/p>\n<p>reserved in favour of the wife.\n<\/p>\n<p>        2.     However, the Family Court found that there was<\/p>\n<p>clarification   required   in   the   matter   of   visitational   rights,<\/p>\n<p>since the Supreme Court had not   interfered with the issue<\/p>\n<p>of custody while Ext.P2 order was passed.  The petition was<\/p>\n<p>not  allowed  for  this reason.  This  order  is   under challenge,<\/p>\n<p>now.\n<\/p>\n<p>        3.    We had heard counsel for the petitioner as well<\/p>\n<p>as respondents.\n<\/p>\n<p>WP(C) NO.721 OF 2007<\/p>\n<p>                                    :-2-:\n<\/p>\n<p>        4.      We   do   not   find   any   error   in   the   manner   in<\/p>\n<p>which   the   issue   has   been   approached   by   the   court.\n<\/p>\n<p>Learned   counsel   for   the   respondent   submits   that<\/p>\n<p>expeditious   steps   will   be   taken   to   get   the   order   of<\/p>\n<p>clarification   as   had   been   referred   to   in   the   order   of   the<\/p>\n<p>Family Court.  The husband also may  move for  any such<\/p>\n<p>orders, in his discretion. As and  when such clarifications<\/p>\n<p>come,   the   Family   Court   will   have   to   take   a   decision   in<\/p>\n<p>consonance   with   the   orders.     We   cannot   set   any   time<\/p>\n<p>limit   for   the   purpose,   but   record   the   submission   of   the<\/p>\n<p>respondent that whatever necessary will be done, without<\/p>\n<p>delay.\n<\/p>\n<p>        The writ petition is therefore closed.\n<\/p>\n<p>                                               M.
