\nThe 15′ rehspovrideint hasap’po’_inted.Wthe petitioner as its dealer
\nby entering into an._a’g’._reern.ejiit dated 29.10.2004 for carrying<\/p>\n
on the tz-usinesus of v.e.ndi’ngVdiesei, petrol, petroieum products<\/p>\n
 and othteri.,’pro’d.0<:ts.'The inspection of the Petrol Bunk which<\/p>\n
 the petitioner was conducted by the<\/p>\n
 respondent~':io..ri'V; 28.4.2010 and found the foliowing<\/p>\n

 ” — Hydreometers and thermometers were<\/p>\n
not available at the outiet.\n<\/p>\n

available.\n<\/p>\n

\nIn addi.ti.o–n”  j_certxai’n” aspects of non~
\nperforman__ce_   were also brought to
\nthe notice of the.’d.\u00e9al\u00a7r.;\u00a7:~i.representative viz., Manjunath.<\/p>\n
The aforem’entiloVned_iagct-\u00e9iiliarel clear from the document at<\/p>\n
_.yAnnexL}ire–sr’.F’. However; the petitioner did not make efforts<\/p>\n
iyto explain :any”‘–of the irregularities that were observed and<\/p>\n
re’cor’c1ed “‘as”_’v_menti’oned above. Consequently, the impugned<\/p>\n
-order”as v’per*2\\nnexure~’G’ came to be passed on 7″‘ June<\/p>\n
 penalty of ?”50,000\/~– on the petitioner. It is<\/p>\n
.:jj_fu”ivtVh’er:made clear in the impugned order that the outlet will<\/p>\n
i ‘il\ufb02rerhain suspended till the payment of penalty is paid and<\/p>\n
WP<\/p>\n
submission of action plan duly endorsed by Executive Sales<\/p>\n
Officer, Bangalore Regional office.\n<\/p>\n
The writ petition is opposed by the respondent  ”<\/p>\n
statement of objections.\n<\/p>\n
2. Sri Madhusudana Rao,l’IVe-arned”counsela.a’ppe:aring; on <\/p>\n
behalf of the petitioner though  on  aspects of
\nthe mater, ultimately conc.l_udedigthgatVf’.th.erlpetigtioher yvill make
\npayment of the penalty  respondent
\nand conseque.n.tl3y, V’bei:directed to permit
\nthe  dealership. The said
\nsubmission i-so,pfpos~eid’byl_\u00e9$ri__.M.~S.Narayan, learned counsel<\/p>\n
appearing on iibvehalffhyof. respondent, who inter alia<\/p>\n
,..,.conte,n_d’edi*.that thegipetitioner cannot be shown any mercy,<\/p>\n
 a,s,_:s-he has sold the petroleum products at the<\/p>\n
hfi’g~h:er_ra’tes”_v.t_ha,n”\ufb01prescribed and certain other irregularities<\/p>\n
-are  the working of the petitioner.\n<\/p>\n
  The records prima facie reveal that the petitioner is<\/p>\n
V.’–..’::at_ffau|t. She has committed certain irregularities as<\/p>\n
M<\/p>\n
mentioned in Annexure~’F’. The petitioner’s representative<\/p>\n
was present during the joint meeting and after discussions_,<\/p>\n
the record of discussions was prepared as per <\/p>\n
which contains the irregularities committed bythe’ipeti’tioner,_:if  <\/p>\n
Annexure–‘F’ is signed by the petit4ion_erfs’ re,presenta:ti_ve:,i<\/p>\n
Thus, it is clear that the peti_t’io_VnerV”virtuallyTadmyiyts _:\u00a7the <\/p>\n
irregularities\/illegalities.\n<\/p>\n
4. Be that as it may,’ as Petitioner is
\nready to pay  If the
\npayment of  petitioner and if
\nshe  pjljaln\ufb02dulyhendforsed by the Executive
\nSales  \u00abpf  office, the suspension<\/p>\n
