2. Facts leading to this appeal are that, respondent<\/p>\n
V uuherein is plaintiff and appellant is defendant in the trial<\/p>\n
Court. The plaintiff filed Suit for declaration and permanent<\/p>\n
E<\/p>\n

acres of dry land situated in <\/p>\n
village, Basaral Hobli, Mandya  wh’ich’Awas*grantedto T.<\/p>\n
her by Tahsildar, Mandya Talluk. –grantcerti\ufb01c’ate*. <\/p>\n
in favour of plaintiff is at””e\u00abI?;\u00a7ii..P1 beforeralghellllvtrlial Court,
\nwherein the property”  plaintifffis i’dentified\u00b0by extent and
\nboundary correspondingto  within which it is<\/p>\n

\nissues aridlllield  sarrie in favour of plaintiff and decreed<\/p>\n
 svuxity which’ wasilchallenged by defendant in first appeal<\/p>\n

if =  the judgment and decree passed by trial<\/p>\n
 ‘OfS.No.99\/ 1996 was con\ufb01rmed. The present appeal<\/p>\n
” is. directed against the aforesaid concurrent \ufb01ndings.<\/p>\n
3. The ground on which the present appeal is filed by
\ndefendant\/appellant is that, earlier he had filed a suit in<\/p>\n
OS.No.874\/1993 for the relief of permanent injunction<\/p>\n

4. On going through  decree of trial<\/p>\n
Court and \ufb01rstappellateiserioticed that saguvali<\/p>\n
chitissued vi’n7faVo*ur’of plaintiff in the present suit is earlier
\none in the order of tiinef wherein an extent of 2 acres granted<\/p>\n
inpgfai\/our of plaintiff and the same is identi\ufb01ed with reference<\/p>\n
A \u00abto surve_y_rii.1mber as well as boundary bordering on all four<\/p>\n
 _  property. Based on that, title as well as<\/p>\n
p”0.sse.ssion\u00b0 of plaintiff over the suit schedule property is<\/p>\n
 .c confirrned in the present suit, which is confirmed by first<\/p>\n
if ‘A._V’a-ppellate Court. In the said suit, the trial Court and first<\/p>\n
appellate Court while assessing facts and documents<\/p>\n
available on record have come to the conclusion that
\nsaguvali chit\/ grant certificate issued by Tahsidlar, Mandya<\/p>\n
i,\/ifizgi<\/p>\n
district in favour of defendant is to an extentiof <\/p>\n
guntas and does not contain boundary  <\/p>\n
which is said to be situated within  of ”ileggad’thalli ‘<\/p>\n
village. It is further noticed-by bath the C.ourts_belc;wlti1ati\u00bb<\/p>\n
there is nothing on record  that tfboundfaiy of land
\ngranted in favour of  of land granted
\nin favour of plaintiff is ‘in the absence of<\/p>\n
any bouri’dafg,r.i-‘ beinig ‘” mentioned in the grant<\/p>\n
certificate.[saguvali\u00ab chit”issu,e(l’vtolthe land granted in favour
\nof defen’da11t.: “liJ.ndeVr\u00b0’t.he.__lcircumstance, both the Courts
\nbelow vvlerel unab_1efr.to=come to a conclusion that the land<\/p>\n
granted in favourof plaintiff and defendant are one and the<\/p>\n
\u00bb lsarne.vor.yt’he”adjacent properties. There is also no basis as to<\/p>\n
H  llthe.”p:.de:fendant would identify his property without<\/p>\n
referencehlto any of the documents. In the light of these<\/p>\n
 “tit1i.ngs,l both the Courts below have rightly come to the<\/p>\n
lavconfclusion that plaintiff has made out a case not only to<\/p>\n
“prove her title based on documents but also her possession<\/p>\n
in respect of the suit schedule property. Whereas, defendant<\/p>\n
who is appellant herein has miserably failed to substantiate<\/p>\n
W<\/p>\n
his claim with supporting documents tha_tlth.e’  of<\/p>\n
plaintiff and that of defendant   and_the-lsamxevvpianpd the if.<\/p>\n
exparte judgment and decree obtainedby
\nin 0.3.847\/93 would act
\nhand. Even assumin’g~..f0r  said principle
\nwould apply, it   matters are for
\npermanentiinjurietionnlonlyi  case, the case of
\nplaintiff is” not tfoijj-:.p:i\u00e9rtnla:nentip.injunction, it is both for<\/p>\n
decla1’ation”jof h’e;r.ti”t1e”–as Wellas permanent injunction to<\/p>\n
protect “her icifer the suit schedule property,’<\/p>\n
which sll”ie_pllhaslp._roVediin support of documents produced in<\/p>\n
 suit. V Whe’rea__s_,__ihe earlier suit filed by defendant is only<\/p>\n
‘ ufor inju.ne.tion_, that too, on the basis of a document, which<\/p>\n
if ‘- :do.esl’lno”t~..contain any boundary to the extent mentioned<\/p>\n
therein’ and it is also in respect of an extent of 3 acres 20<\/p>\n
l  guntas of land as against the suit schedule property which is<\/p>\n
 extent of 2 acres. Under the circumstance, the<\/p>\n
 contention of appellant that principles of res-judicata applies<\/p>\n
to the matter on hand and both the Courts below have failed<\/p>\n
to notice the same and have given a wrong finding holding<\/p>\n
that the present suit is not barred by fres-<\/p>\n
