at the hands of the petitioner has. been opposed’ <\/p>\n
State Government, by \ufb01ling a”s_tat.ement of oibjecitions.\n<\/p>\n
2. During the c’ot;irse”– learned counsel
\nfor the respondents in’vit’ed\u00a5 to the decision<\/p>\n

recorded inuparalglraplh 36 thereof. Paragraph 36 relied<\/p>\n
 onxuby\ufb01thelldearned counsel for the respondents is being<\/p>\n
 extracte\u00e9iv.here’i;inder;\n<\/p>\n
 allegations made in the petition disclose a
\n“l,arhentable state of affairs in one of the premier
\n universities of India. The petitioner might have
\n moved in his private interest but enquiry into the
\nA Conduct of the examiners of the Bombay
\nUniversity in one of the highest medical degrees
\nwas a matter of public interest. Such state of
\naffairs having been brought to the notice of the
\ncourt, it was the duty of the court to the public
\nthat the truth and the validity of the allegations
\nmade he inquired into. It was in furtherance of
\npublic interest that an enquiry into the state of
\naffairs of public institution becomes necessary and<\/p>\n
3<\/span><\/p>\n
private litigation assumes the character of public
\ninterest litigation and such an enquiry cannot be
\navoided if it is necessary and essential for-.pthe
\nadministration of justice.\n<\/p>\n
3. During the course of hearing,
\nfor the respondents could not invite.ourI_atteiiition”to}ariyit 2
\nbasis for prejudice, that would   <\/p>\n
respondents consequent’  tli\ufb01.  the”\n<\/p>\n
petitioner to withdraw ptliev\ufb02indstant lllwritflgetitioii.
\nNeedless to mention,   approaches a
\nCourt, is   and has an
\nixnquestic-‘ndablebilllV”   the said claim, by
\n l  sense of the matter,
\nthe  hands of the petitioner to<\/p>\n
