Justice K.SURENDRA MOHAN\n\n Dated :20\/01\/2011\n\n O R D E R\n           R.BASANT &amp; K.SURENDRA MOHAN, JJ.\n                     ***********************\n              W.P(C) Nos.12470 &amp; 13398 of 2010\n                  *****************************\n             Dated this the 20th day of January, 2011\n\n                           JUDGMENT\n<\/pre>\n<p>BASANT, J.\n<\/p>\n<p>     W.P(c) No.12470 of 2010 is filed by the petitioner, who has<\/p>\n<p>purchased an item of property, which was involved in an<\/p>\n<p>insolvency proceedings before the court of the Subordinate<\/p>\n<p>Judge, Thiruvananthapuram. The short prayer of the petitioner is<\/p>\n<p>that police protection may be afforded to the petitioner to put up<\/p>\n<p>boundary over the property which he has purchased. According<\/p>\n<p>to the petitioner, there is virtually no dispute about the right of<\/p>\n<p>the petitioner over the property purchased by him or the<\/p>\n<p>boundaries of that property.\n<\/p>\n<p>     2.    We had spent a long time hearing the parties.<\/p>\n<p>Towards the fag end of the hearing, it was brought to our notice<\/p>\n<p>that I.A.No.6331 of 2006 in O.P(I.P) No.2 of 1998 is pending<\/p>\n<p>before the learned Subordinate Judge, Thiruvananthapuram,<\/p>\n<p>wherein this specific relief has been claimed. Request was made<\/p>\n<p>in that petition for permission to put up the boundary over the<\/p>\n<p>property purchased by the petitioner and the insolvency court<\/p>\n<p>W.P(C) Nos.12470 &amp; 13398 of 2010   2<\/p>\n<p>was requested to afford police protection to put up such<\/p>\n<p>compound wall.\n<\/p>\n<p>      3.    That petition is pending even now and it has not been<\/p>\n<p>disposed of, it was submitted. We wanted both counsel to take<\/p>\n<p>instructions. Both counsel have taken instructions. It is now<\/p>\n<p>conceded that the said petition is pending before the Insolvency<\/p>\n<p>Court.     After discussions at the Bar it is agreed that the<\/p>\n<p>petitioner shall seek immediate orders in I.A.No.6331 of 2006.<\/p>\n<p>Parties shall be at liberty to raise all their contentions before the<\/p>\n<p>Insolvency Court, in the proceedings before which court, the<\/p>\n<p>petitioner had purchased the property. In these circumstances,<\/p>\n<p>we are satisfied and it is agreed that this Writ Petition can now<\/p>\n<p>be closed with specific directions to the Subordinate Judge,<\/p>\n<p>Thiruvananthapuram, to dispose of I.A.No.6331 of 2006 in O.P<\/p>\n<p>(I.P) No.2 of 1998, pending before it expeditiously. No further<\/p>\n<p>orders appear to be necessary on that aspect in W.P(c) No.12470<\/p>\n<p>of 2010.\n<\/p>\n<p>      4.    After the filing of W.P(c) No.12470 of 2010, the 5th<\/p>\n<p>respondent therein had filed W.P(c) No.13398 of 2010 claiming<\/p>\n<p>directions to the police to afford protection to him for his life.<\/p>\n<p>Not to be left behind, the petitioner in W.P(c) No.12470 of 2010<\/p>\n<p>W.P(C) Nos.12470 &amp; 13398 of 2010    3<\/p>\n<p>has also made a request that protection may be afforded for the<\/p>\n<p>life of the petitioner herein, ie. the officer representing the<\/p>\n<p>petitioner company.\n<\/p>\n<p>      5.    The petitioners in both petitioners assert that they<\/p>\n<p>have no intention whatsoever to take law into their hands and<\/p>\n<p>indulge in any contumacious, culpable, wanton or violent acts<\/p>\n<p>against the other. The learned Government Pleader submits that<\/p>\n<p>in the perception of police, there is no threat to the life or person<\/p>\n<p>of either petitioner. If there be any such threat, the police shall<\/p>\n<p>take necessary action and ensure that such threat is abated,<\/p>\n<p>submits the learned Government Pleader.<\/p>\n<p>      6.    We are, in these circumstances, satisfied that no<\/p>\n<p>specific directions for police protection for life and person need<\/p>\n<p>be granted to the petitioner in either case. We are satisfied that<\/p>\n<p>the submission\/undertaking of the learned Government Pleader<\/p>\n<p>can be accepted.\n<\/p>\n<p>                   7.    In the result:\n<\/p>\n<p>      A)           i)    W.P(c) No.12470 of 2010 is dismissed, but<\/p>\n<p>            with the specific observation\/direction that the<\/p>\n<p>            Subordinate        Judge,  Thiruvananthapuram,      must<\/p>\n<p>            dispose of I.A.No.6331 of 2006 in O.P(I.P) No.2 of<\/p>\n<p>W.P(C) Nos.12470 &amp; 13398 of 2010   4<\/p>\n<p>            1998 as expeditiously as possible &#8211; at any rate, within<\/p>\n<p>            a period of three months from 01.02.2011. Needless<\/p>\n<p>            to say, the parties shall be at liberty to raise all their<\/p>\n<p>            contentions in the said I.A before the Insolvency<\/p>\n<p>            Court;\n<\/p>\n<p>                   ii)   Compliance shall be reported to this Court;<\/p>\n<p>                   iii)   Both parties are directed to appear before<\/p>\n<p>             the Subordinate Judge, Thiruvananthapuram, where<\/p>\n<p>             I.A.No.6331 of 2006 is pending, on 01.02.2011 to<\/p>\n<p>             continue the said proceedings;\n<\/p>\n<p>                   iv)   The Registry shall forthwith communicate<\/p>\n<p>             copy of this order to the Subordinate Judge,<\/p>\n<p>             Thiruvananthapuram.\n<\/p>\n<p>      B)    W.P(c) No.13398 of 2010 is dismissed.<\/p>\n<p>     7.
