DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tPerused<br \/>\nthe petition preferred by the petitioner through jail.\n<\/p>\n<p>\tThe<br \/>\npetitioner convict of the offence punishable under section 302 of the<br \/>\nIPC has preferred this petition against the order passed by the<br \/>\ncompetent authority of refusing to transfer him from Central Jail,<br \/>\nVadodara to Central Jail, Ahmedabad at Sabarmati on the ground that<br \/>\nfamily of the petitioner, including his parents is staying at<br \/>\nAhmedabad and they suffer undue hardship, if he is not transferred,<br \/>\nas prayed above.\n<\/p>\n<p>\tThe<br \/>\ncompetent authority, after considering the relevant aspects found<br \/>\nthat the application preferred by the petitioner was not as per the<br \/>\npermissible Re-Classification Rules.  Besides the petitioner has<br \/>\nroots in the city of Ahmedabad and, therefore, the competent<br \/>\nauthority formed the opinion that the petitioner should continue at<br \/>\nVadodara Central Jail.\n<\/p>\n<p>\tHaving<br \/>\nheard learned APP and on perusal of the record, in any manner it<br \/>\ncannot be said that the view taken by the competent authority is<br \/>\nunreasonable or contrary to law.  No interference is called for by<br \/>\nthis Court in exercise of powers under Article 226 of the<br \/>\nConstitution of India.\n<\/p>\n<p>\tThis<br \/>\npetition stands dismissed accordingly.\n<\/p>\n<p>[Anant<br \/>\nS.
