SHAH\n\t\t\n\t\n\n \n\nDate\n: 28\/04\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, the petitioner has prayed for an appropriate writ, order<br \/>\nand\/or direction, quashing and setting aside the impugned order dated<br \/>\n19\/05\/2010 passed by the Secretary (Appeals), Revenue Department,<br \/>\nState of Gujarat in Revision Application No.18\/2004 dismissing the<br \/>\nsaid revision application mainly on the ground of delay and latches.\n<\/p>\n<p>2.\t\tAt<br \/>\nthe outset, it is required to be noted that the Collector, Ahmedabad<br \/>\ngranted land admeasuring about 4047 sq.mtrs. out of land bearing<br \/>\nSurvey No.240\/A paiki situated at Ranpur to the Mamlatdar office of<br \/>\nRanpur for its office construction, which came to be challenged by<br \/>\nthe petitioner before the Secretary (Appeals), Revenue Department,<br \/>\nState of Gujarat in the year 2004 i.e. after a period of three years,<br \/>\nwhich came to be dismissed by Revisional Authority by impugned order<br \/>\ndated 19\/05\/2010 on the aforesaid ground. Normally, this Court would<br \/>\nhave remanded the matter to decide and dispose of the same on merits,<br \/>\nhowever, it is reported that on the land in question construction of<br \/>\noffice of Mamlatdar, Ranpur is already made and office is running<br \/>\nsince long, no purpose would be served to remand the matter.\n<\/p>\n<p>3.\t\tIt<br \/>\nis to be noted that there is a further delay of one year in<br \/>\npreferring the present petition. Considering the  aforesaid facts,<br \/>\nthe present petition is not entertained. However, it will be open for<br \/>\nthe petitioner to approach State Government for the land in question,<br \/>\nwhich has been allotted to Mamlatdar office, Ranpur as they were<br \/>\nclaiming ownership over the land in question and as and when such<br \/>\napplication is made, the same may be decided considering the fact<br \/>\nthat the petitioner is also Department of Central Government. It is<br \/>\nto be noted that as such the land in question is treated as<br \/>\nGovernment Padtar land by the Collector, which has been allotted in<br \/>\nthe year 2001 for construction of Mamlatdar&#8217;s Office at Ranpur.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present petition is disposed of.
