No.22536 of 2010\n                    VIJAY SINGH YADAV, SON OF LATE BIHARI SINGH\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   12.07.2010                Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                               The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 25(1-b)a and 26 of the Arms Act.<\/p>\n<p>                               It has been submitted that from the possession of the<\/p>\n<p>                  petitioner a country made pistol without cartridge was recovered<\/p>\n<p>                  for which he is in custody since 19.10.2008. Further submission<\/p>\n<p>                  is that the petitioner apart from a case instituted for SC\/ST Act,<\/p>\n<p>                  is not an accused in any other case.\n<\/p>\n<p>                               In view of such, let the petitioner above named, be released on<\/p>\n<p>                  bail on furnishing bail bond of Rs. 5,000\/- (Five thousand) with two sureties<\/p>\n<p>                  of the like amount each to the satisfaction of Sri A.K. Singh, Judicial<\/p>\n<p>                  Magistrate, 1st Class, Arrah, Bhojpur, in Sessions Trial No. 1023 of 2010<\/p>\n<p>                  arising out of Charpokhari P.S. Case No. 156 of 2008 subject to the<\/p>\n<p>                  following conditions: (i)That one of the bailors will be a close<\/p>\n<p>                  relative of the petitioner who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioner. The bailor<\/p>\n<p>                  will undertake to furnish information to the Court about any<\/p>\n<p>                  change in address of the petitioner. (ii)That the bailor shall also<\/p>\n<p>                  state on affidavit that he will inform the court concerned if the<\/p>\n<p>                  petitioner is implicated in any other case of similar nature after<\/p>\n<p>                  his release in the present case and thereafter the court below<\/p>\n<p>                  will be at liberty to initiate the proceeding for cancellation of bail<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        on the ground of misuse. (iii)That the petitioner will give an<\/p>\n<p>        undertaking that he will receive the police papers on the given<\/p>\n<p>        date and be present on date fixed for charge and if he fails to<\/p>\n<p>        do so on two given dates and delays the trial in any manner, his<\/p>\n<p>        bail will be liable to be cancelled for reasons of misuse.
