SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>Both<br \/>\n\tthese appeals arise out of the order of appointment and Award<br \/>\n\tdeclared by the learned sole Arbitrator. These First Appeals are of<br \/>\n\tthe year 1991. It appears that both these appeals were placed on<br \/>\n\tboard for hearing in the year 2006 and an Affidavit was filed on<br \/>\n\tbehalf of the respondents and a Further Affidavit was also filed on<br \/>\n\tbehalf of the respondents stating that the dispute is amicable<br \/>\n\tsettled between the parties and  on payment of Rs.56,700=00 and<br \/>\n\tRs.9,039=00 by the respondent herein, both the appeals are to be<br \/>\n\twithdrawn.  It appears that the copy of the Further Affidavit has<br \/>\n\tbeen served upon the office of the Government Pleader way back on<br \/>\n\t8\/8\/2007, and there is no counter to the same.\n<\/p>\n<p>In<br \/>\n\tview of the Further Affidavit dtd.25\/7\/2007 affirmed by one<br \/>\n\tMr.Navinbhai Dave son of Chandulal Dave, Director of respondent,<br \/>\n\tboth these First Appeals are dismissed.
