Thereafter, on 16th January 1988, the<br \/>\n\tpetitioner was promoted to the post of Mamlatdar (Class-II). Since<br \/>\n\tthen he has been working at various places as Mamlatdar, Class-II<br \/>\n\tofficer. That on 18th February 1994, the petitioner was<br \/>\n\ttransferred as City Mamlatdar, Class-II Officer to Nadiad. The<br \/>\n\trespondents on 28th July 1994 passed the impugned order<br \/>\n\tof reversion\/ reduction in rank of the petitioner from the post of<br \/>\n\tMamlatdar (Class-II) to the post of Deputy Mamlatdar (Class-III)<br \/>\n\twithout affording any opportunity of hearing to the petitioner.<br \/>\n\tHence, the present petition.\n<\/p>\n<p>It<br \/>\n\tis the main argument advanced by the learned advocate for the<br \/>\n\tpetitioner that the impugned order has been passed by the<br \/>\n\trespondent-authority without affording any reasonable opportunity of<br \/>\n\thearing to the petitioner and therefore, the same is against the<br \/>\n\tprinciples of natural justice and, therefore, the petition is<br \/>\n\trequired to be allowed.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned advocate for the<br \/>\n\tpetitioner and documents produced on record, it clearly transpires<br \/>\n\tthat the respondent-authority has passed the impugned order without<br \/>\n\taffording any opportunity of hearing to the petitioner. Thus, only<br \/>\n\ton the ground of principles of natural justice, the impugned order<br \/>\n\tis vitiated and it is required to be quashed and set aside.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid observations, the present petition is hereby<br \/>\n\tallowed. The impugned order dated 28th July 1994 passed<br \/>\n\tby the respondent-authority is hereby quashed and set aside. The<br \/>\n\tmatter is remanded to the respondent-authority for deciding the same<br \/>\n\tafresh by issuing notice to the petitioner and affording reasonable<br \/>\n\topportunity of hearing to him and thereafter to pass a speaking<br \/>\n\torder.  It is, however, made clear that the respondent-authority<br \/>\n\twill consider all the contentions raised by the petitioner before<br \/>\n\thim. It is required to be noted that this Court has not examined the<br \/>\n\tmatter on merits.  Rule is made absolute to the aforesaid extent.
