Challenge in this appeal is to the judgment of a learned<\/p>\n<p>Single Judge of the Madras High Court upholding the<\/p>\n<p>conviction of the appellant for offence punishable under<\/p>\n<p>Section 8 (c) read with Section 22 of the Narcotic Drugs and<\/p>\n<p>Psychotropic Substances Act, 1985 (in short the `Act&#8217;) and<\/p>\n<p>sentence of 10 years rigorous imprisonment and a fine of<br \/>\nRs.1,00,000\/- as was imposed by learned Special Judge,<\/p>\n<p>Salem.\n<\/p>\n<p>2.      Background facts in a nutshell are as follows:<\/p>\n<p>        Veerannan (PW-1), Sub Inspector of Police, attached to<\/p>\n<p>N.I.B. C.I.D., Salem on 16.12.1999 at about 9.00 A.M. along<\/p>\n<p>with Vellingiri (PW-4), Head Constable No.910 and other Police<\/p>\n<p>party      on    secret    information      were   patrolling      at<\/p>\n<p>Pethanayakkampalaym Bus Stop. They found activities of the<\/p>\n<p>appellant\/accused, who stood near the bus stop with a yellow<\/p>\n<p>colour bag on his right hand, at about 12.00 noon, to be<\/p>\n<p>suspicious. P.W.1 after introducing himself, conveyed to him<\/p>\n<p>that he is entitled for the conduct of the search before a<\/p>\n<p>Gazetted Officer or a Judicial Magistrate. The accused gave<\/p>\n<p>consent to be searched by the official himself. Accordingly,<\/p>\n<p>P.W.1     searched   his   bag   in   the   presence   of   the   two<\/p>\n<p>independent witnesses namely Duraisamy (PW-2), Village<\/p>\n<p>Administrative Assistant and Duraisamy Assistant (PW-3) and<\/p>\n<p>P.W.4 Head Constable and found 2 Kilograms of Diazepam.<\/p>\n<p>P.W.1 seized the same under Ex.P2 mahazar in the presence<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><br \/>\nof the said witnesses. He took two samples of 25 grams each<\/p>\n<p>marked as M.0.2 and affixed the seal and the rest of the<\/p>\n<p>contraband was sealed, which is marked as M.0.1.The<\/p>\n<p>appellant\/accused was arrested under Ex.P3 arrest memo, a<\/p>\n<p>copy of which was served on him. The accused was brought to<\/p>\n<p>the Office, and a case was registered in Crime No. 91\/99<\/p>\n<p>under Sec. 20(b) (1) of the Act. Ex.P4 printed F.I.R. was<\/p>\n<p>prepared. The accused was taken to the concerned Court<\/p>\n<p>along with the F.I.R and the material objects. A detailed report<\/p>\n<p>under Ex.P5 under Sec.57 of&#8217;-the Act was prepared and sent<\/p>\n<p>to the higher officials. Sankarapandian (PW-6), Inspector of<\/p>\n<p>police, NIB CID, Salem took up further investigation after<\/p>\n<p>obtaining Ex.P5 and other relevant records from PW-1. He<\/p>\n<p>proceeded to the site of occurrence and also to the house of<\/p>\n<p>the accused, made a search in front of the witnesses, prepared<\/p>\n<p>Ex.P7 search memo, examined PWs 1 to 4 and recorded their<\/p>\n<p>statements. The investigating officer (PW-6) made a request<\/p>\n<p>under Ex.P8 to the Court for sending M.O.2 for chemical<\/p>\n<p>analysis.   Accordingly,   the       sample   was   analysed   by<\/p>\n<p>Arulanandam (PW-5) Scientific Assistant attached to the<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><br \/>\nForensic Laboratory, who found that the sample under M.O.2<\/p>\n<p>is diazepam. PW-5 sent Ex.P6 report to the Court. On<\/p>\n<p>19.1.2002 PW-6 examined PW-5 and recorded his statement.<\/p>\n<p>On completion of the investigation, PW-6 filed a charge sheet<\/p>\n<p>against the accused under Section 22 of the Act.<\/p>\n<p>     Since the accused pleaded innocence the trial was held.<\/p>\n<p>Six witnesses were examined and several exhibits and<\/p>\n<p>material objects were brought on record. In his examination<\/p>\n<p>under Section 313 of the Code of Criminal Procedure, 1973 (in<\/p>\n<p>short the `Code&#8217;) the accused-appellant flatly denied the<\/p>\n<p>accusations. He examined his wife as PW-1. The trial Court<\/p>\n<p>found that the prosecution has been able to establish its<\/p>\n<p>accusations. Two grounds were taken before the High Court<\/p>\n<p>relating to the alleged non compliance of the mandatory<\/p>\n<p>provisions of Sections 42(2) and the other 50 of the Act. The<\/p>\n<p>High Court did not find any substance. Accordingly, the<\/p>\n<p>appeal was dismissed.\n<\/p>\n<p><span class=\"hidden_text\">                             4<\/span>\n<\/p>\n<p>3.   In support of the appeal, learned counsel for the<\/p>\n<p>appellant submitted that even if the prosecution case is<\/p>\n<p>accepted   in toto there    is clear material to show the<\/p>\n<p>contravention of the requirements of Sections 42(2) and 50 of<\/p>\n<p>the Act.\n<\/p>\n<\/p>\n<p>4.   Learned counsel for the respondent-State supported the<\/p>\n<p>judgments of the trial Court and the High Court.<\/p>\n<p>5.   Sections 42(2) and 43 of the Act are as under:<\/p>\n<blockquote><p>           &#8220;42(2)-Where an officer takes down any<br \/>\n           information in writing under sub-section (1) or<br \/>\n           records grounds for his belief under the<br \/>\n           proviso thereto, he shall within seventy-two<br \/>\n           hours send a copy thereof to his immediate<br \/>\n           official superior.\n<\/p><\/blockquote>\n<blockquote><p>           43. Power of seizure and arrest in public<br \/>\n           place.-Any officer of any of the departments<br \/>\n           mentioned in section 42 may-<\/p><\/blockquote>\n<p>           (a) seize in any public place or in transit, any<br \/>\n           narcotic drug or psychotropic substance or<br \/>\n           controlled substance in respect of which he<br \/>\n           has reason to believe an offence punishable<br \/>\n           under this Act has been committed, and, along<br \/>\n           with such drug or substance, any animal or<br \/>\n           conveyance or article liable to confiscation<\/p>\n<p><span class=\"hidden_text\">                              5<\/span><br \/>\n          under this Act, any document or other article<br \/>\n          which he has reason to believe may furnish<br \/>\n          evidence of the commission of an offence<br \/>\n          punishable under this Act or any document or<br \/>\n          other article which may furnish evidence of<br \/>\n          holding any illegally acquired property which<br \/>\n          is liable for seizure or freezing or forfeiture<br \/>\n          under Chapter VA of this Act;\n<\/p>\n<p>          (b) detain and search any person whom he has<br \/>\n          reason to believe to have committed an offence<br \/>\n          punishable under this Act, and if such person<br \/>\n          has any narcotic drug or psychotropic<br \/>\n          substance or controlled substance in his<br \/>\n          possession and such possession appears to<br \/>\n          him to be unlawful, arrest him and any other<br \/>\n          person in his company.\n<\/p>\n<p>          Explanation.-For the purposes of this section,<br \/>\n          the expression &#8220;public place&#8221; includes any<br \/>\n          public conveyance, hotel, shop, or other place<br \/>\n          intended for use by, or accessible to, the<br \/>\n          public.&#8221;\n<\/p>\n<\/p>\n<p>6.   So far as Section 42(2) is concerned it is to be noted that<\/p>\n<p>search was made in public place and not in a building and as<\/p>\n<p>such what was applicable was Section 43 and not Section 42<\/p>\n<p>(2) of the Act. The decision of this Court in <a href=\"\/doc\/1438183\/\">State of Punjab vs.<\/p>\n<p>Baldev Singh<\/a> (1999 (6) SCC 172) is clearly applicable to the<\/p>\n<p>facts of the present case. The view in Baldev Singh&#8217;s case<\/p>\n<p><span class=\"hidden_text\">                              6<\/span><br \/>\n(supra) was re-iterated in <a href=\"\/doc\/1216036\/\">State of Haryana v. Jarnail Singh<\/p>\n<p>and Ors.<\/a> (2004 (5) SCC 188).\n<\/p>\n<\/p>\n<p>7.   So far as the applicability of Section 50 of the Act is<\/p>\n<p>concerned, it is to be noted that there was search of the bag<\/p>\n<p>carried by the appellant and there was no personal search. It<\/p>\n<p>has been held in State of H.P. v. Pawan Kumar (2005 (4) SCC<\/p>\n<p>350) that when there is no personal search and the search is<\/p>\n<p>effected in relation to a bag, Section 50 of the Act has no<\/p>\n<p>application.\n<\/p>\n<\/p>\n<p>8.   Above being the position, we find no infirmity in the<\/p>\n<p>judgment of the High Court to warrant interference.
