Leave granted.\n<\/p>\n<p>2.The  appeals by special leave arise from the judgment\t and<br \/>\nOrder dated 14.5.95 and 20.11.92 of the High Court of Punjab<br \/>\n&amp;  Haryana made in Review Application No.20 CII of 1993\t and<br \/>\nC.M. 2262 of 1993 and C.R. No.3019\/92 respectively.\n<\/p>\n<p>3.   The notification under s.4(1) of the Land\t  Acquisition<br \/>\nAct, 1894, for short the Act, was  published  initially\t  on<br \/>\nMarch 3 1, 1981\t    acquiring  a  large extent\tof  land  in<br \/>\nGobindpura  and\t other\tplaces\tfor  extension\tof  military<br \/>\ncantonment   at\t  Bhatinda.    In   the\t  determination\t  of<br \/>\ncompensation, the Division Bench of the High Court in L.P.A.<br \/>\nNo. 13 49\/89 and batch ultimately held that:<br \/>\n&#8220;Consequently  we  venture to make the modification  in\t the<br \/>\norder  of  the\tSingle Judge, to the effect  that  the\tland<br \/>\nfailing\t within\t a  depth of 500 meters an  either  side  of<br \/>\nBhatinda-Bibiwala Road shall also be assessed at the rate of<br \/>\nRs.90,000\/- per acre as its market value&#8230;&#8230;&#8230;<br \/>\nThat  order appears to have become final.  Subsequently\t the<br \/>\nrespondents filed an application before the Additional Dist.<br \/>\nJudge in Civil Misc.  No.75 of 10.8.1991 for demarcation and<br \/>\naward  of compensation\tto the 500 meters as ordered by\t the<br \/>\nHigh  Court.   By order dated 16.12.1991  the  Addl.   Dist.<br \/>\nJudge held that-,<br \/>\n&#8220;From the evidence discussed above, it is crystal clear that<br \/>\nthe  Land measuring  70 kanals 13 Marlas belonging  to\tNaib<br \/>\nSingh  etc., land measuring 141 kanals 1 marla belonging  to<br \/>\nGurdial\t Singh\tetc.  land  measuring  30  kanals  3  marlas<br \/>\nbelonging  to Pratap Kaur etc. land measuring 40  kanals  10<br \/>\nmarlas\tbelonging  to Bhagwan Kaur etc.\t land  measuring  48<br \/>\nkanals belonging to Gurdial Kaur etc., and land measuring  3<br \/>\nkanals\ti.e. 1\/12 share of 35 kanals 9 marlas  belonging  to<br \/>\nSadhy Singh are with 500 meters from Bathinda Bibiwala road.\n<\/p>\n<p><span class=\"hidden_text\">571<\/span><\/p>\n<p>\t      I\t may  add  here that  the  evidence  of\t the<br \/>\n\t      applicants    remained\tunchanged    despite<br \/>\n\t      opportunities given to the UOI.  On the  other<br \/>\n\t      hand,   the   officials\tof   the   concerned<br \/>\n\t      department have appeared in the witness box as<br \/>\n\t      AW 1, AW 2 and AW 5 to support the case of the<br \/>\n\t      claimants.     Even   otherwise\t from\t the<br \/>\n\t      interpretation  ofjudgment  Ex.A3\t it  clearly<br \/>\n\t      goes to show that the land which falls  within<br \/>\n\t      the  depth of 500 meters from either  side  of<br \/>\n\t      Bathinda Bibiwala Road, should be assessed  at<br \/>\n\t      rate of Rs.90,000\/- per acre.  The land of the<br \/>\n\t      applicants  adjoins  the\tland  which  as\t per<br \/>\n\t      evidence\ton record, was assessed at the\trate<br \/>\n\t      of   Rs.90,000\/-\t per  acre.    I   therefore<br \/>\n\t      accepting\t the  applications direct  the\tNaib<br \/>\n\t\t\t    Tehsildar (MLA) Bhatinda to prepare the amende<br \/>\nd<br \/>\n\t      memo  of\tcosts in respect of the\t above\tsaid<br \/>\n\t      land   of\t the  applicants  at  the  rate of<br \/>\n\t      Rs.90,000\/- per acre.  The parties are left to<br \/>\n\t      bear their own costs&#8221;.\n<\/p>\n<p>Calling\t in  question the above order the  appellants  filed<br \/>\nrevision  in the High Court.  The High Court  dismissed\t the<br \/>\nrevision  in limine.  Thereafter the review  petitions\talso<br \/>\nstood dismissed.  Thus these appeals by special leave.\n<\/p>\n<p>4. The question that arises in these appeals is whether\t the<br \/>\nDistrict Judge has power and\tjurisdiction\tto award<br \/>\ncompensation  @\t Rs.90,000\/-  per acre to  the\tarea  coming<br \/>\nwithin\tthe  belt of 500 meters as ordered by  the  Division<br \/>\nBench of the High Court.\n<\/p>\n<p>5.  Section 26 of the Act gives power to the Civil Court  to<br \/>\ngive award thus:\n<\/p>\n<blockquote><p>\t      1)  Every\t award under this Part shall  be  in<br \/>\n\t      writing signed by the Judge, and shall   specify<br \/>\n\t      the amount awarded under clause\t  first\t  of<br \/>\n\t      sub-s.(1) of s.23, and&#8230;&#8230;&#8230;.&#8221;\n<\/p><\/blockquote>\n<p>Section\t 13-A  of the Act as amended under Act\t68  of\t1984<br \/>\nprovides power for correcting clerical error% thus:\n<\/p>\n<blockquote><p>\t      &#8220;13-A.  Correction of clerical errors, etc&#8230;.<br \/>\n\t      (1)   The\t Collector may, at any time but\t not<br \/>\n\t      later  than  six months from die date  of\t the<br \/>\n\t      award, or where he has been required under  s.<br \/>\n\t      18  to make a reference to the  Court,  before<br \/>\n\t      the  making  of  such  reference,\t by   order,<br \/>\n\t      correct any clerical or arithmetical  mistakes<br \/>\n\t      in the award or errors arising therein  either<br \/>\n\t      on  his own motion  or on the  application  of<br \/>\n\t      any person interested or a local authority.<br \/>\n\t      Provided that no correction which is likely to<br \/>\n\t      affect prejudicially any person shall be\tmade<br \/>\n\t      unless such person has been given a reasonable<br \/>\n\t      opportunity of making a representation in\t the<br \/>\n\t      matter.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t      (Sub-ss.(2)  and (3) are not material for\t the<br \/>\n\t      purpose of this case. hence omitted).\n<\/p><\/blockquote>\n<p>6.  Perforce,  it has no application to\t the,  Civil  Court.<br \/>\nEven  if the principle is extended to the Civil\t Court,\t the<br \/>\nCourt  committed manifest error of jurisdiction in  allowing<br \/>\nthe application, as it did not correct any clerical error.\n<\/p>\n<p>7.A  conjoint reading of ss.26 and 13-A of the\tAct  clearly<br \/>\nindicates  that while making the award and  determining\t the<br \/>\ncompensation  under clause firstly of subs.(1) of  s.23\t the<br \/>\nCollector  had\tjurisdiction to determine  the\tcompensation<br \/>\nincluding  belting  for the purpose  of\t determining  market<br \/>\nvalue\tand  correct  clerical\tand  arithmetical   mistakes<br \/>\ncommitted in making the award.\tThe High Court had exercised<br \/>\nappellate  power under s.54 of the Act.\t Appellate power  is<br \/>\nco-extensive  with that of the Civil Court.  Therefore,\t the<br \/>\nHigh Court, while exercising the appellate power, could<br \/>\n<span class=\"hidden_text\">572<\/span><br \/>\nalso  decide belting.  The Division Bench in the  LPA  while<br \/>\ndetermining  the compensation under clause firstly  of\tsub-<br \/>\ns.(1)  of s.23, had identified belting upto a depth  of\t 500<br \/>\nmeters and directed payment of compensation for that land at<br \/>\n90,000\/-  per  acre.   When the\t High  Court  exercised\t the<br \/>\nappellate power, without any order of remand or calling\t for<br \/>\na  finding,  the  District  Judge was  devoid  of  power  or<br \/>\njurisdiction  to correct any error either under s.  13-A  of<br \/>\nthe Act or under s. 152 CPC, that too beyond the  limitation<br \/>\nprescribed  under  s. 13A itself The identification  of\t the<br \/>\nland  is not a clerical or arithmetical mistake\t within\t the<br \/>\nmeaning\t of  s. 13-A or s. 152 CPC.  It\t is  an\t independent<br \/>\nexercise  of the power for the purpose of  determination  of<br \/>\nthe  compensation under clause firstly of sub-s.(1) of\ts.23<br \/>\nof the Act.  With making the award under s.26 of the Act the<br \/>\nCivil  Court ceased to have power to alter the award  except<br \/>\nto  correct clerical or arithmetical errors.  The action  of<br \/>\nthe Additional District Judge was an independent one without<br \/>\nreference or an order of remand or the High Court calling  a<br \/>\nfinding from it.  The Civil Court, therefore, was devoid  of<br \/>\njurisdiction and power to pass the impugned award or  order,<br \/>\nas stated by the Additional District Judge; and that too af-<br \/>\nter it had made the award.\n<\/p>\n<p>8.   Since  the Addl.  Dist.  Judge was not called  upon  to<br \/>\ndetermine the compensation after identification of the\tland<br \/>\nwithin\tthe  belting  of 500 meters  as\t determined  by\t the<br \/>\nDivision  Bench, the order of the District Judge is  clearly<br \/>\nwithout jurisdiction and power and is a nullity.  Therefore,<br \/>\nthe  High Court was not right in dismissing the\t application<br \/>\nwithout\t adverting to these material questions touching\t the<br \/>\njurisdiction  and power of the Addl.  Dist.  Judge.   Though<br \/>\nSri  Arun  Jetley,  the learned\t Senior\t counsel  repeatedly<br \/>\nrequested  this Court not to interfere under Art.136, it  is<br \/>\nnecessary  to  correct legal error to set the  procedure  in<br \/>\norder.\n<\/p>\n<p>9.   The,  appeals are accordingly allowed.  It is  open  to<br \/>\nthe  respondents, if so advised, to approach the High  Court<br \/>\nfor  appropriate  relief  and it is for the  High  Court  to<br \/>\nconsider and dispose of it according to law.  No costs.<br \/>\nIn C.A. Nos. 3182-87 of 1995 @ SLP (C) Nos. 18320-25194:\n<\/p>\n<p>10.  Leave granted.  Substitution allowed.\n<\/p>\n<p>11.  In\t view of the above judgment, these appeals also\t are<br \/>\nallowed.
