Heard.     \n\n3.  'the  -oi"eonvenience parties are referred to\nas theyarereferr\u00a7d._to'\u00abin the claim petition before the\n\n'rr;ibu_na1.i ~\n\n.0 V'  A  i,':Brief factslmofvthe case are:\n\n  l---3\u00ab~06, when the claimant along with\n\nothers  travelling in the bus bearing registration\n\n i VgNolK\u00a33l--16--54;33 from Chitradurga to their respective\n\nV"-n-ative places, in between D.Kurubara Hatty --\n\n00 Thoparamalige village, the bus met with an accident\n\n5?:\n\n\n\ndue to the rash and negligent of the same by its driver.\nAs a result, the passengers including the claimant\nsustained injuries. Hence, he \ufb01led a claim petition\n\nbefore the MACT, Chitradurga, seeking  of\n\nRs.6,'75,000\/--. The Tribunal by \n\nand award has awarded compensatiori of;--d T. it\n\nwith interest at 6%    \ncompensation awarded    \nin appeal seeking V   .c.ornpensaVtion.\n\n5. As there is   occurrence of\n\naccident, nelglgigencgie   the insurer of the\n\noffending point that remains for my\nconsiderationdl   appeal is:\n\nV l "'W_hether the quantum of\n\n ;_'--r.pcoInpensa*tio'n awarded by the Tribunal is\n\n, _ just'-._ and proper or does it call for\nit ' as _  ..er:ha=nc.ement?\n\nit  hearing the learned Counsel for the parties\n\n andgperusing the award of the Tribunal, I am of the\n\nit *  that the compensation awarded by the Tribunal is\n\n$5\n\n\n\nnot just and proper, it is on the lower side and therefore\n\nit is deserved to be enhanced.\n\nAs per wound certificate -- Ex.103, the claimant\n\nhas sustained the following injuries :\n\nComminuted fracture of upper l\/Sid of\n\nleft tibia.\n\nDr. R.T. Chandrashekari ;":ex2:;_fr1iiieCi .   ivho .2\n\nhas given disability 'llc_er.tiiicat'e at  \ncategorically stated that...  " had  fundergone\nsurgery and skin grafting  "There is loosening\n\nof diametricl'o.f   of one inch\n\ncori1pared.ltlo=rigl*itf'leg}"'-. He had given first aid. He has\n\nstatedl"c.lai:,naln_t.lhas.isruffered permanent disability of 50\n\n to loWer___l_irnb.\n\n   (Jonsidering the nature of injuries. Rs.10,000\/--\n\n 2   Tribunal towards pain and suffering is\n\nonztlie lower side and it is deserved to be enhanced by\n\nif 'another Rs.20,000\/- and I award Rs.30,000\/-- under\n\n  head.\n\n .\n<\/pre>\n
8. As Rs.42,020\/– awarded by the Tribunal towards
\nmedical expenses is as per medical bills produced by
\nthe claimant, the same is just and proper and therefore,<\/p>\n
it does not call for enhancement.<\/p>\n
9. Claimant was treated as inpatient <\/p>\n
8-3-06 in Government Hospital, .jchifir~:;c\u00a2{rg’g;i,, as -. <\/p>\n
continued treatment at <\/p>\n
from 8-3-06 to 10-5-osaa aga.,in\u00ab.,frorn–T7\u00a56:O6 to’<\/p>\n
17-6-06, totally  a \u00ababout; 70 days.
\nConsidering the same, it awarded by the<\/p>\n
Tribunal tiov\/liiards atten_dian.tx”a1j_1dVnourishment charges<\/p>\n
is   therefore, totally a sum of
\nRs.20,l0O_,O\/.+   towards incidental expenses.<\/p>\n
 __TClaimar1t.c1.aims to have been earning Rs.5,000\/–<\/p>\n
‘ .-Viper  doing agriculture. But the same is not<\/p>\n
 In the absence of proof of income, his<\/p>\n
income is assessed at Rs.3,000\/– per month. Nature of<\/p>\n
V’ ,_inj_uries suggest, he must have been under rest and<\/p>\n
 treatment for a period of five months. Therefore, a sum<\/p>\n
Q?\n<\/p>\n
of Rs.15,000\/– is awarded towards loss of income<\/p>\n
during laid up period.\n<\/p>\n
11. Considering the disability stated by the.__ doctor<\/p>\n
and an amount of discomfort and unhappii1Ve’ss’L:’–whieh<\/p>\n
he has to undergo for the rest of his  \/;<\/p>\n

12. Claimant is ‘aged years. Multiplier<\/p>\n

\nassessed 50 to 55% to left lower limb<\/p>\n
 '_I'rihi.1na1"has'- considered the disability caused to<\/p>\n
   at llll l5%. It is on the lower side and<\/p>\n
it    caused to whole body is taken at<\/p>\n

 is So hfiiture loss of income works out to Rs.85,680\/–<\/p>\n

14. Accordingly  in part and the

\nextent   claimant is entitled for
\na total  – as against\n<\/p>\n
— the Tribunal with interest at
\n6% p.a’.e compensation of Rs.80,480\/–<\/p>\n
