Heard learned counsel for the petitioner and the<\/p>\n<p>                       State.\n<\/p>\n<p>                                   2. This writ petition has been filed for issuing a<\/p>\n<p>                       writ in the nature of mandamus or any other appropriate<\/p>\n<p>                       writ     commanding         the    respondent-State        Election<\/p>\n<p>                       Commissioner to stay the schedule of Panchayat election<\/p>\n<p>                       at Ranipur Sakarpura Panchayat under Khagaria Block,<\/p>\n<p>                       District-Khagaria, on the ground that the nomination paper<\/p>\n<p>                       of the petitioner has wrongly been cancelled arbitrarily<\/p>\n<p>                       with ulterior motive.\n<\/p>\n<p>                                   3. The case of the petitioner that he filed a<\/p>\n<p>                       nomination in the office of the Block Development<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Officer-cum-Block Election Officer, Khagaria to contest<\/p>\n<p>the election of Mukhiya in Ranipur Sakarpura Panchayat<\/p>\n<p>under Khagaria Block in the District of Khagaria in view<\/p>\n<p>of announcement of Panchayat election by the State<\/p>\n<p>Election Commission.        The election was notified and<\/p>\n<p>announced on 22. 03. 2011. The date published for filing<\/p>\n<p>of nomination from 28. 02.2011 to 07. 03. 2011. The<\/p>\n<p>further case is that the petitioner that according to<\/p>\n<p>schedule, 10. 03. 2011 was the date fixed for the<\/p>\n<p>correction of nomination paper, 12. 03. 2011 was date<\/p>\n<p>fixed for allotment of symbol and 24. 04. 2011 is the date<\/p>\n<p>fixed for voting.\n<\/p>\n<p>          4.    The further case of the petitioner is that<\/p>\n<p>petitioner filed nomination on 07. 03. 2011. However, in<\/p>\n<p>the nomination paper the column for the proposer was left<\/p>\n<p>vacant.   Hence, on the date fixed for correction of<\/p>\n<p>nomination paper, the petitioner went to office of Block<\/p>\n<p>Development Officer-cum-Block Election Officer and<\/p>\n<p>remained there from 10.30 A.M. to 4 P.M., but the<\/p>\n<p>signature of the proposer was not taken or corrected in the<\/p>\n<p>nomination paper and hence nomination paper of the<\/p>\n<p>petitioner was cancelled.\n<\/p>\n<p><span class=\"hidden_text\">                    3<\/span><\/p>\n<p>          5. The grievance of the petitioner is that he was<\/p>\n<p>not given opportunity to fill up the vacant column with the<\/p>\n<p>signature of the proposer and nomination paper of the<\/p>\n<p>petitioner has been cancelled without giving any<\/p>\n<p>opportunity to the petitioner.     The petitioner thereafter<\/p>\n<p>approached the Collector-cum- District Election Officer,<\/p>\n<p>as well as Office of the Election Commission, Bihar,<\/p>\n<p>Patna, and even filed a petition before the District Election<\/p>\n<p>Officer as well as the State Election Officer by FAX, but<\/p>\n<p>in vain and hence has filed the writ petition to ventilate the<\/p>\n<p>grievance for a direction or issuance of writ by this Court<\/p>\n<p>to make correction in nomination so that he may contest<\/p>\n<p>the election.\n<\/p>\n<p>          6. Learned counsel for the petitioner submits<\/p>\n<p>that petitioner has got right to contest the election and<\/p>\n<p>petition for nomination has         wrongly been rejected<\/p>\n<p>malafidely and arbitrarily and hence there is violation of<\/p>\n<p>Article 14 of the Constitution of India as he has been<\/p>\n<p>devoid to contest the election, if the nomination paper is<\/p>\n<p>not accepted.\n<\/p>\n<p>          7. Learned counsel for the State Election<\/p>\n<p>Commission however, raised preliminary objection that<br \/>\n<span class=\"hidden_text\">                   4<\/span><\/p>\n<p>since the election has been announced and notification for<\/p>\n<p>the election has already been notified, hence, process of<\/p>\n<p>the election has set in.      Hence this Court has no<\/p>\n<p>jurisdiction under Article 226 of the Constitution of India<\/p>\n<p>to entertain any application which touches the election of<\/p>\n<p>the Panchayat in view of Article 243 O of the Constitution<\/p>\n<p>of India and has placed reliance unreported decision in<\/p>\n<p>C.W.J.C. No. 5234 of 2011 (Palti Devi Vrs. The State of<\/p>\n<p>Bihar &amp; Ors.) &amp; 2006 (2) PLJR 482 and 483.\n<\/p>\n<p>          8. Hence in view of respective submission the<\/p>\n<p>question for consideration whether the rejection of<\/p>\n<p>nomination by the Returning Officer is regard of election<\/p>\n<p>of Mukhiya when Panchayat election has been notified<\/p>\n<p>and announced can be interfere in writ jurisdiction.<\/p>\n<p>          9. However in this regard the fact undisputed<\/p>\n<p>that Panchayat election has been notified. In pursuance of<\/p>\n<p>Panchayat election, nomination has been filed by Mukhiya<\/p>\n<p>which has been rejected by the Block Development<\/p>\n<p>Officer-cum-Block Election Officer who is Returning<\/p>\n<p>Officer. However, rejection of nomination by a Returning<\/p>\n<p>Officer is a definite steps toward the election of the<\/p>\n<p>candidate concern as election may be taken to embrace the<br \/>\n<span class=\"hidden_text\">                       5<\/span><\/p>\n<p>whole procedure which consists of several stages whereby<\/p>\n<p>person is declared elected.\n<\/p>\n<p>          10. However it is relevant to quote;\n<\/p>\n<p>          &#8220;Article 243 O- Notwithstanding anything in<\/p>\n<p>this Constitution;-\n<\/p>\n<blockquote><p>                          (a) the validity of any law relating to<br \/>\n                             the delimitation of Constituency<br \/>\n                             or the allotment of seat to such<br \/>\n                             Constituency made or purported<br \/>\n                             to be made of under Atricle 243 K<br \/>\n                             shall not be called in question any<br \/>\n                             court,\n<\/p><\/blockquote>\n<blockquote><p>                          (b) no election to any Panchayat<br \/>\n                             shall be called in question except<br \/>\n                             by an election petition presented<br \/>\n                             to such authority and in such<br \/>\n                             manner as      is provided by or<br \/>\n                             under any law made by the<br \/>\n                             legislature of a State.<\/p><\/blockquote>\n<p>          11. However Article 243 O starts with a non<\/p>\n<p>obstinate clause and Article 243 O (b) provides that<\/p>\n<p>election of Panchayat shall only be called in question by<\/p>\n<p>an election petition presented to such authority and in such<\/p>\n<p>manner as provided by legislature of a State.               The<\/p>\n<p>legislature has provide the mode, to challenge election<br \/>\n<span class=\"hidden_text\">                    6<\/span><\/p>\n<p>under Section 137 and Section 138 of the Bihar Panchayat<\/p>\n<p>Raj Act by election petition before the Munsif        within<\/p>\n<p>whose jurisdiction such Gram Panchayat is situated.<\/p>\n<p>          12. Hence the non-obstinate clause with which<\/p>\n<p>the Article 243 O begins debar the High Court power of<\/p>\n<p>writ jurisdiction or any other court in the land to entertain<\/p>\n<p>a suit or proceeding calling in question the election of<\/p>\n<p>Gram Panchayat.\n<\/p>\n<p>          13. The restriction impose by Article 243 O in<\/p>\n<p>harmony with the principle at hand, if a right is creation<\/p>\n<p>of special statute where in a remedy is provided for<\/p>\n<p>enforcement of such right then that remedy is alone and no<\/p>\n<p>other remedy is available to the person who has been<\/p>\n<p>denied the exercise of that right.\n<\/p>\n<p>          14.   Hence Article 243 O shall prevent over<\/p>\n<p>other part of the Constitution to debar any court, even the<\/p>\n<p>High Court in its jurisdiction of under Article 226 to<\/p>\n<p>provide remedy in case if dispute is with regard to<\/p>\n<p>Panchayat election.\n<\/p>\n<p>          15. Hence the petitioner whose nomination has<\/p>\n<p>been rejected has a remedy by election petition before<\/p>\n<p>Munsif. He is not entitled to seek remedy by means of a<br \/>\n<span class=\"hidden_text\">                          7<\/span><\/p>\n<p>       writ for the purpose of doing that for which there is a<\/p>\n<p>       remedy only by way of election petition.<\/p>\n<p>                 16. Hence the High Court has no power under<\/p>\n<p>       Article 226 of the Constitution of India.<\/p>\n<p>                 17. Hence the writ petition is hereby dismissed.<\/p>\n<pre>m.p.
