Justice K.T.SANKARAN\n\n Dated :06\/01\/2011\n\n O R D E R\n                K.T.SANKARAN, J.\n          ------------------------------\n              Tr.P.(C).No.400 OF 2010\n          ------------------------------\n                      th\n      Dated this the 6  day of January, 2011\n\n\n\n\n                      ORDER\n<\/pre>\n<p>    The petitioner, who is the husband of the<\/p>\n<p>respondent, seeks transfer of OP No.703 of 2010<\/p>\n<p>(filed by the wife) pending before the Family<\/p>\n<p>Court, Malappuram to the Family Court, Thrissur.<\/p>\n<p>    2. The petitioner is residing at Thiruvathra in<\/p>\n<p>Chavavakkad  Taluk,   Thrissur   District.      The<\/p>\n<p>respondent belongs to Palappetty in Ponnani Taluk,<\/p>\n<p>Malappuram  District.   The  Family   Court  having<\/p>\n<p>jurisdiction  is  indisputably  the  Family  Court,<\/p>\n<p>Malappuram.  It is stated that the matrimonial home<\/p>\n<p>is within the jurisdiction of the Family Court,<\/p>\n<p>Thrissur. That means, probably, the Thrissur Family<\/p>\n<p>Court  and   the  Malappuram   Family  Court   have<\/p>\n<p>jurisdiction.  O.P.No.703 of 2010 was filed by the<\/p>\n<p>wife before the Family Court, Malappuram, a court<\/p>\n<p>having jurisdiction.\n<\/p>\n<p><span class=\"hidden_text\">Tr.P.(C).No.400 OF 2010     2<\/span><\/p>\n<p>    3.   The    ground   for  transfer is  that   the<\/p>\n<p>petitioner has to travel about 100 K.M. to appear<\/p>\n<p>before the Family Court at Malappuram and the<\/p>\n<p>respondent has to travel about 80 K.M. to reach<\/p>\n<p>Malappuram.     It is stated that the Family Court,<\/p>\n<p>Thrissur   is   nearer   to  the place  of  both  the<\/p>\n<p>parties.\n<\/p>\n<\/p>\n<p>    4. The ground stated by the petitioner is not<\/p>\n<p>an adequate ground for transferring the case. The<\/p>\n<p>respondent did not put forward any case that she<\/p>\n<p>has  inconvenience     to  appear before  the  Family<\/p>\n<p>Court, Malappuram. The additional distance which<\/p>\n<p>the petitioner has to travel is about 20 K.M. when<\/p>\n<p>compared to the distance to be travelled by the<\/p>\n<p>wife to appear before the Family Court, Malappuram.<\/p>\n<p>    5.   The   learned   counsel for  the  petitioner<\/p>\n<p>submitted that under Section 9 of the Family Courts<\/p>\n<p>Act, a duty is cast on every Family Court to assist<\/p>\n<p><span class=\"hidden_text\">Tr.P.(C).No.400 OF 2010      3<\/span><\/p>\n<p>and persuade the parties to arrive at a settlement.<\/p>\n<p>In the present case, the Family Court did not make<\/p>\n<p>any such an attempt, contents the counsel.        That is<\/p>\n<p>not   a  ground    for   transfer   of   the   case.  The<\/p>\n<p>petitioner can very well point out the same before<\/p>\n<p>the Family Court.      If the procedure prescribed by<\/p>\n<p>the Family Court is not followed, the petitioner<\/p>\n<p>can point out the same before the Appellate Court,<\/p>\n<p>as well.\n<\/p>\n<\/p>\n<p>    6.   The   learned   counsel    for   the  petitioner<\/p>\n<p>submitted that the respondent has claimed an amount<\/p>\n<p>of Rs.7,93,100\/- as the value of the gold ornaments<\/p>\n<p>allegedly   appropriated     by  the   petitioner.     In<\/p>\n<p>ground (F), it is stated by the petitioner as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>    &#8220;F. Now it is quite common in Family Court,<br \/>\n          Malappuram ordering the return of the Gold<br \/>\n          ornaments shown in the marriage photograph<br \/>\n          produced before it without any evidence to<br \/>\n          show   that   those   were   original  gold<br \/>\n          ornaments.   Now the respondent herein has<br \/>\n          claimed an amount of Rs.7,93,100\/- as the<br \/>\n          value of Gold ornaments and money allegedly<br \/>\n          she   had   and   misappropriated   by  the<br \/>\n          petitioner. The petitioner is sure that if<\/p>\n<p><span class=\"hidden_text\">Tr.P.(C).No.400 OF 2010       4<\/span><\/p>\n<p>          the trial of the above case is held at<br \/>\n          Family Court, Malappuram, it will award the<br \/>\n          entire  amount   claimed  in  the  petition<br \/>\n          without any valid evidence.&#8221;<\/p><\/blockquote>\n<p>    7. I do not think that this is a ground for<\/p>\n<p>transfer of the case from Family Court, Malappuram.<\/p>\n<p>If this ground is a ground for transfer, all<\/p>\n<p>similar cases pending before the Family Court,<\/p>\n<p>Malappuram should be transferred to some other<\/p>\n<p>courts.     If the petitioner is aggrieved by any<\/p>\n<p>order passed by the Family Court, he would be free<\/p>\n<p>to raise all the contentions in the appeal.<\/p>\n<p>    No grounds are made out to transfer the case as<\/p>\n<p>prayed for.
