No.27261 of 2010\n                  ARBIND KUMAR SINHA, SON OF LATE RAM PRATAP SINGH\n                                            Versus\n                                     STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>4.   29.09.2010               Heard learned counsel for the petitioner and the<\/p>\n<p>                   State.\n<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                   offence under Sections 25(1-B)A, 26, 30 and 35 of the Arms<\/p>\n<p>                   Act.\n<\/p>\n<p>                              It was submitted that the petitioner&#8217;s mother passed<\/p>\n<p>                   away on 24.9.2010 for which a death certificate has also been<\/p>\n<p>                   issued by the relevant authorities on 28.9.2010 and, therefore,<\/p>\n<p>                   this case has been taken up for out of turn hearing.<\/p>\n<p>                              Considering that the petitioner is in custody since<\/p>\n<p>                   24.4.2010, let the petitioner above named, be released on bail<\/p>\n<p>                   on furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                   sureties of the like amount each or any other surety to be fixed<\/p>\n<p>                   by the court concerned to the satisfaction of Chief Judicial<\/p>\n<p>                   Magistrate, Patna, in Ramkrishna Nagar P.S. Case No. 30 of<\/p>\n<p>                   2010 subject to the following conditions: (i)That one of the<\/p>\n<p>                   bailors will be a close relative of the petitioner who will give an<\/p>\n<p>                   affidavit giving genealogy as to how he is related with the<\/p>\n<p>                   petitioner and the other shall be the son of the petitioner. The<\/p>\n<p>                   bailor will undertake to furnish information to the Court about<\/p>\n<p>                   any change in address of the petitioner. (ii)That the bailor shall<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        also state on affidavit that he will inform the court concerned if<\/p>\n<p>        the petitioner is implicated in any other case of similar nature<\/p>\n<p>        after his release in the present case and thereafter the court<\/p>\n<p>        below will be at liberty to initiate the proceeding for cancellation<\/p>\n<p>        of bail on the ground of misuse. (iii)That the petitioner will give<\/p>\n<p>        an undertaking that he will receive the police papers on the<\/p>\n<p>        given date and be present on date fixed for charge and if he<\/p>\n<p>        fails to do so on two given dates and delays the trial in any<\/p>\n<p>        manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>        misuse.
