         The petitioners are applicants for the post of<\/p>\n
Third Grade Overseer\/Tracer in the department of Public<\/p>\n
Works and Irrigation. The qualifications prescribed are as<\/p>\n
follows:\n<\/p>\n
        (i)    Pass   in   SSLC     examination    or its<\/p>\n
               equivalent qualification and<\/p>\n<\/blockquote>\n
        (ii)   Must     possess    any    one     of  the<\/p>\n
               qualifications mentioned below:<\/p>\n<\/blockquote>\n
            (a)    Lower    Grade    Drawing    Group<\/p>\n
                   Certificate KGTE or equivalent.<\/p>\n<\/blockquote>\n
            (b)    Second Grade Certificate secured<\/p>\n
                   by Draftsmen (Civil) Trainees<\/p>\n
                   under T.T. Scheme, College of<\/p>\n
                   Engineering or under Industria;<\/p>\n
                   Training Centre conducted by<\/p>\n
                   the     Ministry     of     Labour,<\/p>\n
                   Government of India, after a<\/p>\n
                   course of 18 months.\n<\/p><\/blockquote>\n
            (c)    Building Drawing and Estimating<\/p>\n
                   (Higher or Lower) KGTE or<\/p>\n
                   equivalent and any two of the<\/p>\n
                   other Civil Engineering Subjects<\/p>\n
                   under KGTE or equivalent.<\/p>\n<\/blockquote>\n

                    years course) of the Women’s<\/p>\n

                    Rural Engineering given by the<\/p>\n
                    Rural Institute, Thavanur.<\/p>\n
\n\n             (f)    Vocational Higher Secondary\n\n                    course        Certificate    in\n\n                    Draftsmanship    and    Quantity\n\n                    Surveying.\n\n             (g)    Vocational Higher Secondary\n\n<\/pre>\n
                    Course Certificate in Building<\/p>\n
                    Technology.”\n<\/p>\n
         2. The petitioners are certificate holders in ITC<\/p>\n
(Civil) and therefore, they are duly qualified. But the<\/p>\n
petitioners are aggrieved that when the list was<\/p>\n
published, it contained the names of number of persons,<\/p>\n
who are having engineering degree and who do not<\/p>\n
possess the qualification as mentioned in the notification.<\/p>\n
The petitioners have, therefore, approached this court<\/p>\n
for directing the respondents to exclude the persons<\/p>\n
having higher qualifications than that are prescribed in<\/p>\n
Ext.P1 notification.\n<\/p>\n
         3. I heard learned counsel for the petitioner<\/p>\n
Sri.Nagaraj Narayanan and standing counsel for the<\/p>\n
Public Service Commission Sri.Alexander Thomas.<\/p>\n

         4. In my view, the issue is covered against the<\/p>\n
petitioners by the judgment of the Supreme Court<\/p>\n
reported in Jyothi K.K.       v. Kerala Public Service<\/p>\n
Commission<\/a> {JT 2002 (Suppl.1) SC 85}.            Learned<\/p>\n
counsel for the petitioners refers to the judgment of a<\/p>\n
Division Bench of this court reported in Partha Radha<\/p>\n
& ors. v. State of Kerala<\/a> {2000(3) ILR Kerala 53}.<\/p>\n
No doubt, the proposition laid down therein supports the<\/p>\n
case of the petitioners. But I have to take note of the<\/p>\n
fact that the decision of the Supreme Court in Jyothi’s<\/p>\n
case is subsequent to the decision of the Division Bench<\/p>\n
in Partha Radha’s case. This court is bound by the law<\/p>\n
laid down in Jyothi’s case.\n<\/p>\n
         Therefore, I do not find any merit in the writ<\/p>\n
petition. Accordingly, the same is dismissed.<\/p>\n
