Justice V.K.MOHANAN\n\n Dated :14\/12\/2009\n\n O R D E R\n                     C.N.RAMACHANDRAN NAIR &amp;\n                                V.K.MOHANAN, JJ.\n                ....................................................................\n                 Writ Appeal Nos.2275 &amp; 2256 of 2006\n                ....................................................................\n               Dated this the 14th day of December, 2009.\n\n                                       JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>       Appellant IS challenging judgment of the learned Single Judge<\/p>\n<p>holding that appellant and the licencee are jointly and severally liable<\/p>\n<p>under Section 17B of the Employees Provident Fund Act to pay the<\/p>\n<p>liability of the employees. We have in similar cases also held that the<\/p>\n<p>factory owner as well as the licencee are jointly and severally liable to<\/p>\n<p>pay the Provident Fund contribution under Section 17B of the<\/p>\n<p>Employees Provident Fund Act.                        It is for the appellant to claim<\/p>\n<p>reimbursement from the licencee and in fact, Suit filed by the appellant<\/p>\n<p>is stated to be pending. Writ Appeal, therefore, lack any merit and is<\/p>\n<p>dismissed.     Appellant can approach the second respondent-Regional<\/p>\n<p>Provident Fund Commissioner and give a proposal and we are sure the<\/p>\n<p>second respondent will grant reasonable instalment facility for clearing<\/p>\n<p>the arrears on condition of appellant furnishing post-dated Cheques for<\/p>\n<p>recovering amounts on due dates of instalments granted by him. If<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>appellant gives undertaking along with post-dated Cheques, then the<\/p>\n<p>second respondent will direct the Recovery authorities to withhold<\/p>\n<p>recovery proceedings for recovery of arrears in terms of the instalment<\/p>\n<p>facility.
