Justice ANTONY DOMINIC\n\n Dated :02\/12\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                 W.P.(C) NO.34585 OF 2009 (P)\n              --------------------------------------------------\n          Dated this the 2nd day of December, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner retired on 30.6.1989 as Armed Police Inspector,<\/p>\n<p>Malabar Special Police, Malappuram. The name of his wife Smt. K.P.<\/p>\n<p>Padmavathy Amma was entered in the service records for family<\/p>\n<p>pension. It is stated that subsequent to his retirement, the marriage<\/p>\n<p>was dissolved as per judgment dated 19.12.1995 render by the<\/p>\n<p>Sub Court, Ottappalam in O.P.No.40\/1995.<\/p>\n<p>      2.    Thereafter,    the petitioner got married one <a href=\"\/doc\/126511\/\">Smt. V.<\/p>\n<p>Padmavathy Amma. Later<\/a> on 7.8.1998 he made Ext.P3 application<\/p>\n<p>to the 2nd respondent to accord sanction for incorporating the name<\/p>\n<p>of <a href=\"\/doc\/126511\/\">Smt. V. Padmavathy Amma<\/a> for family pension. Though<\/p>\n<p>supporting documents were also produced, still final orders on<\/p>\n<p>Ext.P3 have not been passed and therefore this writ petition is<\/p>\n<p>filed.\n<\/p>\n<p>      3. If as stated by the petitioner, he has filed a proper request,<\/p>\n<p>Ext.P3, before the 2nd respondent for incorporation of the name<\/p>\n<p>his 2nd wife for family pension, there is no reason why the said<\/p>\n<p>WPC.No.34585 \/09<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>request shall not be considered.\n<\/p>\n<p>     4.
