Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/07\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n             W.P.(C)No.26828 of 2008 R\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    This  petition  is  filed  by  the  father   of<\/p>\n<p>deceased Ranjith, whose dead body was found in a<\/p>\n<p>well near to the property of the petitioner on<\/p>\n<p>30.7.2006, under Article 226 of Constitution of<\/p>\n<p>India for a writ of mandamus to constitute a<\/p>\n<p>special  investigation  team  to  probe  into   the<\/p>\n<p>unnatural death of his son Ranjith.\n<\/p>\n<p>    2.   On the night of 29.7.2006, a feast was<\/p>\n<p>arranged in the house of Balachandran, a neighbour,<\/p>\n<p>in  connection  with  naming  of   his  grandchild.<\/p>\n<p>According to the petitioner, Ranjith had gone there<\/p>\n<p>to help preparation of feast. When, on the next day<\/p>\n<p>morning, Ranjth did not return, petitioner made an<\/p>\n<p>enquiry and wife of Balachandran disclosed that he<\/p>\n<p>had returned to the house during early hours. As<\/p>\n<p>Ranjith did not reach the house, a thorough search<\/p>\n<p>was made.  Finally, the dead body was found in the<\/p>\n<p><span class=\"hidden_text\">WPC 26828\/08               2<\/span><\/p>\n<p>well, which was taken with the help of fire force.<\/p>\n<p>Exhibit     P1  postmortem  certificate shows   that<\/p>\n<p>autopsy was conducted by the Forensic Professor,<\/p>\n<p>Medical College Hospital, Alappuzha, which would<\/p>\n<p>reveal that death was due to the combined effect of<\/p>\n<p>head injury and drowning.    It is contended that he<\/p>\n<p>gathered     information  that  on   the  night   of<\/p>\n<p>29.7.2006,     deceased  Ranjith,  along  with   his<\/p>\n<p>friends,     consumed  liquor  from  the  house   of<\/p>\n<p>Balachandran and thereafter there was a quarrel<\/p>\n<p>between them and Ranjith was forcibly removed from<\/p>\n<p>the house and expressing doubt on the death of<\/p>\n<p>Ranjith, Exhibit P2 complaint was submitted to C.I.<\/p>\n<p>of Police, Puthenkurisu. Later, Exhibit P4 petition<\/p>\n<p>was filed     before the Home Minister for a proper<\/p>\n<p>investigation.      Contending   that   no    proper<\/p>\n<p>investigation is being conducted in the case, this<\/p>\n<p>petition is filed.\n<\/p>\n<p>     3. Fifth respondent filed a written statement<\/p>\n<p>to the effect that investigation of the case was<\/p>\n<p><span class=\"hidden_text\">WPC 26828\/08               3<\/span><\/p>\n<p>being conducted by the Sub Inspector of Police till<\/p>\n<p>17.10.2006 and the viscera collected at the time of<\/p>\n<p>autopsy were sent for examination to the Forensic<\/p>\n<p>Science     Laboratory,  Thiruvananthapuram and   it<\/p>\n<p>revealed that alcohol percentage in the blood of<\/p>\n<p>the   deceased   was  74.3%\/100  ml.    It was  also<\/p>\n<p>disclosed that iron rods were found in the well,<\/p>\n<p>where the dead body was found and the investigation<\/p>\n<p>revealed that deceased Ranjith, after consuming<\/p>\n<p>much alcohol, took part in the preparation of feast<\/p>\n<p>and thereafter left the house at about 3.30 a.m.<\/p>\n<p>and on the way, he accidentally fee into the well<\/p>\n<p>and as iron rods were there inside the well, he<\/p>\n<p>sustained injuries on the head and cause of death<\/p>\n<p>was the injuries and drowning and a final report<\/p>\n<p>was submitted before the Sub Divisional Magistrate,<\/p>\n<p>Muvattupuzha on 12.9.2007 itself.\n<\/p>\n<p>     4. Learned counsel appearing for the petitioner<\/p>\n<p>submitted     that  proper  investigation  was  not<\/p>\n<p>conducted and death cannot be an accidental one,<\/p>\n<p><span class=\"hidden_text\">WPC 26828\/08               4<\/span><\/p>\n<p>but   could    only  be  homicide  and  if  a  proper<\/p>\n<p>investigation was conducted, the culprits could<\/p>\n<p>have been brought before law.\n<\/p>\n<p>     5. On hearing the learned counsel and going<\/p>\n<p>through the materials produced, I find no reason to<\/p>\n<p>direct an investigation as sought for.    As a final<\/p>\n<p>report,     after  registration  of  the  case  under<\/p>\n<p>Section 174 of Code of criminal Procedure, was<\/p>\n<p>submitted before the Sub Divisional Magistrate, the<\/p>\n<p>proper remedy of the petitioner is to file a<\/p>\n<p>private complaint before the concerned Magistrate.<\/p>\n<p>If so advised, petitioner is entitled to file a<\/p>\n<p>private complaint.\n<\/p>\n<p>     Petition is dismissed with liberty to file a<\/p>\n<p>private complaint.\n<\/p>\n<p>\n17th July, 2009        (M.Sasidharan Nambiar, Judge)<br \/>\ntkv<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.N.
