No.26 of 2007\n               - - - - - - - - - - - - - - - - - - - - - - - - -\n                     Dated: 20th September, 2007\n\n                                   ORDER\n<\/pre>\n<p>      The Proprietor of M\/s.Judeson Engineering Sales and Service,<\/p>\n<p>an authorised dealer of M\/s.Greaves Cotton Ltd. was awarded with six<\/p>\n<p>works of &#8220;providing comprehensive maintenance of E\/A sets for<\/p>\n<p>various T.E.buildings&#8221; under the BSNL &#8211; TESD-II, Trivandrum, TESD-<\/p>\n<p>Kottarakkara, TESD-Kollam and TESD- Alleppey, TESD-Trivandrum-I<\/p>\n<p>and TESD-Trivandrum III respectively. Annexure A                  are true<\/p>\n<p>photostat copies of the relevant pages of the agreement executed<\/p>\n<p>between the petitioner and the respondents and clause 25 therein is<\/p>\n<p>an arbitration clause. The petitioner claims that he has satisfactorily<\/p>\n<p>completed the work as per the specifications in the agreement. But<\/p>\n<p>the respondents, namely, the Chief General Manager, Kerala<\/p>\n<p>Telecommunications, Trivandrum (R1), the Chief Engineer, Kerala<\/p>\n<p>Zone, BSNL,      Trivandrum (R2), the            Superintending Engineer,<\/p>\n<p>Electrical, BSNL, Trivandrum (R3) and the Executive Engineer,<\/p>\n<p>Telecom Electrical Division, BSNL, Trivandrum (R4) have delayed<\/p>\n<p>disbursement of the remuneration due to the petitioner in a arbitrary<\/p>\n<p>manner and in violation of the agreements executed between the<\/p>\n<p>petitioner and the respondents. The petitioner points out that as<\/p>\n<p><span class=\"hidden_text\">A.R.No.26\/07                        &#8211; 2 &#8211;<\/span><\/p>\n<p>requested by the respondents, he has extended the contract period<\/p>\n<p>by further four months on the same conditions. The petitioner<\/p>\n<p>stopped the work only after a letter in that regard was given by the<\/p>\n<p>respondents. The petitioner has already issued the amount for two<\/p>\n<p>bills for the same rate quoted by the petitioner after completion of<\/p>\n<p>the work. There is no case for the respondents that the petitioner has<\/p>\n<p>not completed the work as per the specifications in the agreement or<\/p>\n<p>that the work done by the petitioner is substandard. It is on account<\/p>\n<p>of the request of the respondents that the petitioner did the work for<\/p>\n<p>a further period of six months. The petitioner relies on Annexure B<\/p>\n<p>counter affidavit filed by the respondents before this court in<\/p>\n<p>W.P.C.No.7098 of 2005 initiated by the petitioner to contend that<\/p>\n<p>even according to the respondents, the petitioner&#8217;s remedy is to<\/p>\n<p>invoke the provisions of the Arbitration Act. Annexure C is the copy of<\/p>\n<p>the judgment in that Writ Petition whereby this court relegated the<\/p>\n<p>petitioner to remedies under the Arbitration Act. Annexure D is copy<\/p>\n<p>of the request made by the petitioner invoking the arbitration clause.<\/p>\n<p>The petitioner points out that the contention raised through the reply<\/p>\n<p>notice Annexure E is only one of limitation. The above contention,<\/p>\n<p>according to the petitioner is unsustainable. On these averments, the<\/p>\n<p><span class=\"hidden_text\">A.R.No.26\/07                        &#8211; 3 &#8211;<\/span><\/p>\n<p>petitioner prays in this application under Section 11(5) of the<\/p>\n<p>Arbitration Act read with clause 2(1) and 2(2) of the Scheme of<\/p>\n<p>Appointment of Arbitrators by the Chief Justice of the High Court of<\/p>\n<p>Kerala that an independent and impartial arbitrator be appointed for<\/p>\n<p>settling the disputes between the petitioner and the respondents.<\/p>\n<p>      2. A counter affidavit has been filed by the respondents wherein<\/p>\n<p>the only serious contention seen raised is that the contention that the<\/p>\n<p>petitioner&#8217;s claim to have the issue settled through arbitration is<\/p>\n<p>barred by limitation.\n<\/p>\n<p>      3. Heard both sides.\n<\/p>\n<p>      4. I am of the view that the question whether the arbitration<\/p>\n<p>proceedings are barred by limitation itself can be made an issue in<\/p>\n<p>the arbitration. Under these circumstances, the Arbitration Request<\/p>\n<p>will stand allowed. Sri.N.D.Joy, Advocate, Neelamkavil Bhavan,<\/p>\n<p>28\/3227, 1st Cross Cheruparambath Road, Kadavanthara, Ernakulam<\/p>\n<p>already empanelled     by this court is appointed as Arbitrator for<\/p>\n<p>resolving the disputes between the petitioner and the respondents<\/p>\n<p>raised through Annexure D.
