MOHANAN, J.\n              ----------------------------------------\n            Bail Application No.2024 of 2010\n              -----------------------------------------\n          Dated this the 16th day of April, 2010\n\n                           O R D E R\n<\/pre>\n<p>         This is an application for regular bail filed by the<\/p>\n<p>petitioner, who is accused in Crime No. 6\/2010 of<\/p>\n<p>Chathannoor Excise Range, in which offences under Section<\/p>\n<p>22(b) of the NDPS Act is involved.\n<\/p>\n<p>     2.   The allegation against the petitioner is that, on<\/p>\n<p>27-2-2010 the accused was found in possession of 7 ampules<\/p>\n<p>of Buprenorphine, measuring 2 ml each and committed<\/p>\n<p>offence u\/s.22(b) of the NDPS Act.<\/p>\n<p>     4.   I have heard learned counsel for the petitioner<\/p>\n<p>and also the learned Public Prosecutor.<\/p>\n<p>     5.   The petitioner is arrested only on 27-2-2010. The<\/p>\n<p>investigation in this case is in progress. Considering the<\/p>\n<p>nature of the offences involved in the case,            I am not<\/p>\n<p>inclined to grant bail to the petitioner at this stage,<\/p>\n<p>especially since the release of the petitioner at this stage is<\/p>\n<p>B.A.No.2024 of 2010<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>likely to affect the investigation adversely and there is no<\/p>\n<p>guarantee that he would not influence the witnesses and<\/p>\n<p>interfere with the investigation.<\/p>\n<p>       In the result, there is no merit in the petition for bail<\/p>\n<p>and accordingly, the same is dismissed.<\/p>\n<p>                                     V.K.MOHANAN,<br \/>\n                                      JUDGE<br \/>\nami\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Arun M.Prasad vs State Of Kerala on 16 April, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 2024 of 2010() 1.
