Rakib\n                                            Versus\n                                   The State Of Bihar\n                                ----------------------------------\n<\/pre>\n<p>3   24-08-2011              Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned Additional Public Prosecutor for the state.<\/p>\n<p>                            Petitioner is in jail custody since 07.03.2011 in a<\/p>\n<p>                 case registered under sections-376, 504\/34 of the Indian<\/p>\n<p>                 Penal Code on the allegation that he committed rape upon the<\/p>\n<p>                 informant of the present case.\n<\/p>\n<p>                            The contention of learned counsel for the petitioner<\/p>\n<p>                 is that Medical Report of the informant does not support the<\/p>\n<p>                 allegation which is Annexure-3 to this petition. It is further<\/p>\n<p>                 contended by him that as a matter of fact, on the alleged date<\/p>\n<p>                 of occurrence, the family members of the informant attacked<\/p>\n<p>                 the house of the petitioner and not only assaulted the<\/p>\n<p>                 petitioner and his other family members but also committed<\/p>\n<p>                 theft of belongings of the petitioner and his other family<\/p>\n<p>                 members for which the petitioner filed Complaint case bearing<\/p>\n<p>                 Complaint Case No. 121 C of 2011 in which, the court after<\/p>\n<p>                 due inquiry, has found prima facie case true under sections-<\/p>\n<p>                 323, 379 of the Indian Penal Code.\n<\/p>\n<p>                            Regard being had to the facts and circumstances of<\/p>\n<p>                 the case as well as submission of the parties; I am not inclined<\/p>\n<p>                 to release the petitioner on bail. Accordingly, his prayer for bail<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>        in connection with Palasi P.S.
