     The revision petitioner is the counter-petitioner in<\/p>\n
CMP.No.8\/2007 on the file of the Sub Divisional Magistrate,<\/p>\n
Perinthalmanna. The first respondent herein filed the above<\/p>\n
petition with an allegation that there existed a public path<\/p>\n
way passing through the western side of the AMLP School,<\/p>\n
Edaikkad and that the revision petitioner who is the<\/p>\n
counter-petitioner before the lower court had obstructed<\/p>\n
the path way. Being satisfied with a prima facie case, the<\/p>\n
Sub Divisional Magistrate issued a conditional order under<\/p>\n
Section 133(1) of the Code of Criminal Procedure.         The<\/p>\n
respondent was called upon to show cause for not making<\/p>\n
the order absolute, if not complied with.<\/p>\n
     2.   The revision petitioner entered appearance and<\/p>\n
filed objection stating that there existed no public path way<\/p>\n
as alleged by the respondents herein.\n<\/p>\n

                             -: 2 :-<\/span><\/p>\n
      3.    The learned Sub Divisional Magistrate called for a<\/p>\n
report from the Village Officer and Addl.Tahsildar. Then<\/p>\n
witnesses from either side were examined and seven<\/p>\n
documents were exhibited. The learned Magistrate finally<\/p>\n
arrived at a conclusion that there existed a road on the<\/p>\n
western side of the AMLP School, Edaikkal and it was<\/p>\n
objected by the revision petitioner herein by constructing<\/p>\n
steps. Accordingly, interim order was made absolute and<\/p>\n
the revision petitioner was directed to remove the steps so<\/p>\n
constructed.\n<\/p>\n
      4.    Assailing the correctness, legality and propriety of<\/p>\n
the order impugned, this revision petitioner was filed.<\/p>\n
Learned counsel on both sides and the learned Public<\/p>\n
Prosecutor were heard.\n<\/p>\n
      5.    As regards the existence of the path way there is<\/p>\n
oath against oath. During the pendency of the proceedings<\/p>\n
the revision petitioner instituted a suit as OS.No.120\/2008<\/p>\n
before the Munsiff’s Court, Perinthalmanna for a permanent<\/p>\n
prohibitory injunction with an allegation against the<\/p>\n
Crl.R.P.No.4035 of 2008.\n<\/p>\n

respondent that he had been attempting to trespass into the<\/p>\n
plaint schedule property.       According to the revision<\/p>\n
petitioner, the plaint schedule property covers so called<\/p>\n
disputed path way. Regarding the identity of the property<\/p>\n
there is dispute. I find that at this stage it need not be<\/p>\n
probed into in this proceedings.      However, the revision<\/p>\n
petitioner    took    out a  commission.     The   advocate<\/p>\n
commissioner inspected the property and filed a report<\/p>\n
along with a sketch. Copy of the report of the commission,<\/p>\n
along with sketch, certified copy of the document relating to<\/p>\n
the property of the respondent, which were marked as<\/p>\n
Ext.P7, were produced during the course of enquiry.<\/p>\n
Though the copy of the document was marked as Ext.P7,<\/p>\n
the lower court didn’t mark the report and sketch submitted<\/p>\n
by the commissioner. According to the learned counsel for<\/p>\n
the revision petitioner, there is no good reason for not<\/p>\n
marking report and sketch which would indicate that there<\/p>\n
exist no public path way as contended by the respondent.<\/p>\n
The learned counsel for the revision petitioner further<\/p>\n
Crl.R.P.No.4035 of 2008.\n<\/p>\n
                             -: 4 :-<\/span><\/p>\n
argued that because of the non marking of the documents,<\/p>\n
he was denied an opportunity to present his case. It was<\/p>\n
also argued that the report submitted by the Village Officer<\/p>\n
would justify the report submitted by the commissioner and<\/p>\n
it is ignoring that the report of the Village Officer that there<\/p>\n
exist no path way, the order impugned was passed.<\/p>\n
      6.    Admittedly, the revision petitioner had taken up<\/p>\n
the matter before the civil court.             In the above<\/p>\n
circumstance, especially in view of Section 137(2) Crl.P.C.,<\/p>\n
I find that the lower court should have refrained from<\/p>\n
passing an order like the one impugned.           A reading of<\/p>\n
Sec.137(1) and (2) would be appropriate.           It reads as<\/p>\n
follows:\n<\/p>\n
                “137. Procedure where existence of
\n         public right is denied:-       (1)  Where an
\n         order is made under section 133 for the
\n         purpose of preventing obstruction, nuisance
\n         or danger to the public in the use of any way
\n         river, channel or place, the Magistrate shall,
\n         on the appearance before him of the person
\n         against whom the order was made, question
\n         him as to whether he denies the existence of
\n         any public right in respect of the way, river,
\n         channel or place, and if he does so, the
\n         Magistrate shall, before proceeding under<\/p>\n
Crl.R.P.No.4035 of 2008.\n<\/p><\/blockquote>\n
                             -: 5 :-<\/span><\/p>\n
         section 138, inquire into the matter.”\n<\/p><\/blockquote>\n
                (2) If in such inquiry the Magistrate
\n         finds that there is any reliable evidence in
\n         support of such denial, he shall stay the
\n         proceedings     until  the  matter   of the
\n         existence of such right has been decided by
\n         a competent Court; and if he finds that
\n         there is no such evidence, he shall proceed
\n         as laid down in section 138.”<\/p><\/blockquote>\n
      7.    In this case, Ext.P7 document produced by the<\/p>\n
revision petitioner would show that there was no public<\/p>\n
path way leading to the property of the respondent as<\/p>\n
contended by the revision petitioner.      On a prim facie<\/p>\n
perusal of the report of the commission also would show<\/p>\n
that there existed no public path way leading to the<\/p>\n
property of the respondent.      In the above circumstance,<\/p>\n
there is some reliable evidence in support of such denial.<\/p>\n
That being the materials on record, the lower authority<\/p>\n
would have stayed the proceedings as contemplated under<\/p>\n
Sec.137(2) Crl.P.C. until the matter has been decided by<\/p>\n
the competent civil court. In this view of the matter, I find<\/p>\n
that the order impugned is not sustainable and it is liable to<\/p>\n
be set aside and the proceeding is to be stayed under<\/p>\n
Crl.R.P.No.4035 of 2008.\n<\/p>\n

Sec.137(2) Crl.P.C.\n<\/p>\n
      8.    In the result, the revision petition is allowed. The<\/p>\n
order impugned is set aside and remanded back to the<\/p>\n
lower authority for fresh disposal after the disposal of the<\/p>\n
suit OS.No.120\/2008 on the file of the Munsiff’s Court,<\/p>\n
Perinthalmanna.         Till the civil suit is decided, the<\/p>\n
proceedings would stand stayed under Sec.137(2) Crl.P.C.<\/p>\n
      9.    The learned counsel for the respondent submitted<\/p>\n
for a direction to maintain status quo. Since the matter has<\/p>\n
been seized by the civil court the parties are bound to<\/p>\n
maintain status quo till the suit is disposed or until<\/p>\n
otherwise it was ordered by the civil court or thereafter an<\/p>\n
order is passed by the lower court, in case it was<\/p>\n
warranted. The lower court shall dispose of the proceeding<\/p>\n
untrammelled by the observations made in this order.<\/p>\n
