  25t6′;’2Q03, at about 9.45 p.m,, the appellant<\/p>\n
 alozzg  were proceeding on motor cycle<\/p>\n
   39\/C-3650. When they reached<\/p>\n

~  gip;jeItant’s vehicle, as a result of which the rider along<\/p>\n
”  pinion rider and the motor bike fell down sustaining<\/p>\n

gievous ixljuxies to the rider and pillion rider of the motor
\ncycle. So tar as the rash and negligent driving of the<\/p>\n
driver of the lorry, the Tribunal has held that the aceident<\/p>\n
was due to the negligence of the driver of the <\/p>\n
same is not questioned by the respo:did.enii_1″~  _  <\/p>\n
Therefore, we are not making  <\/p>\n
said question,<\/p>\n

too low x\u00e9fheh  the injuries suffered by the<\/p>\n

  evidence of P.W.—-1 appellant and the<\/p>\n
 medicaid’ Alreeords, we \ufb01nd that the appellant sustained<\/p>\n
V’ “fi’a;(i’iZ1;tI’eH0f right femur, fracture of both bones of right leg,<\/p>\n
‘   cut injury exposing the tendons of the right foot<\/p>\n
  12 cm x 8 cm with fracture of 2nd metatarcel of<\/p>\n

right foot So far as right hand is concerned there was
\ndeformity of right little finger and subsequently, the
\nfracture of little \ufb01nger, 4th and 591 metacarpals were<\/p>\n
disclosed. So far as femur and both bones of right<\/p>\n
fractures were reduced by inserting screws  _<\/p>\n
skin grai\ufb01ng was done on the right foot.    <\/p>\n
were conservatively treated. He v\u00e9ss inps\ufb01enton the-.,_\ufb01rs.t.’<\/p>\n

under process of union and ma} union of second<\/p>\n
‘x__metaLarsa1Vis noticed. With this, there is sti\ufb01less in the<\/p>\n
A “rand right leg is shortened by 2”. For walking, he has<\/p>\n
.’  use clutches. According to the Doctor, with the best<\/p>\n
possible treamzent, he would not be 100% normal person<\/p>\n
and the appellant needs support to walk through out his
\nlife. With all these, he o\ufb01ers disability of 60% to the right<\/p>\n
leg [permanent disabiiity) and 40\u00b0\/o to the total body’ So<\/p>\n
far as right hand, no permanent disability of any <\/p>\n
described.\n<\/p>\n

\nmonthly salary of Rs.3,080\/– irxoltidirxgi  <\/p>\n
tax of 123.30\/~ as on the date_v’of.aceirieV:ni;. _  <\/p>\n
at Ex.P.8 issued by   ..SWemyVVf\u00a7Temp1e,<\/p>\n
Kollegal Taluk shows Vlieiiiivas-. oiilesiteii  10 months and<\/p>\n
10 days  sleeve to his credit either earned.
\nieave or’mediea1″1eaiie.Ti1iefJefore, he was on loss of pay.<\/p>\n
The gresponxiexits ‘Have’ not challenged this certificate and<\/p>\n
  fact\ufb02mtihat no appeal is \ufb02ied, we need not<\/p>\n
V’geV:Vm’1ineness of the contents of Ex. P.8 and R9.<\/p>\n
  we look at the quantum of compensation<\/p>\n
it it  J’und_er.di\ufb01”ere11t heads awarded by the Tribunal, we are of<\/p>\n
  Hie’ opi:t1ion there is no basis or any formula on which<\/p>\n
  -assessment was made. Though under general damages,<\/p>\n
compensation is awarded towards injury, paiI1;'”–and<\/p>\n
suffering, medical expenses are also included  V.<\/p>\n
awarding special damages of Rs.69,220\/– as     <\/p>\n
There is no reasoning how the   <\/p>\n
came to be awarded for each    <\/p>\n
damages towards medical expenses of—  swas ‘V<\/p>\n
granted. Similarly, tiie\ufb02leatnegi’ ggggnper  \u00a2f* mg MACT
\nignored the permanent   the appellant,
\nwhich affected’    ;I’herefore, some
\namount ”   towards permanent
\n   life, future expenses
\n and nourishment The cost<\/p>\n
of   a;:d%\u00a2:hei4 disability is also totally ignored<\/p>\n
 ,.,.,by-itii1e:p_’1earnedAMember of the MACT. So far as loss of<\/p>\n
  “the leave period, the Tribunal ig;nored the<\/p>\n
 made by the appellant towards life<\/p>\n
 ixtsurantie, GPF etc. were to his bene\ufb01ts and even during<\/p>\n
“period of his leave those amounts would have been<\/p>\n
   and deducted towards premium. The only<\/p>\n
statutory deduction ought to have been towards<\/p>\n
professiona} tax i.e., Rs.30\/–. in the light of the above<\/p>\n
Ieasoning, we are of the opinion the general <\/p>\n
damages have to be assessed properly   V’<\/p>\n
awarding the following amounts:\n<\/p>\n
General damages:\n<\/p>\n
1. Towards  pain + . S}.,()Uf)]~–\n<\/p>\n

costs, enhancixxg the compensation to Rs.2,42,445\/~ as<\/p>\n
