The certificate of Muljibhai Patel<br \/>\nUrological Hospital at page 33 at Annexure G states that the<br \/>\napplicant is to be admitted on 12th<br \/>\nSeptember, 2010 for the surgery which is scheduled on 13th<br \/>\nSeptember, 2010. Therefore, learned advocate Mr.Hriday Buch for the<br \/>\napplicant has submitted that the present application may be allowed.\n<\/p>\n<p>2.\tLearned A.P.P.\n<\/p>\n<p>Ms.Mini Nair has, on verification, confirmed about the fact that the<br \/>\napplicant is required to undergo a surgery as stated in the<br \/>\napplication.\n<\/p>\n<p>3.\tIn view of the<br \/>\nreasons stated in the application requesting for grant of temporary<br \/>\nbail on medical ground, the present application deserves to be<br \/>\nallowed.\n<\/p>\n<p>4.\tAccordingly,<br \/>\nthe application stands partly allowed. The applicant-accused is<br \/>\nordered to be released on temporary bail for a period upto<br \/>\n03.10.2010 on<br \/>\nhis executing a personal bond of Rs.5,000\/- before the jail authority<br \/>\nsubject to the conditions that he shall;\n<\/p>\n<p>a.\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>b.\tnot abuse the liberty<br \/>\ngranted to him;\n<\/p>\n<p>c.\tsurrender his<br \/>\npassport to the concerned \tjail authority;\n<\/p>\n<p>d.\tnot leave Nadiad town<br \/>\nwithout prior \tpermission of this Court.\n<\/p>\n<p>5.\tThe<br \/>\napplicant shall surrender to the jail authority on 04.10.2010.\n<\/p>\n<p>6.\tRule<br \/>\nis made absolute accordingly to the aforesaid extent.
