The sole contention raised by him is that the<br \/>\nmother of the appellant who is an old lady is seriously ill in<br \/>\nPoland and she has expressed a desire to see her only son.<br \/>\nHe referred to a copy of the letter dated 15.5.2001 received<br \/>\nfrom the Consulate of the Republic of Poland in Mumbai to<br \/>\nthe Minister of Jails (Gujarat)\t requesting him to grant<br \/>\nremission of the remaining period of sentence (then 7<br \/>\nmonths) on compassionate and humanitarian grounds.<br \/>\nLearned counsel further contended that the appellant has<br \/>\nalready undergone substantial part of the sentence which is<br \/>\nto be completed in December, 2001.  In view of the<br \/>\nsubsequent development after the judgment of the High<br \/>\nCourt the learned counsel contended that this Court may<br \/>\nreduce the sentence to the period of imprisonment already<br \/>\nundergone and order release of the appellant immediately.\n<\/p>\n<p>\tSri T.V.Ratnam, learned counsel for the respondents<br \/>\ncontended that in view of the serious allegations made<br \/>\nagainst the appellant in the case this Court should not<br \/>\naccept the prayer for modification of the sentence.\n<\/p>\n<p>\tFrom the discussions in the judgment of the High Court<br \/>\nit appears that a plea for reduction of the sentence was<br \/>\nmade on behalf of the appellant before the Court. The High<br \/>\nCourt referring to the judgment of this Court in the case of<br \/>\nDevchand Kalyan Tandel Vs. State of Gujarat reported in<br \/>\n1997 (89) E.L.T. 433 (S.C.) and the case of K.I.Pavunnv vs.<br \/>\nAssistant Collector (H.Q.) Central Excise, Collectorate,<br \/>\nCochin, reported in 1997 (90) E.L.T. 241 (S.C.) declined to<br \/>\ntake a lenient view in the matter and rejected the plea for<br \/>\nreduction of the period of the sentence.\n<\/p>\n<p>\t<a href=\"\/doc\/1599972\/\">In K.T. Pavunny vs. Assistant Collector<\/a> case (supra)<br \/>\nthis Court altered the sentence.  The operative portion of the<br \/>\njudgment reads as follows:\n<\/p>\n<p>&#8220;Having reached the finding that the appellant<br \/>\nhas committed the offences under section<br \/>\n135(1)(i) of the Act and Sections 85(1)(a) and<br \/>\n86 of the Gold (Control) Act, 1968 we think<br \/>\nthat instead of being committed to jail, the<br \/>\nappellant should be sentenced to pay fine of<br \/>\nRs.10,000 and Rs.5,000 respectively for the<br \/>\ntwo aforementioned offences, within 4 months<br \/>\nfrom today. In default, he shall undergo<br \/>\nimprisonment for a period of 2 months and 1<br \/>\nmonth respectively which are directed to run<br \/>\nconsecutively.\n<\/p>\n<p>\tThe appeal  is accordingly allowed to<br \/>\nthe above extent of modification and the<br \/>\nsentences imposed by the High Court stand<br \/>\nmodified accordingly.&#8221;\n<\/p>\n<p>\tWe have considered the prayer  of the appellant for<br \/>\nreduction of sentence to the period already undergone.\tWe<br \/>\nhave also perused the observations made by this Court in<br \/>\nthe case of <a href=\"\/doc\/980562\/\">Devchand Kalyan Tandel vs. State of Gujarat<\/a><br \/>\n(supra) and the judgment in <a href=\"\/doc\/1263819\/\">K.T. Pavunny vs. Asstt.<br \/>\nCollector (H.Q.) Central Excise, Collectorate, Cochin<br \/>\n(Supra),<\/a>  in which this Court altered the sentence<br \/>\nsubstituting the period of imprisonment. We are of the view<br \/>\nthat on the facts and in the circumstances of the case,<br \/>\nconsidering the illness of the mother of the appellant who is<br \/>\nan old lady which fact has been authenticated by the<br \/>\nConsulate of the  Republic of Poland and a short period of<br \/>\nabout four months  is left for completion of the sentence, the<br \/>\nprayer of the appellant for reduction of  sentence should be<br \/>\nallowed.  Accordingly, while maintaining the conviction of the<br \/>\nappellant, the order of sentence is modified to the extent of<br \/>\nthe period of imprisonment already undergone by him.
