The aforesid suit<br \/>\nwas filed by the respondent herein &#8211; original plaintiff.  The<br \/>\nlearned trial Judge partially allowed the said suit  and directed the<br \/>\npetitioner herein to pay mesne profit at the rate of Rs.425 per month<br \/>\nto the plaintiff till the realisation of possession of suit premises.<br \/>\n   The petitioner herein filed appeal against the aforesaid order.\n<\/p>\n<p>\tDuring<br \/>\nthe pendency of the appeal, the respondent &#8211; original plaintiff<br \/>\nhas filed Execution  Petition No.29 of 2008 before the executing<br \/>\ncourt.   The petitioner has, therefore, filed application Exhibit 15<br \/>\npraying for stay of the execution proceedings.  The said application<br \/>\nis rejected by the appellate court.  If the said application is not<br \/>\ngranted, then, the appeal of the petitioner would become infructuous.<br \/>\n   Hence, the order of the appellate Court is required to quashed and<br \/>\nset aside and execution proceedings are stayed pending the appeal.\n<\/p>\n<p>\tIt<br \/>\nis open for the respondent to move an application before the<br \/>\nappellate court to hear and dispose of the appeal expeditiously and<br \/>\nin any case within 90 days either from the date of receipt of writ of<br \/>\nthis Court or from the date of application, which is to be filed by<br \/>\nthe respondent.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid observations and directions, petition is allowed.
