Case No. 231 of 2005 for alleged<\/p>\n<p>     offence under Sections 33, 41 and 42 of the Indian Forest Act<\/p>\n<p>     pending in the court of Chief Judicial Magistrate, Hazaribagh,<\/p>\n<p>     (now pending in the court of K. Pattadar, Judicial Magistrate, 1st<\/p>\n<p>     Class, Hazaribagh). The petitioner has also filed an Interlocutory<\/p>\n<p>     Application whereby he challenged the order dated 17.06.2006<\/p>\n<p>     passed by Chief Judicial Magistrate, Hazaribagh in G. Case No.<\/p>\n<p>     231 of 2005 corresponding to T.R. Case No. 232 of 2009, whereby<\/p>\n<p>     and whereunder he took cognizance of the offence under Sections<\/p>\n<p>     33, 41 and 42 of the Indian Forest Act.\n<\/p>\n<p>     2           The    case   of   prosecution   in   brief   is   that   on<\/p>\n<p>     14.05.2005, the complainant, Forest Range Officer of Gola Range<\/p>\n<p>     had intercepted a truck bearing no. PB-07B 3966 loaded with<\/p>\n<p>     coal. It is further alleged that after seeing the complainant, the<\/p>\n<p>     driver fled away however, khalasi of the truck was arrested and<\/p>\n<p>     on demand he could not produce any document relating to transit<\/p>\n<p>     of coal. Accordingly, the coal was seized and an offence report<\/p>\n<p>     was sent to Chief Judicial Magistrate, Hazaribagh. It then<\/p>\n<p>     appears that after obtaining the sanction from the Divisional<\/p>\n<p>     Forest Officer, Ramgarh Forest Division, the prosecution report<\/p>\n<p>     was submitted in the court of Chief Judicial Magistrate,<\/p>\n<p>     Hazaribagh, who, vide order dated 17.06.2006, took cognizance of\n<\/p>\n<p>                            -2-                   [Cr.M.P. No. 853 of 2005]<\/p>\n<p>the offences under Sections 33, 41 and 42 of the Indian Forest<\/p>\n<p>Act.\n<\/p>\n<p>3.            It is submitted by Sri Anil Kumar, learned counsel for<\/p>\n<p>the petitioner that from perusal of offence report as well as the<\/p>\n<p>prosecution report, no case under sections 33, 41 and 42 of the<\/p>\n<p>Indian Forest Act is made out.          Hence, the entire criminal<\/p>\n<p>proceeding including the order taking cognizance, is an abuse of<\/p>\n<p>the process of the court. Hence, the same cannot be sustained by<\/p>\n<p>this court.\n<\/p>\n<p>4.            Learned   Additional   P.P.   however    submits      that<\/p>\n<p>petitioner had not followed transit rules for transporting the coal<\/p>\n<p>and therefore, he had violated the provisions of Forest Act.<\/p>\n<p>Hence, there is no illegality in the prosecution of accused<\/p>\n<p>petitioner.\n<\/p>\n<p>5.            Having heard the submission, I have gone through<\/p>\n<p>the record of the case. Admittedly, the prosecution report has<\/p>\n<p>been filed under Sections 33, 41 and 42 of the Indian Forest Act.<\/p>\n<p>From perusal of Section 33 of the Indian Forest Act, it appears<\/p>\n<p>that it prescribes punishment to any person who contravenes the<\/p>\n<p>notification under Section 30 or rule framed under Section 32 of<\/p>\n<p>the Indian Forest Act. Section 30 and Section 32 of the Indian<\/p>\n<p>Forest Act run hereinunder:\n<\/p>\n<blockquote><p>              &#8220;30. Power to issue notification reserving trees,<br \/>\n              etc. &#8211; The State Government may, by notification in<br \/>\n              the Official Gazette,-\n<\/p><\/blockquote>\n<blockquote><p>              (a) declare any trees or class of trees in a protected<br \/>\n              forest to be reserved from a date fixed by the<br \/>\n              notification;\n<\/p><\/blockquote>\n<blockquote><p>              (b) declare that any portion of such forest specified in<br \/>\n              the notification shall be closed for such term, not<br \/>\n              exceeding thirty years, as the State Government<br \/>\n              thinks fit, and that the rights of private persons, if<br \/>\n              any, over such portion shall be suspended during<br \/>\n              such term provided that the remainder of such forest<br \/>\n              be sufficient, and in a locality reasonably convenient,<br \/>\n              for the due exercise of the right suspended in the<br \/>\n              portion so closed; or\n<\/p><\/blockquote>\n<blockquote><p>                           -3-                   [Cr.M.P. No. 853 of 2005]<\/p>\n<\/blockquote>\n<blockquote><p>            (c) prohibit, from a date fixed as aforesaid, the<br \/>\n            quarrying of stone, or the burning of lime or charcoal,<br \/>\n            or the collection or subjection to any manufacturing<br \/>\n            process, or removal of, any forest-produce in any<br \/>\n            such forest, and the breaking up or clearing for<br \/>\n            cultivation, for building, for herding cattle or for any<br \/>\n            other purpose, of any land in any such forest.\n<\/p><\/blockquote>\n<blockquote><p>            32. Power to make rules for protected forests.-<br \/>\n            The State Government may make rules to regulate<br \/>\n            the following matters, namely : &#8211;\n<\/p><\/blockquote>\n<blockquote><p>            (a) the cutting, sawing, conversion and removal of<br \/>\n            trees and timber, and the collection, manufacturing<br \/>\n            and removal of forest-produce, from protected forest;\n<\/p><\/blockquote>\n<blockquote><p>            (b) the granting of licences to the inhabitants of<br \/>\n            towns and villages in the vicinity of protected forests<br \/>\n            to take trees, timber or other forest-produce for their<br \/>\n            own use, and the production and return of such<br \/>\n            licences by such persons;\n<\/p><\/blockquote>\n<blockquote><p>            (c) the granting of licences to persons feeling or<br \/>\n            removing trees or timber or other forest-produce from<br \/>\n            such forests for the purposes of trade, and the<br \/>\n            production and return of such licences by such<br \/>\n            persons;\n<\/p><\/blockquote>\n<blockquote><p>            (d) the payments, if any, to be made by the persons<br \/>\n            mentioned in clause (b) and (c) for permission to cut<br \/>\n            such trees, or to collect and remove such timber or<br \/>\n            other forest-produce;\n<\/p><\/blockquote>\n<blockquote><p>            (e) the other payments, if any to be made by them in<br \/>\n            respect of such trees, timber and produce, and the<br \/>\n            places where such payment shall be made;\n<\/p><\/blockquote>\n<blockquote><p>            (f) the examination of forest-produce passing out of<br \/>\n            such forests;\n<\/p><\/blockquote>\n<blockquote><p>            (g) the clearing and breaking up of land for<br \/>\n            cultivation or other purposes in such forests;\n<\/p><\/blockquote>\n<blockquote><p>            (h) the protection from fire of timber lying in such<br \/>\n            forests and of trees reserved under section 30;\n<\/p><\/blockquote>\n<blockquote><p>            (i) the cutting of grass and posturing of cattle in such<br \/>\n            forests;\n<\/p><\/blockquote>\n<blockquote><p>            (j) hunting, shooting, fishing, poisoning water and<br \/>\n            settling traps or snares in such forests, and the<br \/>\n            killing or catching of elephants in such forests in<br \/>\n            areas in which the Elephants Preservation Act, 1879<br \/>\n            (6 of 1879) is not in force;\n<\/p><\/blockquote>\n<blockquote><p>            (k) the protection and management of any portion of<br \/>\n            a forest closed under Section 30; and\n<\/p><\/blockquote>\n<blockquote><p>            (l) the exercise of rights referred to in Section 29.&#8221;<\/p><\/blockquote>\n<p>            Section 41 of the Indian Forest Act gives power to<\/p>\n<p>make rule to regulate transit of forest produce and Section 42 of<\/p>\n<p>the Indian Forest Act prescribes punishment for violation of<\/p>\n<p>transit rules made under Section 41 of the Indian Forest Act.\n<\/p>\n<p>                                 -4-                   [Cr.M.P. Thus, from the plain reading of Sections 30, 32 and<\/p>\n<p>      41 of the Indian Forest Act, it is clear that under the said Act, the<\/p>\n<p>      State Government have no power to issue any notification or<\/p>\n<p>      frame rule for transit of coal. From perusal of prosecution report,<\/p>\n<p>      it is clear that there is no allegation against the petitioner or any<\/p>\n<p>      other accused persons that they were mining the coal in forest<\/p>\n<p>      area.   Admittedly, the coal in question is not a forest produce.<\/p>\n<p>      Thus, the rule for transit of Forest produce framed under Section<\/p>\n<p>      41 of the Indian Forest Act has no application in the case of<\/p>\n<p>      transit of coal. Under the said circumstance, Section 42 of Indian<\/p>\n<p>      Forest Act has no application.\n<\/p>\n<p>      7.          As noticed above, there is no notification or rule<\/p>\n<p>      framed by the State Government under Sections 30 and 32 of the<\/p>\n<p>      Indian Forest Act for transportation of coal. Therefore Section 33<\/p>\n<p>      will also not apply. Thus, if the allegation made in the prosecution<\/p>\n<p>      report is taken to be true on its face value, no offence under<\/p>\n<p>      Sections 33, 41 and 42 of the Indian Forest Act is made out.<\/p>\n<p>      8.          Under the said circumstances, I find that initiation of a<\/p>\n<p>      criminal proceeding under the aforesaid sections of the Indian<\/p>\n<p>      Forest Act is an abuse of the process of the court which could not<\/p>\n<p>      be sustained.\n<\/p>\n<p>      9.          In the result, this application is allowed. Consequently,<\/p>\n<p>      the entire criminal proceeding as well as impugned order dated<\/p>\n<p>      17.06.2006 in connection with G. Case No. 231 of 2005 pending in<\/p>\n<p>      the court of K.
